L. 104–294, title VI, § 604(b)(9), Oct. 11, 1996, 110 Stat. 3507.)","seq_in_title":451,"parent_identifier":"/us/usc/t34/stII/ch201/schI","ancestors":[{"identifier":"/us/usc/t34","level":"title","num":"Title 34—","heading":"CRIME CONTROL AND LAW ENFORCEMENT","status":null,"is_section":false},{"identifier":"/us/usc/t34/stII","level":"subtitle","num":"Subtitle II—","heading":"Protection of Children and Other Persons","status":null,"is_section":false},{"identifier":"/us/usc/t34/stII/ch201","level":"chapter","num":"CHAPTER 201—","heading":"VICTIM RIGHTS, COMPENSATION, AND ASSISTANCE","status":null,"is_section":false},{"identifier":"/us/usc/t34/stII/ch201/schI","level":"subchapter","num":"SUBCHAPTER I—","heading":"CRIME VICTIMS FUND","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id26b07d9d-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20110\"><num value=\"20110\">§ 20110.</num><heading> Administrative provisions</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26b07d9e-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20110/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Authority of Director to establish rules and regulations</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Director may establish such rules, regulations, guidelines, and procedures as are necessary to carry out any function of the Director under this subchapter.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26b07d9f-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20110/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Recordkeeping</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Each recipient of sums under this subchapter shall keep such records as the Director shall prescribe, including records that fully disclose the amount and disposition by such recipient of such sums, the total cost of the undertaking for which such sums are used, and that portion of the cost of the undertaking supplied by other sources, and such other records as will facilitate an effective audit.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26b07da0-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20110/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Access of Director to books and records for purpose of audit and examination</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Director shall have access, for purpose of audit and examination, to any books, documents, papers, and records of the recipient of sums under this subchapter that, in the opinion of the Director, may be related to the expenditure of funds received under this subchapter.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26b07da1-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20110/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Revealing research or statistical information; prohibition; immunity from legal proceedings; permission; admission of information as evidence</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Except as otherwise provided by Federal law, no officer or employee of the Federal Government, and no recipient of sums under this subchapter, shall use or reveal any research or statistical information furnished under this subchapter by any person and identifiable to any specific private person for any purpose other than the purpose for which such information was obtained in accordance with this subchapter. Such information, and any copy of such information, shall be immune from legal process and shall not, without the consent of the person furnishing such information, be admitted as evidence or used for any purpose in any action, suit, or other judicial, legislative, or administrative proceeding.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26b0a4b2-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20110/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Discrimination prohibited</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">No person shall on the ground of race, color, religion, national origin, handicap, or sex be excluded from participation in, denied the benefits of, subjected to discrimination under, or denied employment in connection with, any undertaking funded in whole or in part with sums made available under this subchapter.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26b0a4b3-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20110/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Failure to comply with provisions; notice and hearing; power of Director</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">If, after reasonable notice and opportunity for a hearing on the record, the Director finds that a State has failed to comply substantially with any provision of this subchapter or a rule, regulation, guideline, or procedure issued under this subchapter, or an application submitted in accordance with this subchapter or the provisions of any other applicable law, the Director shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26b0a4b4-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20110/f/1\"><num value=\"1\">(1)</num><content> terminate payments to such State;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26b0a4b5-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20110/f/2\"><num value=\"2\">(2)</num><content> suspend payments to such State until the Director is satisfied that such noncompliance has ended; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26b0a4b6-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20110/f/3\"><num value=\"3\">(3)</num><content> take such other action as the Director deems appropriate.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26b0a4b7-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20110/g\"><num value=\"g\" class=\"bold\">(g)</num><heading class=\"bold\"> Report</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Director shall, on <date date=\"1990-12-31\">December 31, 1990</date>, and on June 30 every two years thereafter, report to the President and to the Congress on the revenue derived from each source described in <ref href=\"/us/usc/t34/s20101\">section 20101 of this title</ref> and on the effectiveness of the activities supported under this subchapter. The Director may include in such report recommendations for legislation to improve this subchapter.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26b0a4b8-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20110/h\"><num value=\"h\" class=\"bold\">(h)</num><heading class=\"bold\"> Maintenance of effort</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Each entity receiving sums made available under this subchapter for administrative purposes shall certify that such sums will not be used to supplant State or local funds, but will be used to increase the amount of such funds that would, in the absence of Federal funds, be made available for these purposes.</p>\n</content>\n</subsection>\n<sourceCredit id=\"id26b0a4b9-0f21-11eb-9212-a1a9175aa019\">(<ref href=\"/us/pl/98/473/tII/s1407\">Pub.
