Probably should be followed by a comma.</note> samples from rape kits, samples from other sexual assault evidence, and samples taken in cases without an identified suspect.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide3b5a23e-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/a/3\"><num value=\"3\">(3)</num><content> To increase the capacity of laboratories owned by the State or by units of local government to carry out DNA analyses of samples specified in paragraph (1) or (2).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide3b5c94f-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/a/4\"><num value=\"4\">(4)</num><content> To collect DNA samples specified in paragraph (1).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide3b5c950-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/a/5\"><num value=\"5\">(5)</num><content> To ensure that DNA testing and analysis of samples from crimes, including sexual assault and other serious violent crimes, are carried out in a timely manner.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide3b5c951-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/a/6\"><num value=\"6\">(6)</num><content> To implement a DNA arrestee collection process consistent with subchapter III of this chapter.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide3b5c952-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/a/7\"><num value=\"7\">(7)</num><content> To conduct an audit consistent with subsection (n) of the samples of sexual assault evidence that are in the possession of the State or unit of local government and are awaiting testing.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide3b5c953-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/a/8\"><num value=\"8\">(8)</num><content> To ensure that the collection and processing of DNA evidence by law enforcement agencies from crimes, in particular, sexual assault and other violent crimes against persons, is carried out in an appropriate and timely manner and in accordance with the protocols and practices developed under subsection (<i>o</i>)(1).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide3b5c954-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/a/9\"><num value=\"9\">(9)</num><content> To increase the capacity of State and local prosecution offices to address the backlog of violent crime cases in which suspects have been identified through DNA evidence.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ide3b5f065-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Eligibility</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">For a State or unit of local government to be eligible to receive a grant under this section, the chief executive officer of the State or unit of local government shall submit to the Attorney General an application in such form and containing such information as the Attorney General may require. The application shall, as required by the Attorney General—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide3b5f066-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/b/1\"><num value=\"1\">(1)</num><content> provide assurances that the State or unit of local government has implemented, or will implement not later than 120 days after the date of such application, a comprehensive plan for the expeditious DNA analysis of samples in accordance with this section;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide3b5f067-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/b/2\"><num value=\"2\">(2)</num><content> include a certification that each DNA analysis carried out under the plan shall be maintained pursuant to the privacy requirements described in <ref href=\"/us/usc/t34/s12592/b/3\">section 12592(b)(3) of this title</ref>;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide3b5f068-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/b/3\"><num value=\"3\">(3)</num><content> include a certification that the State or unit of local government has determined, by statute, rule, or regulation, those offenses under State law that shall be treated for purposes of this section as qualifying State offenses;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide3b61779-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/b/4\"><num value=\"4\">(4)</num><content> specify the allocation that the State or unit of local government shall make, in using grant amounts to carry out DNA analyses of samples, as between samples specified in subsection (a)(1) and samples specified in subsection (a)(2);</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide3b6177a-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/b/5\"><num value=\"5\">(5)</num><content> specify that portion of grant amounts that the State or unit of local government shall use for the purpose specified in subsection (a)(3);</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide3b6177b-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/b/6\"><num value=\"6\">(6)</num><content> if submitted by a unit of local government, certify that the unit of local government has taken, or is taking, all necessary steps to ensure that it is eligible to include, directly or through a State law enforcement agency, all analyses of samples for which it has requested funding in the Combined DNA Index System;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide3b6177c-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/b/7\"><num value=\"7\">(7)</num><content> specify that portion of grant amounts that the State or unit of local government shall use for the purpose specified in subsection (a)(4); and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide3b6177d-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/b/8\"><num value=\"8\">(8)</num><content> provide assurances that the DNA section of the laboratory to be used to conduct DNA analyses has a written policy that prioritizes the analysis of, to the extent practicable consistent with public safety considerations, samples from homicides and sexual assaults.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ide3b63e8e-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Formula for distribution of grants</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ide3b63e8f-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Attorney General shall distribute grant amounts, and establish appropriate grant conditions under this section, in conformity with a formula or formulas that are designed to effectuate a distribution of funds among eligible States and units of local government that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide3b63e90-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/c/1/A\"><num value=\"A\">(A)</num><content> maximizes the effective utilization of DNA technology to solve crimes and protect public safety; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide3b63e91-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/c/1/B\"><num value=\"B\">(B)</num><chapeau> allocates grants among eligible entities fairly and efficiently to address jurisdictions in which significant backlogs exist, by considering—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide3b63e92-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/c/1/B/i\"><num value=\"i\">(i)</num><content> the number of offender and casework samples awaiting DNA analysis in a jurisdiction;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide3b63e93-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/c/1/B/ii\"><num value=\"ii\">(ii)</num><content> the population in the jurisdiction; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide3b63e94-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/c/1/B/iii\"><num value=\"iii\">(iii)</num><content> the number of part 1 violent crimes in the jurisdiction.