The system shall not be used to search for or obtain any information that does not involve the use of the Internet to facilitate child exploitation.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26d829b9-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Intent of Congress</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">It is the purpose and intent of Congress that the National Internet Crimes Against Children Data System established in subsection (a) is intended to continue and build upon Operation Fairplay developed by the Wyoming Attorney General’s office, which has established a secure, dynamic undercover infrastructure that has facilitated online law enforcement investigations of child exploitation, information sharing, and the capacity to collect and aggregate data on the extent of the problems of child exploitation.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26d829ba-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Purpose of system</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The National Internet Crimes Against Children Data System established under subsection (a) shall be dedicated to assisting and supporting credentialed law enforcement agencies authorized to investigate child exploitation in accordance with Federal, State, local, and tribal laws, including by providing assistance and support to—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26d850cb-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/c/1\"><num value=\"1\">(1)</num><content> Federal agencies investigating and prosecuting child exploitation;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26d850cc-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/c/2\"><num value=\"2\">(2)</num><content> the ICAC Task Force Program established under <ref href=\"/us/usc/t34/s21112\">section 21112 of this title</ref>;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26d850cd-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/c/3\"><num value=\"3\">(3)</num><content> State, local, and tribal agencies investigating and prosecuting child exploitation; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26d850ce-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/c/4\"><num value=\"4\">(4)</num><content> foreign or international law enforcement agencies, subject to approval by the Attorney General.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26d850cf-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Cyber safe deconfliction and information sharing</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The National Internet Crimes Against Children Data System established under subsection (a)—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26d850d0-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/d/1\"><num value=\"1\">(1)</num><content> shall be housed and maintained within the Department of Justice or a credentialed law enforcement agency;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26d850d1-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/d/2\"><num value=\"2\">(2)</num><content> shall be made available for a nominal charge to support credentialed law enforcement agencies in accordance with subsection (c); and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26d850d2-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/d/3\"><num value=\"3\">(3)</num><chapeau> shall—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26d850d3-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/d/3/A\"><num value=\"A\">(A)</num><content> allow Federal, State, local, and tribal agencies and ICAC task forces investigating and prosecuting child exploitation to contribute and access data for use in resolving case conflicts;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26d877e4-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/d/3/B\"><num value=\"B\">(B)</num><content> provide, directly or in partnership with a credentialed law enforcement agency, a dynamic undercover infrastructure to facilitate online law enforcement investigations of child exploitation;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26d877e5-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/d/3/C\"><num value=\"C\">(C)</num><content> facilitate the development of essential software and network capability for law enforcement participants; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26d877e6-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/d/3/D\"><num value=\"D\">(D)</num><content> provide software or direct hosting and support for online investigations of child exploitation activities, or, in the alternative, provide users with a secure connection to an alternative system that provides such capabilities, provided that the system is hosted within a governmental agency or a credentialed law enforcement agency.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26d877e7-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Collection and reporting of data</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26d877e8-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/e/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The National Internet Crimes Against Children Data System established under subsection (a) shall ensure the following:</chapeau><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id26d877e9-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/e/1/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Real-time reporting</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">All child exploitation cases involving local child victims that are reasonably detectable using available software and data are, immediately upon their detection, made available to participating law enforcement agencies.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id26d89efa-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/e/1/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> High-priority suspects</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">Every 30 days, at minimum, the National Internet Crimes Against Children Data System shall—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26d89efb-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/e/1/B/i\"><num value=\"i\">(i)</num><content> identify high-priority suspects, as such suspects are determined by indicators of seriousness of offense or dangerousness to the community or a potential local victim; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26d89efc-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/e/1/B/ii\"><num value=\"ii\">(ii)</num><content> report all such identified high-priority suspects to participating law enforcement agencies.