The initial report required under this subsection shall be submitted by <date date=\"2009-05-01\">May 1, 2009</date>. All subsequent annual reports shall be submitted by May 1st of each fiscal year thereafter. The report required under this subsection may be submitted as part of the annual performance report of the Department of Justice, and shall include the following:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26e4ac67-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/a/1\"><num value=\"1\">(1)</num><content> With respect to grants issued under <ref href=\"/us/usc/t34/s30103\">section 30103 of this title</ref>, the number and identity of State and local law enforcement grant applicants, the number of grants issued, the dollar value of each grant, including a break down of such value showing how the recipient used the funds, the specific purpose of each grant, and the reports from recipients of the grants on the efficacy of the program supported by the grant. The Department of Justice shall use the information provided by the grant recipients to produce a statement for each individual grant. Such statement shall state whether each grantee has accomplished the purposes of the grant as established in <ref href=\"/us/usc/t34/s30103/b\">section 30103(b) of this title</ref>. Those grantees not in compliance with the requirements of sections 30103 to 30106 of this title shall be subject, but not limited to, sanctions as described in the Financial Guide issued by the Office of Justice Programs at the Department of Justice.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26e4d378-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/a/2\"><num value=\"2\">(2)</num><content> With respect to the additional agents of the Federal Bureau of Investigation authorized under paragraphs (1) and (2) of <ref href=\"/us/usc/t34/s30104/a\">section 30104(a) of this title</ref>, the number of investigations and actions in which such agents were engaged, the type of each action, the resolution of each action, and any penalties imposed in each action.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26e4d379-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/a/3\"><num value=\"3\">(3)</num><content> With respect to the training program authorized under <ref href=\"/us/usc/t34/s30104/a/4\">section 30104(a)(4) of this title</ref>, the number of agents of the Federal Bureau of Investigation participating in such program, the elements of the training program, and the subject matters covered by the program.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26e4d37a-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/a/4\"><num value=\"4\">(4)</num><content> With respect to the organized crime plan authorized under <ref href=\"/us/usc/t34/s30104/b\">section 30104(b) of this title</ref>, the number of organized crime investigations and prosecutions resulting from such plan.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26e4d37b-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/a/5\"><num value=\"5\">(5)</num><chapeau> With respect to the authorizations under <ref href=\"/us/usc/t34/s30105\">section 30105 of this title</ref>—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26e4d37c-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/a/5/A\"><num value=\"A\">(A)</num><content> the number of law enforcement officers hired and the number trained;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26e4d37d-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/a/5/B\"><num value=\"B\">(B)</num><content> the number and type of investigations and prosecutions resulting from the hiring and training of such law enforcement officers;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26e4d37e-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/a/5/C\"><num value=\"C\">(C)</num><content> the defendants involved in any such prosecutions;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26e4d37f-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/a/5/D\"><num value=\"D\">(D)</num><content> any penalties imposed in each such successful prosecution;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26e4d380-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/a/5/E\"><num value=\"E\">(E)</num><content> the advanced tools of forensic science procured to investigate, prosecute, and study computer hacking or intellectual property crimes; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26e4d381-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/a/5/F\"><num value=\"F\">(F)</num><content> the number and type of investigations and prosecutions in such tools were used.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26e4d382-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/a/6\"><num value=\"6\">(6)</num><content> Any other information that the Attorney General may consider relevant to inform Congress on the effective use of the resources authorized under sections 30103, 30104, and 30105 of this title.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26e4d383-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/a/7\"><num value=\"7\">(7)</num><chapeau> A summary of the efforts, activities, and resources the Department of Justice has allocated to the enforcement, investigation, and prosecution of intellectual property crimes, including—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26e4fa94-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/a/7/A\"><num value=\"A\">(A)</num><content> a review of the policies and efforts of the Department of Justice related to the prevention and investigation of intellectual property crimes, including efforts at the Office of Justice Programs, the Criminal Division of the Department of Justice, the Executive Office of United States Attorneys, the Office of the Attorney General, the Office of the Deputy Attorney General, the Office of Legal Policy, and any other agency or bureau of the Department of Justice whose activities relate to intellectual property;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26e4fa95-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/a/7/B\"><num value=\"B\">(B)</num><content> a summary of the overall successes and failures of such policies and efforts;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26e4fa96-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/a/7/C\"><num value=\"C\">(C)</num><chapeau> a review of the investigative and prosecution activity of the Department of Justice