<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id26cd2d47-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20929"><num value="20929">§ 20929.</num><heading> Election by Indian tribes</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26cd2d48-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20929/a"><num value="a" class="bold">(a)</num><heading class="bold"> Election</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26cd2d49-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20929/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">A federally recognized Indian tribe may, by resolution or other enactment of the tribal council or comparable governmental body—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id26cd2d4a-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20929/a/1/A"><num value="A">(A)</num><content> elect to carry out this part as a jurisdiction subject to its provisions; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26cd2d4b-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20929/a/1/B"><num value="B">(B)</num><content> elect to delegate its functions under this part to another jurisdiction or jurisdictions within which the territory of the tribe is located and to provide access to its territory and such other cooperation and assistance as may be needed to enable such other jurisdiction or jurisdictions to carry out and enforce the requirements of this part.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26cd2d4c-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20929/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Imputed election in certain cases</heading><chapeau style="-uslm-lc:I12" class="indent1">A tribe shall be treated as if it had made the election described in paragraph (1)(B) if—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id26cd2d4d-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20929/a/2/A"><num value="A">(A)</num><content> it is a tribe subject to the law enforcement jurisdiction of a State under <ref href="/us/usc/t18/s1162">section 1162 of title 18</ref>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26cd2d4e-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20929/a/2/B"><num value="B">(B)</num><content> the tribe does not make an election under paragraph (1) within 1 year of <date date="2006-07-27">July 27, 2006</date> or rescinds an election under paragraph (1)(A); or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26cd2d4f-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20929/a/2/C"><num value="C">(C)</num><content> the Attorney General determines that the tribe has not substantially implemented the requirements of this part and is not likely to become capable of doing so within a reasonable amount of time.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26cd2d50-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20929/b"><num value="b" class="bold">(b)</num><heading class="bold"> Cooperation between tribal authorities and other jurisdictions</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26cd2d51-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20929/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Nonduplication</heading><content><p style="-uslm-lc:I12" class="indent1">A tribe subject to this part is not required to duplicate functions under this part which are fully carried out by another jurisdiction or jurisdictions within which the territory of the tribe is located.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26cd5462-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20929/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Cooperative agreements</heading><chapeau style="-uslm-lc:I12" class="indent1">A tribe may, through cooperative agreements with such a jurisdiction or jurisdictions—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id26cd5463-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20929/b/2/A"><num value="A">(A)</num><content> arrange for the tribe to carry out any function of such a jurisdiction under this part with respect to sex offenders subject to the tribe’s jurisdiction; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26cd5464-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20929/b/2/B"><num value="B">(B)</num><content> arrange for such a jurisdiction to carry out any function of the tribe under this part with respect to sex offenders subject to the tribe’s jurisdiction.</content>
