<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id26b0567b-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20109"><num value="20109">§ 20109.</num><heading> Sexual assault survivors’ notification grants</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26b0567c-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20109/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I11" class="indent0">The Attorney General may make grants as provided in <ref href="/us/usc/t34/s20103/c/1/A">section 20103(c)(1)(A) of this title</ref> to States to develop and disseminate to entities described in subsection (c)(1) of this section written notice of applicable rights and policies for sexual assault survivors.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26b0567d-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20109/b"><num value="b" class="bold">(b)</num><heading class="bold"> Notification of rights</heading><chapeau style="-uslm-lc:I11" class="indent0">Each recipient of a grant awarded under subsection (a) shall make its best effort to ensure that each entity described in subsection (c)(1) provides individuals who identify as a survivor of a sexual assault, and who consent to receiving such information, with written notice of applicable rights and policies regarding—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id26b0567e-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20109/b/1"><num value="1">(1)</num><content> the right not to be charged fees for or otherwise prevented from pursuing a sexual assault evidence collection kit;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26b0567f-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20109/b/2"><num value="2">(2)</num><content> the right to have a sexual assault medical forensic examination regardless of whether the survivor reports to or cooperates with law enforcement;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26b05680-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20109/b/3"><num value="3">(3)</num><content> the availability of a sexual assault advocate;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26b05681-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20109/b/4"><num value="4">(4)</num><content> the availability of protective orders and policies related to their enforcement;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26b05682-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20109/b/5"><num value="5">(5)</num><content> policies regarding the storage, preservation, and disposal of sexual assault evidence collection kits;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26b05683-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20109/b/6"><num value="6">(6)</num><content> the process, if any, to request preservation of sexual assault evidence collection kits or the probative evidence from such kits; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26b05684-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20109/b/7"><num value="7">(7)</num><content> the availability of victim compensation and restitution.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26b05685-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20109/c"><num value="c" class="bold">(c)</num><heading class="bold"> Dissemination of written notice</heading><chapeau style="-uslm-lc:I11" class="indent0">Each recipient of a grant awarded under subsection (a) shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id26b05686-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20109/c/1"><num value="1">(1)</num><content> provide the written notice described in subsection (b) to medical centers, hospitals, forensic examiners, sexual assault service providers, State and local law enforcement agencies, and any other State agency or department reasonably likely to serve sexual assault survivors; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26b05687-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20109/c/2"><num value="2">(2)</num><content> make the written notice described in subsection (b) publicly available on the Internet website of the attorney general of the State.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26b05688-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20109/d"><num value="d" class="bold">(d)</num><heading class="bold"> Provision to promote compliance</heading><content><p style="-uslm-lc:I11" class="indent0">The Attorney General may provide such technical assistance and guidance as necessary to help recipients meet the requirements of this section.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26b07d99-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20109/e"><num value="e" class="bold">(e)</num><heading class="bold"> Integration of systems</heading><content><p style="-uslm-lc:I11" class="indent0">Any system developed and implemented under this section may be integrated with an existing case management system operated by the recipient of the grant if the system meets the requirements listed in this section.</p>
