<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ide3afae2a-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301"><num value="40301">§ 40301.</num><heading> State grant program for criminal justice identification, information, and communication</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ide3afae2b-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I11" class="indent0">Subject to the availability of amounts provided in advance in appropriations Acts, the Office of Justice Programs relying principally on the expertise of the Bureau of Justice Statistics shall make a grant to each State, in a manner consistent with the national criminal history improvement program, which shall be used by the State, in conjunction with units of local government, State and local courts, other States, or combinations thereof, to establish or upgrade an integrated approach to develop information and identification technologies and systems to—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ide3afae2c-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/a/1"><num value="1">(1)</num><content> upgrade criminal history and criminal justice record systems, including systems operated by law enforcement agencies and courts;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ide3afd53d-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/a/2"><num value="2">(2)</num><content> improve criminal justice identification;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ide3afd53e-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/a/3"><num value="3">(3)</num><chapeau> promote compatibility and integration of national, State, and local systems for—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ide3afd53f-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/a/3/A"><num value="A">(A)</num><content> criminal justice purposes;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ide3afd540-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/a/3/B"><num value="B">(B)</num><content> firearms eligibility determinations;</content>

</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ide3afd545-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/a/4"><num value="4">(4)</num><content> capture information for statistical and research purposes to improve the administration of criminal justice.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ide3afd546-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/b"><num value="b" class="bold">(b)</num><heading class="bold"> Use of grant amounts</heading><chapeau style="-uslm-lc:I11" class="indent0">Grants under this section may be used for programs to establish, develop, update, or upgrade—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ide3afd547-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/b/1"><num value="1">(1)</num><content> State centralized, automated, adult and juvenile criminal history record information systems, including arrest and disposition reporting;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ide3afd548-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/b/2"><num value="2">(2)</num><content> automated fingerprint identification systems that are compatible with standards established by the National Institute of Standards and Technology and interoperable with the Integrated Automated Fingerprint Identification System (IAFIS) of the Federal Bureau of Investigation;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ide3afd549-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/b/3"><num value="3">(3)</num><content> finger imaging, live scan, and other automated systems to digitize fingerprints and to communicate prints in a manner that is compatible with standards established by the National Institute of Standards and Technology and interoperable with systems operated by States and by the Federal Bureau of Investigation;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ide3affc5a-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/b/4"><num value="4">(4)</num><content> programs and systems to facilitate full participation in the Interstate Identification Index of the National Crime Information Center;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ide3affc5b-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/b/5"><num value="5">(5)</num><content> systems to facilitate full participation in any compact relating to the Interstate Identification Index of the National Crime Information Center;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ide3affc5c-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/b/6"><num value="6">(6)</num><content> systems to facilitate full participation in the national instant criminal background check system established under <ref href="/us/usc/t34/s40901/b">section 40901(b) of this title</ref> for firearms eligibility determinations, including through increased efforts to pre-validate the contents of felony conviction records and domestic violence records to expedite eligibility determinations, and measures and resources necessary to establish and achieve compliance with an implementation plan under <ref href="/us/usc/t34/s40917">section 40917 of this title</ref>;</content>
</paragraph>

<paragraph style="-uslm-lc:I12" class="indent1" id="ide3b02373-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/b/11"><num value="11">(11)</num><content> the capabilities of forensic science programs and medical examiner programs related to the administration of criminal justice, including programs leading to accreditation or certification of individuals or departments, agencies, or laboratories, and programs relating to the identification and analysis of deoxyribonucleic acid;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ide3b02374-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/b/12"><num value="12">(12)</num><content> sexual offender identification and registration systems;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ide3b02375-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/b/13"><num value="13">(13)</num><content> domestic violence offender identification and information systems;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ide3b02376-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/b/14"><num value="14">(14)</num><content> programs for fingerprint-supported background checks capability for noncriminal justice purposes, including youth service employees and volunteers and other individuals in positions of responsibility, if authorized by Federal or State law and administered by a government agency;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ide3b07197-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/b/15"><num value="15">(15)</num><content> criminal justice information systems with a capacity to provide statistical and research products including incident-based reporting systems that are compatible with the National Incident-Based Reporting System (NIBRS) and uniform crime reports;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ide3b07198-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/b/16"><num value="16">(16)</num><content> multiagency, multijurisdictional communications systems among the States to share routine and emergency information among Federal, State, and local law enforcement agencies;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ide3b098a9-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/b/17"><num value="17">(17)</num><content> the capability of the criminal justice system to deliver timely, accurate, and complete criminal history record information to child welfare agencies, organizations, and programs that are engaged in the assessment of risk and other activities related to the protection of children, including protection against child sexual abuse, and placement of children in foster care; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ide3b098aa-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/b/18"><num value="18">(18)</num><content> notwithstanding subsection (c), antiterrorism purposes as they relate to any other uses under this section or for other antiterrorism programs.