L. 103–322, title IV, § 40503(a), Sept. 13, 1994, 108 Stat. 1946.)","seq_in_title":460,"parent_identifier":"/us/usc/t34/stII/ch201/schIII","ancestors":[{"identifier":"/us/usc/t34","level":"title","num":"Title 34—","heading":"CRIME CONTROL AND LAW ENFORCEMENT","status":null,"is_section":false},{"identifier":"/us/usc/t34/stII","level":"subtitle","num":"Subtitle II—","heading":"Protection of Children and Other Persons","status":null,"is_section":false},{"identifier":"/us/usc/t34/stII/ch201","level":"chapter","num":"CHAPTER 201—","heading":"VICTIM RIGHTS, COMPENSATION, AND ASSISTANCE","status":null,"is_section":false},{"identifier":"/us/usc/t34/stII/ch201/schIII","level":"subchapter","num":"SUBCHAPTER III—","heading":"ADDITIONAL VICTIM COMPENSATION AND SERVICES","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id26b538ca-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141\"><num value=\"20141\">§ 20141.</num><heading> Services to victims</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26b538cb-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Designation of responsible officials</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The head of each department and agency of the United States engaged in the detection, investigation, or prosecution of crime shall designate by names and office titles the persons who will be responsible for identifying the victims of crime and performing the services described in subsection (c) at each stage of a criminal case.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26b538cc-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Identification of victims</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">At the earliest opportunity after the detection of a crime at which it may be done without interfering with an investigation, a responsible official shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26b538cd-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/b/1\"><num value=\"1\">(1)</num><content> identify the victim or victims of a crime;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26b55ede-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/b/2\"><num value=\"2\">(2)</num><content> inform the victims of their right to receive, on request, the services described in subsection (c); and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26b55edf-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/b/3\"><num value=\"3\">(3)</num><content> inform each victim of the name, title, and business address and telephone number of the responsible official to whom the victim should address a request for each of the services described in subsection (c).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26b55ee0-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Description of services</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id26b55ee1-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/c/1\"><num value=\"1\">(1)</num><chapeau> A responsible official shall—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26b55ee2-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/c/1/A\"><num value=\"A\">(A)</num><content> inform a victim of the place where the victim may receive emergency medical and social services;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26b55ee3-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/c/1/B\"><num value=\"B\">(B)</num><content> inform a victim of any restitution or other relief to which the victim may be entitled under this or any other law and <ref class=\"footnoteRef\" idref=\"fn002159\">1</ref><note type=\"footnote\" id=\"fn002159\"><num>1</num> So in original. Probably should be followed by “the”.</note> manner in which such relief may be obtained;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26b55ee4-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/c/1/C\"><num value=\"C\">(C)</num><content> inform a victim of public and private programs that are available to provide counseling, treatment, and other support to the victim; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26b55ee5-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/c/1/D\"><num value=\"D\">(D)</num><content> assist a victim in contacting the persons who are responsible for providing the services and relief described in subparagraphs (A), (B), and (C).</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id26b55ee6-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/c/2\"><num value=\"2\">(2)</num><content> A responsible official shall arrange for a victim to receive reasonable protection from a suspected offender and persons acting in concert with or at the behest of the suspected offender.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id26b55ee7-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/c/3\"><num value=\"3\">(3)</num><chapeau> During the investigation and prosecution of a crime, a responsible official shall provide a victim the earliest possible notice of—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26b55ee8-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/c/3/A\"><num value=\"A\">(A)</num><content> the status of the investigation of the crime, to the extent it is appropriate to inform the victim and to the extent that it will not interfere with the investigation;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26b55ee9-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/c/3/B\"><num value=\"B\">(B)</num><content> the arrest of a suspected offender;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26b55eea-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/c/3/C\"><num value=\"C\">(C)</num><content> the filing of charges against a suspected offender;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26b55eeb-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/c/3/D\"><num value=\"D\">(D)</num><content> the scheduling of each court proceeding that the witness is either required to attend or, under section 10606(b)(4) <ref class=\"footnoteRef\" idref=\"fn002160\">2</ref><note type=\"footnote\" id=\"fn002160\"><num>2</num> See References in Text note below.</note> of title 42, is entitled to attend;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26b55eec-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/c/3/E\"><num value=\"E\">(E)</num><content> the release or detention status of an offender or suspected offender;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26b55eed-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/c/3/F\"><num value=\"F\">(F)</num><content> the acceptance of a plea of guilty or nolo contendere or the rendering of a verdict after trial; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26b55eee-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/c/3/G\"><num value=\"G\">(G)</num><content> the sentence imposed on an offender, including the date on which the offender will be eligible for parole.