<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id26d54315-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111"><num value="21111">§ 21111.</num><heading> Establishment of National Strategy for Child Exploitation Prevention and Interdiction</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26d54316-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I11" class="indent0">The Attorney General of the United States shall create and implement a National Strategy for Child Exploitation Prevention and Interdiction.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26d54317-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/b"><num value="b" class="bold">(b)</num><heading class="bold"> Timing</heading><content><p style="-uslm-lc:I11" class="indent0">Not later than 1 year after <date date="2008-10-13">October 13, 2008</date>, and on February 1 of every second year thereafter, the Attorney General shall submit to Congress the National Strategy established under subsection (a).</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26d54318-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c"><num value="c" class="bold">(c)</num><heading class="bold"> Required contents of National Strategy</heading><chapeau style="-uslm-lc:I11" class="indent0">The National Strategy established under subsection (a) shall include the following:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id26d54319-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/1"><num value="1">(1)</num><content> Comprehensive long-range,<ref class="footnoteRef" idref="fn002188">1</ref><note type="footnote" id="fn002188"><num>1</num> So in original. The comma probably should not appear.</note> goals for reducing child exploitation.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26d56a2a-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/2"><num value="2">(2)</num><content> Annual measurable objectives and specific targets to accomplish long-term, quantifiable goals that the Attorney General determines may be achieved during each year beginning on the date when the National Strategy is submitted.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26d56a2b-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/3"><num value="3">(3)</num><content> Annual budget priorities and Federal efforts dedicated to combating child exploitation, including resources dedicated to Internet Crimes Against Children task forces, Project Safe Childhood, FBI Innocent Images Initiative, the National Center for Missing and Exploited Children, regional forensic computer labs, Internet Safety <ref class="footnoteRef" idref="fn002189">2</ref><note type="footnote" id="fn002189"><num>2</num> So in original. Probably should not be capitalized.</note> programs, and all other entities whose goal or mission is to combat the exploitation of children that receive Federal support.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26d56a2c-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/4"><num value="4">(4)</num><content> A 5-year projection for program and budget goals and priorities.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26d56a2d-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/5"><num value="5">(5)</num><content> A review of the policies and work of the Department of Justice related to the prevention and investigation of child exploitation crimes, including efforts at the Office of Justice Programs, the Criminal Division of the Department of Justice, the Executive Office of United States Attorneys, the Federal Bureau of Investigation, the Office of the Attorney General, the Office of the Deputy Attorney General, the Office of Legal Policy, and any other agency or bureau of the Department of Justice whose activities relate to child exploitation.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26d5913e-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/6"><num value="6">(6)</num><content> A description of the Department’s efforts to coordinate with international, State, local, tribal law enforcement, and private sector entities on child exploitation prevention and interdiction efforts.</content>

</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26d59144-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/7/E"><num value="E">(E)</num><content> the Department of Education;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26d59145-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/7/F"><num value="F">(F)</num><content> the Department of Health and Human Services; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26d5b856-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/7/G"><num value="G">(G)</num><content> other appropriate Federal agencies.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26d5b857-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/8"><num value="8">(8)</num><chapeau> A review of the Internet Crimes Against Children Task Force Program, including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id26d5b858-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/8/A"><num value="A">(A)</num><content> the number of ICAC task forces and location of each ICAC task force;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26d5b859-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/8/B"><num value="B">(B)</num><content> the number of trained personnel at each ICAC task force;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26d5b85a-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/8/C"><num value="C">(C)</num><content> the amount of Federal grants awarded to each ICAC task force;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26d5b85b-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/8/D"><num value="D">(D)</num><chapeau> an assessment of the Federal, State, and local cooperation in each task force, including—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id26d5b85c-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/8/D/i"><num value="i">(i)</num><content> the number of arrests made by each task force;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26d5b85d-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/8/D/ii"><num value="ii">(ii)</num><content> the number of criminal referrals to United States attorneys for prosecution;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26d5b85e-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/8/D/iii"><num value="iii">(iii)</num><content> the number of prosecutions and convictions from the referrals made under clause (ii);</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26d5b85f-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/8/D/iv"><num value="iv">(iv)</num><content> the number, if available, of local prosecutions and convictions based on ICAC task force investigations; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26d5b860-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/8/D/v"><num value="v">(v)</num><content> any other information demonstrating the level of Federal, State, and local coordination and cooperation, as such information is to be determined by the Attorney General;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26d5df71-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/8/E"><num value="E">(E)</num><content> an assessment of the training opportunities and technical assistance available to support ICAC task force grantees; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26d5df72-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/8/F"><num value="F">(F)</num><content> an assessment of the success of the Internet Crimes Against Children Task Force Program at leveraging State and local resources and matching funds.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26d5df73-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/9"><num value="9">(9)</num><content> An assessment of the technical assistance and support available for Federal, State, local, and tribal law enforcement agencies, in the prevention, investigation, and prosecution of child exploitation crimes.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26d5df74-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/10"><num value="10">(10)</num><content> A review of the backlog of forensic analysis for child exploitation cases at each FBI Regional Forensic lab and an estimate of the backlog at State and local labs.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26d5df75-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/11"><num value="11">(11)</num><content> Plans for reducing the forensic backlog described in paragraph (10), if any, at Federal, State and local forensic labs.