The purpose of grants under this section shall be to provide funds for personnel, training, technical assistance, data collection, and equipment to prevent and prosecute prisoner rape.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26e74523-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Use of grant amounts</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Amounts received by a grantee under this section may be used by the grantee, directly or through subgrants, only for one or more of the following activities:</chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26e74524-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Protecting inmates</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Protecting inmates by—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26e74525-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/b/1/A\"><num value=\"A\">(A)</num><content> undertaking efforts to more effectively prevent prison rape;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26e74526-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/b/1/B\"><num value=\"B\">(B)</num><content> investigating incidents of prison rape; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26e74527-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/b/1/C\"><num value=\"C\">(C)</num><content> prosecuting incidents of prison rape.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26e74528-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Safeguarding communities</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Safeguarding communities by—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26e74529-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/b/2/A\"><num value=\"A\">(A)</num><content> making available, to officials of State and local governments who are considering reductions to prison budgets, training and technical assistance in successful methods for moderating the growth of prison populations without compromising public safety, including successful methods used by other jurisdictions;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26e76c3a-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/b/2/B\"><num value=\"B\">(B)</num><content> developing and utilizing analyses of prison populations and risk assessment instruments that will improve State and local governments’ understanding of risks to the community regarding release of inmates in the prison population;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26e76c3b-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/b/2/C\"><num value=\"C\">(C)</num><chapeau> preparing maps demonstrating the concentration, on a community-by-community basis, of inmates who have been released, to facilitate the efficient and effective—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26e76c3c-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/b/2/C/i\"><num value=\"i\">(i)</num><content> deployment of law enforcement resources (including probation and parole resources); and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26e76c3d-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/b/2/C/ii\"><num value=\"ii\">(ii)</num><content> delivery of services (such as job training and substance abuse treatment) to those released inmates;</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26e76c3e-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/b/2/D\"><num value=\"D\">(D)</num><content> promoting collaborative efforts, among officials of State and local governments and leaders of appropriate communities, to understand and address the effects on a community of the presence of a disproportionate number of released inmates in that community; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26e76c3f-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/b/2/E\"><num value=\"E\">(E)</num><content> developing policies and programs that reduce spending on prisons by effectively reducing rates of parole and probation revocation without compromising public safety.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26e76c40-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Grant requirements</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26e76c41-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Period</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">A grant under this section shall be made for a period of not more than 2 years.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26e76c42-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Maximum</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The amount of a grant under this section may not exceed $1,000,000.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26e76c43-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/c/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Matching</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Federal share of a grant under this section may not exceed 50 percent of the total costs of the project described in the application submitted under subsection (d) for the fiscal year for which the grant was made under this section.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26e76c44-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Applications</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26e76c45-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">To request a grant under this section, the chief executive of a State shall submit an application to the Attorney General at such time, in such manner, and accompanied by such information as the Attorney General may require.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26e76c46-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Contents</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Each application required by paragraph (1) shall—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26e76c47-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/d/2/A\"><num value=\"A\">(A)</num><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26e76c48-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/d/2/A/i\"><num value=\"i\">(i)</num><content> include the certification of the chief executive that the State receiving such grant has adopted all national prison rape standards that, as of the date on which the application was submitted, have been promulgated under this chapter; or</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26e79359-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/d/2/A/ii\"><num value=\"ii\">(ii)</num><content> demonstrate to the Attorney General, in such manner as the Attorney General shall require, that the State receiving such grant is actively working to adopt and achieve full compliance with the national prison rape standards described in clause (i);</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26e7935a-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/d/2/B\"><num value=\"B\">(B)</num><content> specify with particularity the preventative, prosecutorial, or administrative activities to be undertaken by the State with the amounts received under the grant; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26e7935b-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/d/2/C\"><num value=\"C\">(C)</num><chapeau> in the case of an application for a grant for one or more activities specified in paragraph (2) of subsection (b)—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26e7935c-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/d/2/C/i\"><num value=\"i\">(i)</num><content> review the extent of the budgetary circumstances affecting the State generally and describe how those circumstances relate to the State’s prisons;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26e7935d-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/d/2/C/ii\"><num value=\"ii\">(ii)</num><content> describe the rate of growth of the State’s prison population over the preceding 10 years and explain why the State may have difficulty sustaining that rate of growth; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26e7935e-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/d/2/C/iii\"><num value=\"iii\">(iii)</num><content> explain the extent to which officials (including law enforcement officials) of State and local governments and victims of crime will be consulted regarding decisions whether, or how, to moderate the growth of the State’s prison population.</content>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26e7935f-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Reports by grantee</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26e79360-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/e/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Attorney General shall require each grantee to submit, not later than 90 days after the end of the period for which the grant was made under this section, a report on the activities carried out under the grant. The report shall identify and describe those activities and shall contain an evaluation of the effect of those activities on—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26e79361-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/e/1/A\"><num value=\"A\">(A)</num><content> the number of incidents of prison rape, and the grantee’s response to such incidents; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26e79362-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/e/1/B\"><num value=\"B\">(B)</num><content> the safety of the prisons, and the safety of the communities in which released inmates are present.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26e79363-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/e/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Dissemination</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Attorney General shall ensure that each report submitted under paragraph (1) is made available under the national clearinghouse established under <ref href=\"/us/usc/t34/s30304\">section 30304 of this title</ref>.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26e7b974-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> State defined</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">In this section, the term “State” includes the District of Columbia, the Commonwealth of Puerto Rico, and any other territory or possession of the United States.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26e7b975-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/g\"><num value=\"g\" class=\"bold\">(g)</num><heading class=\"bold\"> Authorization of appropriations</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26e7b976-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/g/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">There are authorized to be appropriated for grants under this section $40,000,000 for each of fiscal years 2004 through 2010.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26e7b977-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s30305/g/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Limitation</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Of amounts made available for grants under this section, not less than 50 percent shall be available only for activities specified in paragraph (1) of subsection (b).</p>\n</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id26e7b978-0f21-11eb-9212-a1a9175aa019\">(<ref href=\"/us/pl/108/79/s6\">Pub.
