<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id26b5ad29-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20142"><num value="20142">§ 20142.</num><heading> Closed circuit televised court proceedings for victims of crime</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26b5ad2a-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20142/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I11" class="indent0">Notwithstanding any provision of the Federal Rules of Criminal Procedure to the contrary, in order to permit victims of crime to watch criminal trial proceedings in cases where the venue of the trial is changed—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id26b5d43b-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20142/a/1"><num value="1">(1)</num><content> out of the State in which the case was initially brought; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26b5d43c-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20142/a/2"><num value="2">(2)</num><content> more than 350 miles from the location in which those proceedings originally would have taken place;</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">the trial court shall order closed circuit televising of the proceedings to that location, for viewing by such persons the court determines have a compelling interest in doing so and are otherwise unable to do so by reason of the inconvenience and expense caused by the change of venue.</continuation>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26b5d43d-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20142/b"><num value="b" class="bold">(b)</num><heading class="bold"> Limited access</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26b5d43e-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20142/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Generally</heading><content><p style="-uslm-lc:I12" class="indent1">No other person, other than official court and security personnel, or other persons specifically designated by the court, shall be permitted to view the closed circuit televising of the proceedings.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26b5d43f-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20142/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Exception</heading><content><p style="-uslm-lc:I12" class="indent1">The court shall not designate a person under paragraph (1) if the presiding judge at the trial determines that testimony by that person would be materially affected if that person heard other testimony at the trial.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26b5d440-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20142/c"><num value="c" class="bold">(c)</num><heading class="bold"> Restrictions</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id26b5d441-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20142/c/1"><num value="1">(1)</num><content> The signal transmitted pursuant to subsection (a) shall be under the control of the court at all times and shall only be transmitted subject to the terms and conditions imposed by the court.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id26b5d442-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20142/c/2"><num value="2">(2)</num><content> No public broadcast or dissemination shall be made of the signal transmitted pursuant to subsection (a). In the event any tapes are produced in carrying out subsection (a), such tapes shall be the property of the court and kept under seal.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id26b5d443-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20142/c/3"><num value="3">(3)</num><content> Any violations of this subsection, or any rule or order made pursuant to this section, shall be punishable as contempt of court as described in <ref href="/us/usc/t18/s402">section 402 of title 18</ref>.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26b5d444-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20142/d"><num value="d" class="bold">(d)</num><heading class="bold"> Donations</heading><content><p style="-uslm-lc:I11" class="indent0">The Administrative Office of the United States Courts may accept donations to enable the courts to carry out subsection (a).</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26b5d445-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20142/e"><num value="e" class="bold">(e)</num><heading class="bold"> Construction</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id26b5d446-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20142/e/1"><num value="1">(1)</num><chapeau> <ref class="footnoteRef" idref="fn002161">1</ref><note type="footnote" id="fn002161"><num>1</num> So in original. No par. (2) has been enacted.</note> Nothing in this section shall be construed—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="id26b5d447-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20142/e/1/i"><num value="i">(i)</num><content> to create in favor of any person a cause of action against the United States or any officer or employees thereof, or</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="id26b5d448-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20142/e/1/ii"><num value="ii">(ii)</num><content> to provide any person with a defense in any action in which application of this section is made.</content>
</clause>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26b5d449-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20142/f"><num value="f" class="bold">(f)</num><heading class="bold"> “State” defined</heading><content><p style="-uslm-lc:I11" class="indent0">As used in this section, the term “State” means any State, the District of Columbia, or any possession or territory of the United States.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26b5fb5a-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20142/g"><num value="g" class="bold">(g)</num><heading class="bold"> Rules</heading><content><p style="-uslm-lc:I11" class="indent0">The Judicial Conference of the United States, pursuant to its rule making authority under <ref href="/us/usc/t28/s331">section 331 of title 28</ref>, may promulgate and issue rules, or amend existing rules, to effectuate the policy addressed by this section. Upon the implementation of such rules, this section shall cease to be effective.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26b5fb5b-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20142/h"><num value="h" class="bold">(h)</num><heading class="bold"> Effective date</heading><content><p style="-uslm-lc:I11" class="indent0">This section shall only apply to cases filed after <date date="1995-01-01">January 1, 1995</date>.</p>
