<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id26b11a01-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20121"><num value="20121">§ 20121.</num><heading> Legal assistance for victims</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26b11a02-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20121/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I11" class="indent0">The purpose of this section is to enable the Attorney General to award grants to increase the availability of civil and criminal legal assistance necessary to provide effective aid to adult and youth victims of domestic violence, dating violence, stalking, or sexual assault who are seeking relief in legal matters relating to or arising out of that abuse or violence, at minimal or no cost to the victims. Criminal legal assistance provided for under this section shall be limited to criminal matters relating to or arising out of domestic violence, sexual assault, dating violence, and stalking.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26b11a03-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20121/b"><num value="b" class="bold">(b)</num><heading class="bold"> Definitions and grant conditions</heading><content><p style="-uslm-lc:I11" class="indent0">In this section, the definitions and grant conditions provided in <ref href="/us/usc/t34/s12291">section 12291 of this title</ref> shall apply.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26b11a04-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20121/c"><num value="c" class="bold">(c)</num><heading class="bold"> Legal assistance for victims grants</heading><chapeau style="-uslm-lc:I11" class="indent0">The Attorney General may award grants under this subsection to private nonprofit entities, Indian tribal governments and tribal organizations, territorial organizations, and publicly funded organizations not acting in a governmental capacity such as law schools, and which shall be used—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id26b11a05-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20121/c/1"><num value="1">(1)</num><content> to implement, expand, and establish cooperative efforts and projects between domestic violence, dating violence, and sexual assault victim service providers and legal assistance providers to provide legal assistance for victims of domestic violence, dating violence, stalking, and sexual assault;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26b11a06-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20121/c/2"><num value="2">(2)</num><content> to implement, expand, and establish efforts and projects to provide legal assistance for victims of domestic violence, dating violence, stalking, and sexual assault by organizations with a demonstrated history of providing direct legal or advocacy services on behalf of these victims; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26b14117-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20121/c/3"><num value="3">(3)</num><content> to implement, expand, and establish efforts and projects to provide competent, supervised pro bono legal assistance for victims of domestic violence, dating violence, sexual assault, or stalking, except that not more than 10 percent of the funds awarded under this section may be used for the purpose described in this paragraph.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26b14118-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20121/d"><num value="d" class="bold">(d)</num><heading class="bold"> Eligibility</heading><chapeau style="-uslm-lc:I11" class="indent0">To be eligible for a grant under subsection (c), applicants shall certify in writing that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id26b14119-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20121/d/1"><num value="1">(1)</num><chapeau> any person providing legal assistance through a program funded under subsection (c) this section—” <ref class="footnoteRef" idref="fn002151">1</ref><note type="footnote" id="fn002151"><num>1</num> So in original. Probably should be “subsection (c) of this section”, and the closing quotation marks probably should not appear.</note></chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id26b1411a-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20121/d/1/A"><num value="A">(A)</num><content> has demonstrated expertise in providing legal assistance to victims of domestic violence, dating violence, sexual assault, or stalking in the targeted population; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26b1411b-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20121/d/1/B"><num value="B">(B)</num><clause style="-uslm-lc:I13" class="indent2" id="id26b1411c-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20121/d/1/B/i"><num value="i">(i)</num><content> is partnered with an entity or person that has demonstrated expertise described in subparagraph (A); and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id26b1411d-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20121/d/1/B/ii"><num value="ii">(ii)</num><content> has completed, or will complete, training in connection with domestic violence, dating violence, stalking, or sexual assault and related legal issues, including training on evidence-based risk factors for domestic and dating violence homicide;</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26b1411e-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20121/d/2"><num value="2">(2)</num><content> any training program conducted in satisfaction of the requirement of paragraph (1) has been or will be developed with input from and in collaboration with a tribal, State, territorial, or local domestic violence, dating violence, sexual assault or stalking victim service provider or coalition, as well as appropriate tribal, State, territorial, and local law enforcement officials;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26b1411f-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20121/d/3"><num value="3">(3)</num><content> any person or organization providing legal assistance through a program funded under subsection (c) has informed and will continue to inform State, local, or tribal domestic violence, dating violence, or sexual assault programs and coalitions, as well as appropriate State and local law enforcement officials of their work; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26b16730-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20121/d/4"><num value="4">(4)</num><content> the grantee’s organizational policies do not require mediation or counseling involving offenders and victims physically together, in cases where sexual assault, domestic violence, dating violence, or child sexual abuse is an issue.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26b16731-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20121/e"><num value="e" class="bold">(e)</num><heading class="bold"> Evaluation</heading><content><p style="-uslm-lc:I11" class="indent0">The Attorney General may evaluate the grants funded under this section through contracts or other arrangements with entities expert on domestic violence, dating violence, stalking, and sexual assault, and on evaluation research.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26b16732-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20121/f"><num value="f" class="bold">(f)</num><heading class="bold"> Authorization of appropriations</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26b16733-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20121/f/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">There is authorized to be appropriated to carry out this section $57,000,000 for each of fiscal years 2014 through 2018.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26b16734-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20121/f/2"><num value="2" class="bold">(2)</num><heading class="bold"> Allocation of funds</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id26b16735-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20121/f/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> Tribal programs</heading><content><p style="-uslm-lc:I13" class="indent2">Of the amount made available under this subsection in each fiscal year, not less than 3 percent shall be used for grants for programs that assist adult and youth victims of domestic violence, dating violence, stalking, and sexual assault on lands within the jurisdiction of an Indian tribe.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id26b16736-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20121/f/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Tribal government program</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id26b16737-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20121/f/2/B/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I14" class="indent3">Not less than 7 percent of the total amount available under this section for each fiscal year shall be available for grants under the program authorized by <ref href="/us/usc/t34/s10452">section 10452 of this title</ref>.</p>