with respect to intellectual property crimes, including—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26e4fa97-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/a/7/C/i\"><num value=\"i\">(i)</num><content> the number of investigations initiated related to such crimes;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26e4fa98-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/a/7/C/ii\"><num value=\"ii\">(ii)</num><content> the number of arrests related to such crimes; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26e4fa99-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/a/7/C/iii\"><num value=\"iii\">(iii)</num><chapeau> the number of prosecutions for such crimes, including—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id26e4fa9a-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/a/7/C/iii/I\"><num value=\"I\">(I)</num><content> the number of defendants involved in such prosecutions;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id26e4fa9b-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/a/7/C/iii/II\"><num value=\"II\">(II)</num><content> whether the prosecution resulted in a conviction; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id26e4fa9c-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/a/7/C/iii/III\"><num value=\"III\">(III)</num><content> the sentence and the statutory maximum for such crime, as well as the average sentence imposed for such crime; and</content>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26e4fa9d-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/a/7/D\"><num value=\"D\">(D)</num><content> a Department-wide assessment of the staff, financial resources, and other resources (such as time, technology, and training) devoted to the enforcement, investigation, and prosecution of intellectual property crimes, including the number of investigators, prosecutors, and forensic specialists dedicated to investigating and prosecuting intellectual property crimes.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26e4fa9e-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/a/8\"><num value=\"8\">(8)</num><chapeau> A summary of the efforts, activities, and resources that the Department of Justice has taken to—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26e4fa9f-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/a/8/A\"><num value=\"A\">(A)</num><content> minimize duplicating the efforts, materials, facilities, and procedures of any other Federal agency responsible for the enforcement, investigation, or prosecution of intellectual property crimes; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26e521b0-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/a/8/B\"><num value=\"B\">(B)</num><content> enhance the efficiency and consistency with which Federal funds and resources are expended to enforce, investigate, or prosecute intellectual property crimes, including the extent to which the Department has utilized existing personnel, materials, technologies, and facilities.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26e521b1-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Initial report of the Attorney General</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The first report required to be submitted by the Attorney General under subsection (a) shall include a summary of the efforts, activities, and resources the Department of Justice has allocated in the 5 years prior to <date date=\"2008-10-13\">October 13, 2008</date>, as well as the 1-year period following such date, to the enforcement, investigation, and prosecution of intellectual property crimes, including—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26e521b2-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/b/1\"><num value=\"1\">(1)</num><content> a review of the policies and efforts of the Department of Justice related to the prevention and investigation of intellectual property crimes, including efforts at the Office of Justice Programs, the Criminal Division of the Department of Justice, the Executive Office of United States Attorneys, the Office of the Attorney General, the Office of the Deputy Attorney General, the Office of Legal Policy, and any other agency or bureau of the Department of Justice whose activities relate to intellectual property;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26e521b3-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/b/2\"><num value=\"2\">(2)</num><content> a summary of the overall successes and failures of such policies and efforts;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26e521b4-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/b/3\"><num value=\"3\">(3)</num><chapeau> a review of the investigative and prosecution activity of the Department of Justice with respect to intellectual property crimes, including—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26e521b5-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/b/3/A\"><num value=\"A\">(A)</num><content> the number of investigations initiated related to such crimes;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26e521b6-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/b/3/B\"><num value=\"B\">(B)</num><content> the number of arrests related to such crimes; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26e521b7-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/b/3/C\"><num value=\"C\">(C)</num><chapeau> the number of prosecutions for such crimes, including—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26e521b8-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/b/3/C/i\"><num value=\"i\">(i)</num><content> the number of defendants involved in such prosecutions;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26e521b9-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/b/3/C/ii\"><num value=\"ii\">(ii)</num><content> whether the prosecution resulted in a conviction; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26e521ba-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/b/3/C/iii\"><num value=\"iii\">(iii)</num><content> the sentence and the statutory maximum for such crime, as well as the average sentence imposed for such crime; and</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26e548cb-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/b/4\"><num value=\"4\">(4)</num><content> a Department-wide assessment of the staff, financial resources, and other resources (such as time, technology, and training) devoted to the enforcement, investigation, and prosecution of intellectual property crimes, including the number of investigators, prosecutors, and forensic specialists dedicated to investigating and prosecuting intellectual property crimes.