L. 114–22, title I, § 117, May 29, 2015, 129 Stat. 245.)","seq_in_title":490,"parent_identifier":"/us/usc/t34/stII/ch207","ancestors":[{"identifier":"/us/usc/t34","level":"title","num":"Title 34—","heading":"CRIME CONTROL AND LAW ENFORCEMENT","status":null,"is_section":false},{"identifier":"/us/usc/t34/stII","level":"subtitle","num":"Subtitle II—","heading":"Protection of Children and Other Persons","status":null,"is_section":false},{"identifier":"/us/usc/t34/stII/ch207","level":"chapter","num":"CHAPTER 207—","heading":"COMBATING DOMESTIC TRAFFICKING IN PERSONS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id26c34206-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20704\"><num value=\"20704\">§ 20704.</num><heading> Grant accountability</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26c34207-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20704/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Definition</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">In this section, the term “covered grant” means a grant awarded by the Attorney General under <ref href=\"/us/usc/t34/s20703\">section 20703 of this title</ref>, as amended by section 103.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26c34208-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20704/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Accountability</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">All covered grants shall be subject to the following accountability provisions:</chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26c36919-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20704/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Audit requirement</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id26c3691a-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20704/b/1/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Beginning in the first fiscal year beginning after <date date=\"2015-05-29\">May 29, 2015</date>, and in each fiscal year thereafter, the Inspector General of the Department of Justice shall conduct audits of recipients of a covered grant to prevent waste, fraud, and abuse of funds by grantees. The Inspector General shall determine the appropriate number of grantees to be audited each year.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id26c3691b-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20704/b/1/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Definition</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">In this paragraph, the term “unresolved audit finding” means a finding in the final audit report of the Inspector General that the audited grantee has utilized grant funds for an unauthorized expenditure or otherwise unallowable cost that is not closed or resolved within 12 months from the date when the final audit report is issued.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id26c3691c-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20704/b/1/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Mandatory exclusion</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">A recipient of a covered grant that is found to have an unresolved audit finding shall not be eligible to receive a covered grant during the following 2 fiscal years.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id26c3691d-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20704/b/1/D\"><num value=\"D\" class=\"bold\">(D)</num><heading class=\"bold\"> Priority</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">In awarding covered grants the Attorney General shall give priority to eligible entities that did not have an unresolved audit finding during the 3 fiscal years prior to submitting an application for a covered grant.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id26c3691e-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20704/b/1/E\"><num value=\"E\" class=\"bold\">(E)</num><heading class=\"bold\"> Reimbursement</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">If an entity is awarded a covered grant during the 2-fiscal-year period in which the entity is barred from receiving grants under subparagraph (C), the Attorney General shall—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26c3691f-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20704/b/1/E/i\"><num value=\"i\">(i)</num><content> deposit an amount equal to the grant funds that were improperly awarded to the grantee into the General Fund of the Treasury; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26c36920-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20704/b/1/E/ii\"><num value=\"ii\">(ii)</num><content> seek to recoup the costs of the repayment to the fund from the grant recipient that was erroneously awarded grant funds.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26c36921-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20704/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Nonprofit organization requirements</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id26c36922-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20704/b/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Definition</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">For purposes of this paragraph and covered grants, the term “nonprofit organization” means an organization that is described in <ref href=\"/us/usc/t26/s501/c/3\">section 501(c)(3) of title 26</ref> and is exempt from taxation under <ref href=\"/us/usc/t26/s501/a\">section 501(a) of title 26</ref>.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id26c36923-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20704/b/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Prohibition</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The Attorney General may not award a covered grant to a nonprofit organization that holds money in offshore accounts for the purpose of avoiding paying the tax described in <ref href=\"/us/usc/t26/s511/a\">section 511(a) of title 26</ref>.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id26c39034-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20704/b/2/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Disclosure</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Each nonprofit organization that is awarded a covered grant and uses the procedures prescribed in regulations to create a rebuttable presumption of reasonableness for the compensation of its officers, directors, trustees and key employees, shall disclose to the Attorney General, in the application for the grant, the process for determining such compensation, including the independent persons involved in reviewing and approving such compensation, the comparability data used, and contemporaneous substantiation of the deliberation and decision. Upon request, the Attorney General shall make the information disclosed under this subsection available for public inspection.