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ide3b63e95-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Minimum amount</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Attorney General shall allocate to each State not less than 0.50 percent of the total amount appropriated in a fiscal year for grants under this section, except that the United States Virgin Islands, American Samoa, Guam, and the Northern Mariana Islands shall each be allocated 0.125 percent of the total appropriation.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ide3b664a6-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/c/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Limitation</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Grant amounts distributed under paragraph (1) shall be awarded to conduct DNA analyses of samples from casework or from victims of crime under subsection (a)(2) in accordance with the following limitations:</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide3b664a7-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/c/3/A\"><num value=\"A\">(A)</num><content> For fiscal year 2009, not less than 40 percent of the grant amounts shall be awarded for purposes under subsection (a)(2).</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide3b664a8-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/c/3/B\"><num value=\"B\">(B)</num><content> For each of the fiscal years 2019 through 2024, not less than 40 percent of the grant amounts shall be awarded for purposes under subsection (a)(2).</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide3b664a9-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/c/3/C\"><num value=\"C\">(C)</num><content> For each of fiscal years 2019 through 2024, not less than 75 percent of the total grant amounts shall be awarded for a combination of purposes under paragraphs (1), (2), and (3) of subsection (a).</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ide3b664aa-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/c/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Allocation of grant awards for audits</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">For each of fiscal years 2014 through 2022, not less than 5 percent, but not more than 7 percent, of the grant amounts distributed under paragraph (1) shall, if sufficient applications to justify such amounts are received by the Attorney General, be awarded for purposes described in subsection (a)(7), provided that none of the funds required to be distributed under this paragraph shall decrease or otherwise limit the availability of funds required to be awarded to States or units of local government under paragraph (3).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ide3b68bbb-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/c/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Allocation of grant awards for prosecutors</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">For each fiscal year, not less than 5 percent, but not more than 7 percent, of the grant amounts distributed under paragraph (1) shall, if sufficient applications to justify such amounts are received by the Attorney General, be awarded for purposes described in subsection (a)(9), provided that none of the funds required to be distributed under this paragraph shall decrease or otherwise limit the availability of funds required to be awarded to States or units of local government under paragraph (3).</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ide3b68bbc-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Analysis of samples</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ide3b68bbd-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">A plan pursuant to subsection (b)(1) shall require that, except as provided in paragraph (3), each DNA analysis be carried out in a laboratory that satisfies quality assurance standards and is—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide3b68bbe-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/d/1/A\"><num value=\"A\">(A)</num><content> operated by the State or a unit of local government; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide3b6b2cf-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/d/1/B\"><num value=\"B\">(B)</num><content> operated by a private entity pursuant to a contract with the State or a unit of local government.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ide3b6b2d0-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Quality assurance standards</heading><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide3b6b2d1-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/d/2/A\"><num value=\"A\">(A)</num><content> The Director of the Federal Bureau of Investigation shall maintain and make available to States and units of local government a description of quality assurance protocols and practices that the Director considers adequate to assure the quality of a forensic laboratory.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide3b6b2d2-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/d/2/B\"><num value=\"B\">(B)</num><content> For purposes of this section, a laboratory satisfies quality assurance standards if the laboratory satisfies the quality control requirements described in paragraphs (1) and (2) of <ref href=\"/us/usc/t34/s12592/b\">section 12592(b) of this title</ref>.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ide3b6b2d3-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/d/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Use of vouchers or contracts for certain purposes</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ide3b6b2d4-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/d/3/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">A grant for the purposes specified in paragraph (1), (2), or (5) of subsection (a) may be made in the form of a voucher or contract for laboratory services, even if the laboratory makes a reasonable profit for the services.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ide3b6b2d5-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/d/3/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Redemption</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">A voucher or contract under subparagraph (A) may be redeemed at a laboratory operated on a nonprofit or for-profit basis, by a private entity that satisfies quality assurance standards and has been approved by the Attorney General.