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26e548cc-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Report of the FBI</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Not later than 1 year after <date date=\"2008-10-13\">October 13, 2008</date>, and annually thereafter, the Director of the Federal Bureau of Investigation shall submit a report to Congress on actions taken to carry out sections 30103 to 30106 of this title. The initial report required under this subsection shall be submitted by <date date=\"2009-05-01\">May 1, 2009</date>. All subsequent annual reports shall be submitted by May 1st of each fiscal year thereafter. The report required under this subsection may be submitted as part of the annual performance report of the Department of Justice, and shall include—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26e548cd-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/c/1\"><num value=\"1\">(1)</num><content> a review of the policies and efforts of the Bureau related to the prevention and investigation of intellectual property crimes;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26e548ce-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/c/2\"><num value=\"2\">(2)</num><content> a summary of the overall successes and failures of such policies and efforts;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26e548cf-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/c/3\"><num value=\"3\">(3)</num><chapeau> a review of the investigative and prosecution activity of the Bureau with respect to intellectual property crimes, including—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26e548d0-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/c/3/A\"><num value=\"A\">(A)</num><content> the number of investigations initiated related to such crimes;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26e548d1-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/c/3/B\"><num value=\"B\">(B)</num><content> the number of arrests related to such crimes; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26e548d2-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/c/3/C\"><num value=\"C\">(C)</num><chapeau> the number of prosecutions for such crimes, including—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26e548d3-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/c/3/C/i\"><num value=\"i\">(i)</num><content> the number of defendants involved in such prosecutions;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26e548d4-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/c/3/C/ii\"><num value=\"ii\">(ii)</num><content> whether the prosecution resulted in a conviction; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26e548d5-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/c/3/C/iii\"><num value=\"iii\">(iii)</num><content> the sentence and the statutory maximum for such crime, as well as the average sentence imposed for such crime; and</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26e548d6-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/c/4\"><num value=\"4\">(4)</num><content> a Bureau-wide assessment of the staff, financial resources, and other resources (such as time, technology, and training) devoted to the enforcement, investigation, and prosecution of intellectual property crimes, including the number of investigators, prosecutors, and forensic specialists dedicated to investigating and prosecuting intellectual property crimes.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26e56fe7-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Initial report of the FBI</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The first report required to be submitted by the Director of the Federal Bureau of Investigation under subsection (c) shall include a summary of the efforts, activities, and resources the Federal Bureau of Investigation has allocated in the 5 years prior to <date date=\"2008-10-13\">October 13, 2008</date>, as well as the 1-year period following such date to the enforcement, investigation, and prosecution of intellectual property crimes, including—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26e56fe8-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/d/1\"><num value=\"1\">(1)</num><content> a review of the policies and efforts of the Bureau related to the prevention and investigation of intellectual property crimes;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26e56fe9-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/d/2\"><num value=\"2\">(2)</num><content> a summary of the overall successes and failures of such policies and efforts;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26e56fea-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/d/3\"><num value=\"3\">(3)</num><chapeau> a review of the investigative and prosecution activity of the Bureau with respect to intellectual property crimes, including—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26e56feb-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/d/3/A\"><num value=\"A\">(A)</num><content> the number of investigations initiated related to such crimes;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26e56fec-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/d/3/B\"><num value=\"B\">(B)</num><content> the number of arrests related to such crimes; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26e56fed-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/d/3/C\"><num value=\"C\">(C)</num><chapeau> the number of prosecutions for such crimes, including—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26e56fee-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/d/3/C/i\"><num value=\"i\">(i)</num><content> the number of defendants involved in such prosecutions;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26e56fef-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/d/3/C/ii\"><num value=\"ii\">(ii)</num><content> whether the prosecution resulted in a conviction; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26e56ff0-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30106/d/3/C/iii\"><num value=\"iii\">(iii)</num><content> the sentence and the statutory maximum for such crime, as well as the average sentence imposed for such crime;