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id26d89efd-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/e/1/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Annual reports</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Any statistical data indicating the overall magnitude of child pornography trafficking and child exploitation in the United States and internationally is made available and included in the National Strategy, as is required under <ref href=\"/us/usc/t34/s21111/c/16\">section 21111(c)(16) of this title</ref>.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26d89efe-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/e/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Rule of construction</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Nothing in this subsection shall be construed to limit the ability of participating law enforcement agencies to disseminate investigative leads or statistical information in accordance with State and local laws.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26d8c60f-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Mandatory requirements of network</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The National Internet Crimes Against Children Data System established under subsection (a) shall develop, deploy, and maintain an integrated technology and training program that provides—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26d8c610-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/f/1\"><num value=\"1\">(1)</num><content> a secure, online system for Federal law enforcement agencies, ICAC task forces, and other State, local, and tribal law enforcement agencies for use in resolving case conflicts, as provided in subsection (d);</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26d8c611-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/f/2\"><num value=\"2\">(2)</num><content> a secure system enabling online communication and collaboration by Federal law enforcement agencies, ICAC task forces, and other State, local, and tribal law enforcement agencies regarding ongoing investigations, investigatory techniques, best practices, and any other relevant news and professional information;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26d8c612-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/f/3\"><num value=\"3\">(3)</num><content> a secure online data storage and analysis system for use by Federal law enforcement agencies, ICAC task forces, and other State, local, and tribal law enforcement agencies;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26d8ed23-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/f/4\"><num value=\"4\">(4)</num><content> secure connections or interaction with State and local law enforcement computer networks, consistent with reasonable and established security protocols and guidelines;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26d8ed24-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/f/5\"><num value=\"5\">(5)</num><content> guidelines for use of the National Internet Crimes Against Children Data System by Federal, State, local, and tribal law enforcement agencies and ICAC task forces; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26d8ed25-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/f/6\"><num value=\"6\">(6)</num><content> training and technical assistance on the use of the National Internet Crimes Against Children Data System by Federal, State, local, and tribal law enforcement agencies and ICAC task forces.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26d8ed26-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/g\"><num value=\"g\" class=\"bold\">(g)</num><heading class=\"bold\"> National Internet Crimes Against Children Data System Steering Committee</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Attorney General shall establish a National Internet Crimes Against Children Data System Steering Committee to provide guidance to the Network relating to the program under subsection (f), and to assist in the development of strategic plans for the System. The Steering Committee shall consist of 10 members with expertise in child exploitation prevention and interdiction prosecution, investigation, or prevention, including—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26d91437-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/g/1\"><num value=\"1\">(1)</num><content> 3 representatives elected by the local directors of the ICAC task forces, such representatives shall represent different geographic regions of the country;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26d91438-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/g/2\"><num value=\"2\">(2)</num><content> 1 representative of the Department of Justice Office of Information Services;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26d91439-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/g/3\"><num value=\"3\">(3)</num><content> 1 representative from Operation Fairplay, currently hosted at the Wyoming Office of the Attorney General;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26d9143a-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/g/4\"><num value=\"4\">(4)</num><content> 1 representative from the law enforcement agency having primary responsibility for hosting and maintaining the National Internet Crimes Against Children Data System;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26d9143b-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/g/5\"><num value=\"5\">(5)</num><content> 1 representative of the Federal Bureau of Investigation’s Innocent Images National Initiative or Regional Computer Forensic Lab program;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26d9143c-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/g/6\"><num value=\"6\">(6)</num><content> 1 representative of the Immigration and Customs Enforcement’s Cyber Crimes Center;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26d9143d-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/g/7\"><num value=\"7\">(7)</num><content> 1 representative of the United States Postal Inspection Service; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26d9143e-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/g/8\"><num value=\"8\">(8)</num><content> 1 representative of the Department of Justice.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26d9143f-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s21115/h\"><num value=\"h\" class=\"bold\">(h)</num><heading class=\"bold\"> Authorization of appropriations</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">There are authorized to be appropriated for each of the fiscal years 2009 through 2016, $2,000,000 to carry out the provisions of this section.</p>\n</content>\n</subsection>\n<sourceCredit id=\"id26d93b50-0f21-11eb-9212-a1a9175aa019\">(<ref href=\"/us/pl/110/401/tI/s105\">Pub.