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ide3b098ab-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/c"><num value="c" class="bold">(c)</num><heading class="bold"> Assurances</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ide3b098ac-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">To be eligible to receive a grant under this section, a State shall provide assurances to the Attorney General that the State has the capability to contribute pertinent information to the national instant criminal background check system established under section 103(b) of the Brady Handgun Violence Prevention Act (<ref href="/us/usc/t18/s922">18 U.S.C. 922</ref> note).<sup>2</sup></p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ide3b098ad-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Information sharing</heading><chapeau style="-uslm-lc:I12" class="indent1">Such assurances shall include a provision that ensures that a statewide strategy for information sharing systems is underway, or will be initiated, to improve the functioning of the criminal justice system, with an emphasis on integration of all criminal justice components, law enforcement, courts, prosecution, corrections, and probation and parole. The strategy shall be prepared after consultation with State and local officials with emphasis on the recommendation of officials whose duty it is to oversee, plan, and implement integrated information technology systems, and shall contain—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ide3b098ae-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/c/2/A"><num value="A">(A)</num><content> a definition and analysis of “integration” in the State and localities developing integrated information sharing systems;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ide3b0bfbf-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/c/2/B"><num value="B">(B)</num><content> an assessment of the criminal justice resources being devoted to information technology;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ide3b0bfc0-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/c/2/C"><num value="C">(C)</num><content> Federal, State, regional, and local information technology coordination requirements;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ide3b0bfc1-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/c/2/D"><num value="D">(D)</num><content> an assurance that the individuals who developed the grant application took into consideration the needs of all branches of the State Government and specifically sought the advice of the chief of the highest court of the State with respect to the application;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ide3b0bfc2-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/c/2/E"><num value="E">(E)</num><content> State and local resource needs;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ide3b0bfc3-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/c/2/F"><num value="F">(F)</num><content> the establishment of statewide priorities for planning and implementation of information technology systems; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ide3b0bfc4-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/c/2/G"><num value="G">(G)</num><content> a plan for coordinating the programs funded under this subchapter with other federally funded information technology programs, including directly funded local programs such as the Edward Byrne Justice Assistance Grant Program and the M.O.R.E. program established pursuant to part Q of title I of the Omnibus Crime Control and Safe Streets Act of 1968 [<ref href="/us/usc/t34/s10381">34 U.S.C. 10381</ref> et seq.].</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ide3b0bfc5-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/d"><num value="d" class="bold">(d)</num><heading class="bold"> Matching funds</heading><content><p style="-uslm-lc:I11" class="indent0">The Federal share of a grant received under this subchapter may not exceed 90 percent of the costs of a program or proposal funded under this subchapter unless the State has achieved compliance with an implementation plan under <ref href="/us/usc/t34/s40917">section 40917 of this title</ref> or the Attorney General waives, wholly or in part, the requirements of this subsection.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ide3b0bfc6-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/e"><num value="e" class="bold">(e)</num><heading class="bold"> Authorization of appropriations</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ide3b0bfc7-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">There is authorized to be appropriated to carry out this section $250,000,000 for each of fiscal years 2018 through 2022.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ide3b0bfc8-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Limitations</heading><chapeau style="-uslm-lc:I12" class="indent1">Of the amount made available to carry out this section in any fiscal year—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ide3b0bfc9-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/e/2/A"><num value="A">(A)</num><content> not more than 3 percent may be used by the Attorney General for salaries and administrative expenses;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ide3b0e6da-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/e/2/B"><num value="B">(B)</num><content> not more than 5 percent may be used for technical assistance, training and evaluations, and studies commissioned by Bureau of Justice Statistics of the Department of Justice (through discretionary grants or otherwise) in furtherance of the purposes of this section; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ide3b0e6db-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/e/2/C"><num value="C">(C)</num><content> the Attorney General shall ensure the amounts are distributed on an equitable geographic basis.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ide3b0e6dc-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s40301/f"><num value="f" class="bold">(f)</num><heading class="bold"> Grants to Indian tribes</heading><content><p style="-uslm-lc:I11" class="indent0">Notwithstanding any other provision of this section, the Attorney General may use amounts made available under this section to make grants to Indian tribes for use in accordance with this section.</p>
