<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id26d0af53-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20971"><num value="20971">§ 20971.</num><heading> Jimmy Ryce State civil commitment programs for sexually dangerous persons</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26d0af54-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20971/a"><num value="a" class="bold">(a)</num><heading class="bold"> Grants authorized</heading><content><p style="-uslm-lc:I11" class="indent0">Except as provided in subsection (b), the Attorney General shall make grants to jurisdictions for the purpose of establishing, enhancing, or operating effective civil commitment programs for sexually dangerous persons.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26d0af55-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20971/b"><num value="b" class="bold">(b)</num><heading class="bold"> Limitation</heading><content><p style="-uslm-lc:I11" class="indent0">The Attorney General shall not make any grant under this section for the purpose of establishing, enhancing, or operating any transitional housing for a sexually dangerous person in or near a location where minors or other vulnerable persons are likely to come into contact with that person.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26d0af56-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20971/c"><num value="c" class="bold">(c)</num><heading class="bold"> Eligibility</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26d0af57-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20971/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">To be eligible to receive a grant under this section, a jurisdiction shall, before the expiration of the compliance period—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id26d0af58-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20971/c/1/A"><num value="A">(A)</num><content> have established a civil commitment program for sexually dangerous persons that is consistent with guidelines issued by the Attorney General; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26d0af59-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20971/c/1/B"><num value="B">(B)</num><content> submit a plan for the establishment of such a program.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26d0af5a-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20971/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Compliance period</heading><content><p style="-uslm-lc:I12" class="indent1">The compliance period referred to in paragraph (1) expires on the date that is 2 years after <date date="2006-07-27">July 27, 2006</date>. However, the Attorney General may, on a case-by-case basis, extend the compliance period that applies to a jurisdiction if the Attorney General considers such an extension to be appropriate.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26d0af5b-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20971/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Release notice</heading><subparagraph style="-uslm-lc:I12" class="indent1" id="id26d0af5c-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20971/c/3/A"><num value="A">(A)</num><chapeau> Each civil commitment program for which funding is required under this section shall require the issuance of timely notice to a State official responsible for considering whether to pursue civil commitment proceedings upon the impending release of any person incarcerated by the State who—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="id26d0d66d-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20971/c/3/A/i"><num value="i">(i)</num><content> has been convicted of a sexually violent offense; or</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id26d0d66e-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20971/c/3/A/ii"><num value="ii">(ii)</num><content> has been deemed by the State to be at high risk for recommitting any sexual offense against a minor.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id26d0d66f-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20971/c/3/B"><num value="B">(B)</num><content> The program shall further require that upon receiving notice under subparagraph (A), the State official shall consider whether or not to pursue a civil commitment proceeding, or any equivalent proceeding required under State law.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26d0d670-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20971/d"><num value="d" class="bold">(d)</num><heading class="bold"> Attorney General reports</heading><content><p style="-uslm-lc:I11" class="indent0">Not later than January 31 of each year, beginning with 2008, the Attorney General shall submit to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives a report on the progress of jurisdictions in implementing this section and the rate of sexually violent offenses for each jurisdiction.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26d0d671-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20971/e"><num value="e" class="bold">(e)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I11" class="indent0">As used in this section:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id26d0d672-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20971/e/1"><num value="1">(1)</num><chapeau> The term “civil commitment program” means a program that involves—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id26d0d673-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20971/e/1/A"><num value="A">(A)</num><content> secure civil confinement, including appropriate control, care, and treatment during such confinement; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26d0d674-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20971/e/1/B"><num value="B">(B)</num><content> appropriate supervision, care, and treatment for individuals released following such confinement.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26d0d675-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20971/e/2"><num value="2">(2)</num><content> The term “sexually dangerous person” means a person suffering from a serious mental illness, abnormality, or disorder, as a result of which the individual would have serious difficulty in refraining from sexually violent conduct or child molestation.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26d0d676-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20971/e/3"><num value="3">(3)</num><content> The term “jurisdiction” has the meaning given such term in <ref href="/us/usc/t34/s20911">section 20911 of this title</ref>.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26d0d677-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s20971/f"><num value="f" class="bold">(f)</num><heading class="bold"> Authorization of appropriations</heading><content><p style="-uslm-lc:I11" class="indent0">There are authorized to be appropriated to carry out this section $10,000,000 for each of fiscal years 2007 through 2010.</p>