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id26b55eef-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/c/4\"><num value=\"4\">(4)</num><content> During court proceedings, a responsible official shall ensure that a victim is provided a waiting area removed from and out of the sight and hearing of the defendant and defense witnesses.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id26b58600-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/c/5\"><num value=\"5\">(5)</num><chapeau> After trial, a responsible official shall provide a victim the earliest possible notice of—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26b58601-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/c/5/A\"><num value=\"A\">(A)</num><content> the scheduling of a parole hearing for the offender;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26b58602-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/c/5/B\"><num value=\"B\">(B)</num><content> the escape, work release, furlough, or any other form of release from custody of the offender; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26b58603-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/c/5/C\"><num value=\"C\">(C)</num><content> the death of the offender, if the offender dies while in custody.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id26b58604-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/c/6\"><num value=\"6\">(6)</num><content> At all times, a responsible official shall ensure that any property of a victim that is being held for evidentiary purposes be maintained in good condition and returned to the victim as soon as it is no longer needed for evidentiary purposes.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id26b58605-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/c/7\"><num value=\"7\">(7)</num><content> The Attorney General or the head of another department or agency that conducts an investigation of a sexual assault shall pay, either directly or by reimbursement of payment by the victim, the cost of a physical examination of the victim which an investigating officer determines was necessary or useful for evidentiary purposes. The Attorney General shall provide for the payment of the cost of up to 2 anonymous and confidential tests of the victim for sexually transmitted diseases, including HIV, gonorrhea, herpes, chlamydia, and syphilis, during the 12 months following sexual assaults that pose a risk of transmission, and the cost of a counseling session by a medically trained professional on the accuracy of such tests and the risk of transmission of sexually transmitted diseases to the victim as the result of the assault. A victim may waive anonymity and confidentiality of any tests paid for under this section.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id26b58606-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/c/8\"><num value=\"8\">(8)</num><content> A responsible official shall provide the victim with general information regarding the corrections process, including information about work release, furlough, probation, and eligibility for each.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26b58607-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> No cause of action or defense</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">This section does not create a cause of action or defense in favor of any person arising out of the failure of a responsible person to provide information as required by subsection (b) or (c).</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26b58608-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Definitions</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">For the purposes of this section—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26b58609-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/e/1\"><num value=\"1\">(1)</num><content> the term “responsible official” means a person designated pursuant to subsection (a) to perform the functions of a responsible official under that section; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26b5860a-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/e/2\"><num value=\"2\">(2)</num><chapeau> the term “victim” means a person that has suffered direct physical, emotional, or pecuniary harm as a result of the commission of a crime, including—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26b5ad1b-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/e/2/A\"><num value=\"A\">(A)</num><content> in the case of a victim that is an institutional entity, an authorized representative of the entity; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26b5ad1c-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/e/2/B\"><num value=\"B\">(B)</num><chapeau> in the case of a victim who is under 18 years of age, incompetent, incapacitated, or deceased, one of the following (in order of preference):</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26b5ad1d-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/e/2/B/i\"><num value=\"i\">(i)</num><content> a spouse;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26b5ad1e-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/e/2/B/ii\"><num value=\"ii\">(ii)</num><content> a legal guardian;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26b5ad1f-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/e/2/B/iii\"><num value=\"iii\">(iii)</num><content> a parent;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26b5ad20-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/e/2/B/iv\"><num value=\"iv\">(iv)</num><content> a child;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26b5ad21-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/e/2/B/v\"><num value=\"v\">(v)</num><content> a sibling;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26b5ad22-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/e/2/B/vi\"><num value=\"vi\">(vi)</num><content> another family member; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26b5ad23-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20141/e/2/B/vii\"><num value=\"vii\">(vii)</num><content> another person designated by the court.</content>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id26b5ad24-0f21-11eb-9212-a1a9175aa019\">(<ref href=\"/us/pl/101/647/tV/s503\">Pub.