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26c39035-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20704/b/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Conference expenditures</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id26c39036-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20704/b/3/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Limitation</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">No amounts transferred to the Department of Justice under this title,<ref class=\"footnoteRef\" idref=\"fn002169\">1</ref><note type=\"footnote\" id=\"fn002169\"><num>1</num> See References in Text note below.</note> or the amendments made by this title,<ref class=\"footnoteRef\" idref=\"fn002169\">1</ref> may be used by the Attorney General, or by any individual or organization awarded discretionary funds through a cooperative agreement under this title,<ref class=\"footnoteRef\" idref=\"fn002169\">1</ref> or the amendments made by this title,<ref class=\"footnoteRef\" idref=\"fn002169\">1</ref> to host or support any expenditure for conferences that uses more than $20,000 in Department funds, unless the Deputy Attorney General or such Assistant Attorney Generals, Directors, or principal deputies as the Deputy Attorney General may designate, provides prior written authorization that the funds may be expended to host a conference.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id26c39037-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20704/b/3/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Written approval</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Written approval under subparagraph (A) shall include a written estimate of all costs associated with the conference, including the cost of all food and beverages, audiovisual equipment, honoraria for speakers, and any entertainment.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id26c39038-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20704/b/3/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Report</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The Deputy Attorney General shall submit an annual report to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives on all approved conference expenditures referenced in this paragraph.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id26c39039-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20704/b/3/D\"><num value=\"D\" class=\"bold\">(D)</num><heading class=\"bold\"> Annual certification</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">Beginning in the first fiscal year beginning after <date date=\"2015-05-29\">May 29, 2015</date>, the Attorney General shall submit, to the Committee on the Judiciary and the Committee on Appropriations of the Senate and the Committee on the Judiciary and the Committee on Appropriations of the House of Representatives, an annual certification that—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26c3b74a-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20704/b/3/D/i\"><num value=\"i\">(i)</num><content> all audits issued by the Office of the Inspector General under paragraph (1) have been completed and reviewed by the appropriate Assistant Attorney General or Director;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26c3b74b-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20704/b/3/D/ii\"><num value=\"ii\">(ii)</num><content> all mandatory exclusions required under paragraph (1)(C) have been issued;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26c3b74c-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20704/b/3/D/iii\"><num value=\"iii\">(iii)</num><content> all reimbursements required under paragraph (1)(E) have been made; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26c3b74d-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20704/b/3/D/iv\"><num value=\"iv\">(iv)</num><content> includes a list of any grant recipients excluded under paragraph (1) from the previous year.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26c3b74e-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20704/b/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Prohibition on lobbying activity</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id26c3b74f-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20704/b/4/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">Amounts awarded under this title,<sup>1</sup> or any amendments made by this title,<sup>1</sup> may not be utilized by any grant recipient to—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26c3b750-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20704/b/4/A/i\"><num value=\"i\">(i)</num><content> lobby any representative of the Department of Justice regarding the award of grant funding; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26c3b751-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20704/b/4/A/ii\"><num value=\"ii\">(ii)</num><content> lobby any representative of a Federal, State, local, or tribal government regarding the award of grant funding.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id26c3b752-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20704/b/4/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Penalty</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">If the Attorney General determines that any recipient of a covered grant has violated subparagraph (A), the Attorney General shall—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26c3b753-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20704/b/4/B/i\"><num value=\"i\">(i)</num><content> require the grant recipient to repay the grant in full; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26c3b754-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20704/b/4/B/ii\"><num value=\"ii\">(ii)</num><content> prohibit the grant recipient from receiving another covered grant for not less than 5 years.</content>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id26c3b755-0f21-11eb-9212-a1a9175aa019\">(<ref href=\"/us/pl/114/22/tI/s117\">Pub. The Inspector General shall determine the appropriate number of grantees to be audited each year.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><heading> <inline class=\"small-caps\">Mandatory exclusion</inline>.—</heading><content>A recipient of funds under a covered grant that is found to have an unresolved audit finding shall not be eligible to receive funds under a covered grant during the first 2 fiscal years beginning after the end of the 12-month period described in subparagraph (A).</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"D\">“(D)</num><heading> <inline class=\"small-caps\">Priority</inline>.—</heading><content>In awarding covered grants, a covered official shall give priority to eligible applicants that did not have an unresolved audit finding during the 3 fiscal years before submitting an application for the covered grant.