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ide3b6d9e6-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/d/3/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Payments</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The Attorney General may use amounts authorized under subsection (j) to make payments to a laboratory described under subparagraph (B).</p>\n</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ide3b6d9e7-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Restrictions on use of funds</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ide3b6d9e8-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/e/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Nonsupplanting</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Funds made available pursuant to this section shall not be used to supplant State or local government funds, but shall be used to increase the amount of funds that would, in the absence of Federal funds, be made available from State or local government sources for the purposes of this Act.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ide3b6d9e9-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/e/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Administrative costs</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">A State or unit of local government may not use more than 3 percent of the funds it receives from this section for administrative expenses.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ide3b6d9ea-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Reports to the Attorney General</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Each State or unit of local government which receives a grant under this section shall submit to the Attorney General, for each year in which funds from a grant received under this section is expended, a report at such time and in such manner as the Attorney General may reasonably require, which contains—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide3b700fb-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/f/1\"><num value=\"1\">(1)</num><content> a summary of the activities carried out under the grant and an assessment of whether such activities are meeting the needs identified in the application; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide3b700fc-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/f/2\"><num value=\"2\">(2)</num><content> such other information as the Attorney General may require.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ide3b700fd-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/g\"><num value=\"g\" class=\"bold\">(g)</num><heading class=\"bold\"> Reports to Congress</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Not later than 90 days after the end of each fiscal year for which grants are made under this section, the Attorney General shall submit to the Congress a report that includes—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide3b700fe-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/g/1\"><num value=\"1\">(1)</num><content> the aggregate amount of grants made under this section to each State or unit of local government for such fiscal year;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide3b700ff-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/g/2\"><num value=\"2\">(2)</num><content> a summary of the information provided by States or units of local government receiving grants under this section; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide3b70100-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/g/3\"><num value=\"3\">(3)</num><content> a description of the priorities and plan for awarding grants among eligible States and units of local government, and how such plan will ensure the effective use of DNA technology to solve crimes and protect public safety.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ide3b70101-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/h\"><num value=\"h\" class=\"bold\">(h)</num><heading class=\"bold\"> Expenditure records</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ide3b70102-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/h/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Each State or unit of local government which receives a grant under this section shall keep records as the Attorney General may require to facilitate an effective audit of the receipt and use of grant funds received under this section.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ide3b72813-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/h/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Access</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Each State or unit of local government which receives a grant under this section shall make available, for the purpose of audit and examination, such records as are related to the receipt or use of any such grant.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ide3b72814-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Definition</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">For purposes of this section, the term “State” means a State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, the United States Virgin Islands, American Samoa, Guam, and the Northern Mariana Islands.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ide3b72815-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/j\"><num value=\"j\" class=\"bold\">(j)</num><heading class=\"bold\"> Authorization of appropriations</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">There are authorized to be appropriated to the Attorney General for grants under subsection (a) $151,000,000 for each of fiscal years 2019 through 2024.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ide3b72816-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/k\"><num value=\"k\" class=\"bold\">(k)</num><heading class=\"bold\"> Use of funds for accreditation and audits</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Attorney General may distribute not more than 1 percent of the grant amounts under subsection (j)—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide3b72817-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/k/1\"><num value=\"1\">(1)</num><content> to States or units of local government to defray the costs incurred by laboratories operated by each such State or unit of local government in preparing for accreditation or reaccreditation;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide3b74f28-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/k/2\"><num value=\"2\">(2)</num><chapeau> in the form of additional grants to States, units of local government, or nonprofit professional organizations of persons actively involved in forensic science and nationally recognized within the forensic science community—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide3b74f29-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/k/2/A\"><num value=\"A\">(A)</num><content> to defray the costs of external audits of laboratories operated by such State or unit of local government, which participates in the National DNA Index System, to determine whether the laboratory is in compliance with quality assurance standards;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide3b74f2a-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/k/2/B\"><num value=\"B\">(B)</num><content> to assess compliance with any plans submitted to the National Institute of Justice, which detail the use of funds received by States or units of local government under this Act; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide3b74f2b-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/k/2/C\"><num value=\"C\">(C)</num><content> to support future capacity building efforts; and</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide3b74f2c-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/k/3\"><num value=\"3\">(3)</num><content> in the form of additional grants to nonprofit professional associations actively involved in forensic science and nationally recognized within the forensic science community to defray the costs of training persons who conduct external audits of laboratories operated by States and units of local government and which participate in the National DNA Index System.