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26d5df76-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/12"><num value="12">(12)</num><content> A review of the Federal programs related to child exploitation prevention and education, including those related to Internet safety, including efforts by the private sector and nonprofit entities, or any other initiatives, that have proven successful in promoting child safety and Internet safety.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26d60687-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/13"><num value="13">(13)</num><content> An assessment of the future trends, challenges, and opportunities, including new technologies, that will impact Federal, State, local, and tribal efforts to combat child exploitation.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26d60688-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/14"><num value="14">(14)</num><content> Plans for liaisons with the judicial branches of the Federal and State governments on matters relating to child exploitation.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26d60689-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/15"><num value="15">(15)</num><chapeau> An assessment of Federal investigative and prosecution activity relating to reported incidents of child exploitation crimes, which shall include a number of factors, including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id26d6068a-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/15/A"><num value="A">(A)</num><content> the number of high-priority suspects (identified because of the volume of suspected criminal activity or because of the danger to the community or a potential victim) who were investigated and prosecuted;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26d6068b-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/15/B"><num value="B">(B)</num><content> the number of investigations, arrests, prosecutions and convictions for a crime of child exploitation; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26d6068c-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/15/C"><num value="C">(C)</num><content> the average sentence imposed and statutory maximum for each crime of child exploitation.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26d62d9d-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/16"><num value="16">(16)</num><chapeau> A review of all available statistical data indicating the overall magnitude of child pornography trafficking in the United States and internationally, including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id26d62d9e-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/16/A"><num value="A">(A)</num><content> the number of computers or computer users, foreign and domestic, observed engaging in, or suspected by law enforcement agencies and other sources of engaging in, peer-to-peer file sharing of child pornography;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26d62d9f-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/16/B"><num value="B">(B)</num><content> the number of computers or computer users, foreign and domestic, observed engaging in, or suspected by law enforcement agencies and other reporting sources of engaging in, buying and selling, or other commercial activity related to child pornography;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26d62da0-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/16/C"><num value="C">(C)</num><content> the number of computers or computer users, foreign and domestic, observed engaging in, or suspected by law enforcement agencies and other sources of engaging in, all other forms of activity related to child pornography;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26d62da1-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/16/D"><num value="D">(D)</num><content> the number of tips or other statistical data from the National Center for Missing and Exploited Children’s CyberTipline and other data indicating the magnitude of child pornography trafficking; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26d654b2-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/16/E"><num value="E">(E)</num><content> any other statistical data indicating the type, nature, and extent of child exploitation crime in the United States and abroad.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26d654b3-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/17"><num value="17">(17)</num><chapeau> Copies of recent relevant research and studies related to child exploitation, including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id26d654b4-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/17/A"><num value="A">(A)</num><content> studies related to the link between possession or trafficking of child pornography and actual abuse of a child;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26d654b5-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/17/B"><num value="B">(B)</num><content> studies related to establishing a link between the types of files being viewed or shared and the type of illegal activity; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26d654b6-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/17/C"><num value="C">(C)</num><content> any other research, studies, and available information related to child exploitation.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26d654b7-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/18"><num value="18">(18)</num><content> A review of the extent of cooperation, coordination, and mutual support between private sector and other entities and organizations and Federal agencies, including the involvement of States, local and tribal government agencies to the extent Federal programs are involved.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26d67bc8-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/c/19"><num value="19">(19)</num><content> The results of the Project Safe Childhood Conference or other conferences or meetings convened by the Department of Justice related to combating child exploitation.</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26d67bc9-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/d"><num value="d" class="bold">(d)</num><heading class="bold"> Appointment of high-level official</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26d67bca-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Attorney General shall designate a senior official at the Department of Justice with experience in investigating or prosecuting child exploitation cases as the National Coordinator for Child Exploitation Prevention and Interdiction who shall be responsible for coordinating the development of the National Strategy established under subsection (a). The National Coordinator for Child Exploitation Prevention and Interdiction shall be a position in the Senior Executive Service.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26d67bcb-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Duties</heading><chapeau style="-uslm-lc:I12" class="indent1">The duties of the official designated under paragraph (1) shall include—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id26d67bcc-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/d/2/A"><num value="A">(A)</num><content> acting as a liaison with all Federal agencies regarding the development of the National Strategy;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26d67bcd-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/d/2/B"><num value="B">(B)</num><content> working to ensure that there is proper coordination among agencies in developing the National Strategy;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26d6a2de-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/d/2/C"><num value="C">(C)</num><content> being knowledgeable about budget priorities and familiar with all efforts within the Department of Justice and the FBI related to child exploitation prevention and interdiction; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26d6a2df-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s21111/d/2/D"><num value="D">(D)</num><content> communicating the National Strategy to Congress and being available to answer questions related to the strategy at congressional hearings, if requested by committees of appropriate jurisdictions, on the contents of the National Strategy and progress of the Department of Justice in implementing the National Strategy.</content>
