<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id26bd00cc-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20331"><num value="20331">§ 20331.</num><heading> Findings and purpose</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26bd00cd-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20331/a"><num value="a" class="bold">(a)</num><heading class="bold"> Findings</heading><chapeau style="-uslm-lc:I11" class="indent0">The Congress finds that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id26bd00ce-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20331/a/1"><num value="1">(1)</num><content> a large number of juvenile and family courts are inundated with increasing numbers of cases due to increased reports of abuse and neglect, increasing drug-related maltreatment, and insufficient court resources;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26bd27df-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20331/a/2"><num value="2">(2)</num><content> the amendments made to the Social Security Act [<ref href="/us/usc/t42/s301">42 U.S.C. 301</ref> et seq.] by the Adoption Assistance and Child Welfare Act of 1980 make substantial demands on the courts handling abuse and neglect cases, but provide no assistance to the courts to meet those demands;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26bd27e0-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20331/a/3"><num value="3">(3)</num><chapeau> the Adoption <ref class="footnoteRef" idref="fn002166">1</ref><note type="footnote" id="fn002166"><num>1</num> So in original. Probably should be “Adoption Assistance”.</note> and Child Welfare Act of 1980 requires courts to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id26bd27e1-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20331/a/3/A"><num value="A">(A)</num><content> determine whether the agency made reasonable efforts to prevent foster care placement;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26bd27e2-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20331/a/3/B"><num value="B">(B)</num><content> approve voluntary nonjudicial placement; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26bd27e3-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20331/a/3/C"><num value="C">(C)</num><content> provide procedural safeguards for parents when their parent-child relationship is affected;</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id26bd27e4-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20331/a/4"><num value="4">(4)</num><content> social welfare agencies press the courts to meet such requirements, yet scarce resources often dictate that courts comply pro forma without undertaking the meaningful judicial inquiry contemplated by Congress in the Adoption <sup>1</sup> and Child Welfare Act of 1980;</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id26bd27e5-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20331/a/5"><num value="5">(5)</num><content> compliance with the Adoption <sup>1</sup> and Child Welfare Act of 1980 and overall improvements in the judicial response to abuse and neglect cases can best come about through action by top level court administrators and judges with administrative functions who understand the unique aspects of decisions required in child abuse and neglect cases; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26bd27e6-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20331/a/6"><num value="6">(6)</num><content> the Adoption <sup>1</sup> and Child Welfare Act of 1980 provides financial incentives to train welfare agency staff to meet the requirements, but provides no resources to train judges.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26bd27e7-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20331/b"><num value="b" class="bold">(b)</num><heading class="bold"> Purpose</heading><content><p style="-uslm-lc:I11" class="indent0">The purpose of this subchapter is to provide expanded technical assistance and training to judicial personnel and attorneys, particularly personnel and practitioners in juvenile and family courts, to improve the judicial system’s handling of child abuse and neglect cases with specific emphasis on the role of the courts in addressing reasonable efforts that can safely avoid unnecessary and unnecessarily prolonged foster care placement.</p>
