L. 109–248, title VI, § 627, July 27, 2006, 120 Stat. 637.)","seq_in_title":537,"parent_identifier":"/us/usc/t34/stII/ch209/schIII","ancestors":[{"identifier":"/us/usc/t34","level":"title","num":"Title 34—","heading":"CRIME CONTROL AND LAW ENFORCEMENT","status":null,"is_section":false},{"identifier":"/us/usc/t34/stII","level":"subtitle","num":"Subtitle II—","heading":"Protection of Children and Other Persons","status":null,"is_section":false},{"identifier":"/us/usc/t34/stII/ch209","level":"chapter","num":"CHAPTER 209—","heading":"CHILD PROTECTION AND SAFETY","status":null,"is_section":false},{"identifier":"/us/usc/t34/stII/ch209/schIII","level":"subchapter","num":"SUBCHAPTER III—","heading":"GRANTS AND OTHER PROVISIONS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id26d172ea-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20984\"><num value=\"20984\">§ 20984.</num><heading> Grants for fingerprinting programs for children</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26d172eb-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20984/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Attorney General shall establish and implement a program under which the Attorney General may make grants to States, units of local government, and Indian tribal governments in accordance with this section.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26d172ec-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20984/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Use of grant amounts</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">A grant made to a State, unit of local government, or Indian tribal government under subsection (a) shall be distributed to law enforcement agencies within the jurisdiction of such State, unit, or tribal government to be used for any of the following activities:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26d199fd-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20984/b/1\"><num value=\"1\">(1)</num><content> To establish a voluntary fingerprinting program for children, which may include the taking of palm prints of children.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26d199fe-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20984/b/2\"><num value=\"2\">(2)</num><content> To hire additional law enforcement personnel, or train existing law enforcement personnel, to take fingerprints of children.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26d199ff-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20984/b/3\"><num value=\"3\">(3)</num><content> To provide information within the community involved about the existence of such a fingerprinting program.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26d19a00-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20984/b/4\"><num value=\"4\">(4)</num><content> To provide for computer hardware, computer software, or other materials necessary to carry out such a fingerprinting program.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26d19a01-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20984/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Limitation</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Fingerprints of a child derived from a program funded under this section—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26d19a02-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20984/c/1\"><num value=\"1\">(1)</num><content> may be released only to a parent or guardian of the child; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26d19a03-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20984/c/2\"><num value=\"2\">(2)</num><content> may not be copied or retained by any Federal, State, local, or tribal law enforcement officer unless written permission is given by the parent or guardian.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26d19a04-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20984/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Criminal penalty</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Any person who uses the fingerprints of a child derived from a program funded under this section for any purpose other than the purpose described in subsection (c)(1) shall be subject to imprisonment for not more than 1 year, a fine under title 18, or both.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26d19a05-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s20984/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Authorization of appropriations</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">There is authorized to be appropriated $20,000,000 to carry out this section for the 5-year period beginning on the first day of fiscal year 2007.</p>\n</content>\n</subsection>\n<sourceCredit id=\"id26d1c116-0f21-11eb-9212-a1a9175aa019\">(<ref href=\"/us/pl/109/248/tVI/s627\">Pub.