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"E\">“(E)</num><heading> <inline class=\"small-caps\">Reimbursement</inline>.—</heading><chapeau>If an entity is awarded funds under a covered grant during the 2-fiscal-year period during which the entity is barred from receiving covered grants under subparagraph (C), a covered official shall—</chapeau><clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"i\">“(i)</num><content> deposit an amount equal to the amount of the grant funds that were improperly awarded to the grantee into the General Fund of the Treasury; and</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"ii\">“(ii)</num><content> seek to recoup the costs of the repayment to the fund from the recipient of the covered grant that was erroneously awarded grant funds.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Nonprofit organization requirements.—</inline></heading><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><heading> <inline class=\"small-caps\">Definition</inline>.—</heading><content>For purposes of this paragraph and each covered grant program, the term ‘nonprofit organization’ means an organization that is described in section 501(c)(3) of the Internal Revenue Code of 1986 [<ref href=\"/us/usc/t26/s501/c/3\">26 U.S.C. 501(c)(3)</ref>] and is exempt from taxation under section 501(a) of such Code.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><heading> <inline class=\"small-caps\">Prohibition</inline>.—</heading><content>A covered grant may not be awarded to a nonprofit organization that holds money in offshore accounts for the purpose of avoiding paying the tax described in section 511(a) of the Internal Revenue Code of 1986 [<ref href=\"/us/usc/t26/s511/a\">26 U.S.C. 511(a)</ref>].</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><heading> <inline class=\"small-caps\">Disclosure</inline>.—</heading><content>Each nonprofit organization that is awarded a covered grant and uses the procedures prescribed in regulations to create a rebuttable presumption of reasonableness for the compensation of its officers, directors, trustees, and key employees, shall disclose to the applicable covered official, in the application for the covered grant, the process for determining such compensation, including the independent persons involved in reviewing and approving such compensation, the comparability data used, and contemporaneous substantiation of the deliberation and decision. Upon request, a covered official shall make the information disclosed under this subparagraph available for public inspection.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><heading> <inline class=\"small-caps\">Conference expenditures.—</inline></heading><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><heading> <inline class=\"small-caps\">Limitation</inline>.—</heading><content>No amounts made available to a covered agency to carry out a covered grant program may be used by a covered official, or by any individual or entity awarded discretionary funds through a cooperative agreement under a covered grant program, to host or support any expenditure for conferences that uses more than $20,000 in funds made available by the covered agency, unless the covered official provides prior written authorization that the funds may be expended to host the conference.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><heading> <inline class=\"small-caps\">Written approval</inline>.—</heading><content>Written approval under subparagraph (A) shall include a written estimate of all costs associated with the conference, including the cost of all food, beverages, audio-visual equipment, honoraria for speakers, and entertainment.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><heading> <inline class=\"small-caps\">Report.—</inline></heading><clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"i\">“(i)</num><heading> <inline class=\"small-caps\">Department of justice</inline>.—</heading><content>The Deputy Attorney General shall submit an annual report to the appropriate committees of Congress on all conference expenditures approved under this paragraph.</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"ii\">“(ii)</num><heading> <inline class=\"small-caps\">Department of health and human services</inline>.—</heading><content>The Deputy Secretary of Health and Human Services shall submit to the appropriate committees of Congress an annual report on all conference expenditures approved under this paragraph.</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"iii\">“(iii)</num><heading> <inline class=\"small-caps\">Department of homeland security</inline>.—</heading><content>The Deputy Secretary of Homeland Security shall submit to the appropriate committees of Congress an annual report on all conference expenditures approved under this paragraph.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><heading> <inline class=\"small-caps\">Annual certification</inline>.—</heading><chapeau>Beginning in the first fiscal year beginning after the date of enactment of this Act, each covered official shall submit to the appropriate committees of Congress an annual certification—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><chapeau> indicating whether—</chapeau><clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"i\">“(i)</num><content> all audits issued by the Office of the Inspector General of the applicable covered agency under paragraph (1) have been completed and reviewed by the appropriate official;</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"ii\">“(ii)</num><content> all mandatory exclusions required under paragraph (1)(C) have been issued; and</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"iii\">“(iii)</num><content> all reimbursements required under paragraph (1)(E) have been made; and</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> that includes a list of any recipients of a covered grant excluded under paragraph (1) from the previous year.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Preventing Duplicative Grants.—</inline></heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>Before a covered official awards a covered grant, the covered official shall compare potential awards under the covered grant program with other covered grants awarded to determine if duplicate grant awards are awarded for the same purpose.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Report</inline>.—</heading><chapeau>If a covered official awards duplicate covered grants to the same applicant for the same purpose the covered official shall submit to the appropriate committees of Congress a report that includes—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> a list of all duplicate covered grants awarded, including the total dollar amount of any duplicate covered grants awarded;