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ide3b74f2d-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/l\"><num value=\"l\" class=\"bold\">(l)</num><heading class=\"bold\"> Use of funds for other forensic sciences</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Attorney General may award a grant under this section to a State or unit of local government to alleviate a backlog of cases with respect to a forensic science other than DNA analysis if the State or unit of local government—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide3b7763e-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/l/1\"><num value=\"1\">(1)</num><chapeau> certifies to the Attorney General that in such State or unit—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide3b7763f-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/l/1/A\"><num value=\"A\">(A)</num><content> all of the purposes set forth in subsection (a) have been met;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide3b77640-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/l/1/B\"><num value=\"B\">(B)</num><content> a significant backlog of casework is not waiting for DNA analysis; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide3b77641-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/l/1/C\"><num value=\"C\">(C)</num><content> there is no need for significant laboratory equipment, supplies, or additional personnel for timely DNA processing of casework or offender samples; and</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide3b77642-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/l/2\"><num value=\"2\">(2)</num><content> demonstrates to the Attorney General that such State or unit requires assistance in alleviating a backlog of cases involving a forensic science other than DNA analysis.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ide3b77643-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/m\"><num value=\"m\" class=\"bold\">(m)</num><heading class=\"bold\"> External audits and remedial efforts</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">In the event that a laboratory operated by a State or unit of local government which has received funds under this Act has undergone an external audit conducted to determine whether the laboratory is in compliance with standards established by the Director of the Federal Bureau of Investigation, and, as a result of such audit, identifies measures to remedy deficiencies with respect to the compliance by the laboratory with such standards, the State or unit of local government shall implement any such remediation as soon as practicable.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ide3b79d54-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n\"><num value=\"n\" class=\"bold\">(n)</num><heading class=\"bold\"> Use of funds for auditing sexual assault evidence backlogs</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ide3b79d55-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Eligibility</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Attorney General may award a grant under this section to a State or unit of local government for the purpose described in subsection (a)(7) only if the State or unit of local government—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide3b79d56-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/1/A\"><num value=\"A\">(A)</num><content> submits a plan for performing the audit of samples described in such subsection; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide3b79d57-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/1/B\"><num value=\"B\">(B)</num><content> includes in such plan a good-faith estimate of the number of such samples.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ide3b79d58-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Grant conditions</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">A State or unit of local government receiving a grant for the purpose described in subsection (a)(7)—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide3b79d59-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/2/A\"><num value=\"A\">(A)</num><content> may not enter into any contract or agreement with any non-governmental vendor laboratory to conduct an audit described in subsection (a)(7); and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide3b7c46a-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/2/B\"><num value=\"B\">(B)</num><chapeau> shall—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide3b7c46b-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/2/B/i\"><num value=\"i\">(i)</num><content> not later than 1 year after receiving the grant, complete the audit referred to in paragraph (1)(A) in accordance with the plan submitted under such paragraph;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide3b7c46c-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/2/B/ii\"><num value=\"ii\">(ii)</num><content> not later than 60 days after receiving possession of a sample of sexual assault evidence that was not in the possession of the State or unit of local government at the time of the initiation of an audit under paragraph (1)(A), subject to paragraph (4)(F), include in any required reports under clause (v), the information listed under paragraph (4)(B);</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide3b7c46d-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/2/B/iii\"><num value=\"iii\">(iii)</num><chapeau> for each sample of sexual assault evidence that is identified as awaiting testing as part of the audit referred to in paragraph (1)(A)—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ide3b7c46e-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/2/B/iii/I\"><num value=\"I\">(I)</num><content> assign a unique numeric or alphanumeric identifier to each sample of sexual assault evidence that is in the possession of the State or unit of local government and is awaiting testing; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ide3b7c46f-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/2/B/iii/II\"><num value=\"II\">(II)</num><content> identify the date or dates after which the State or unit of local government would be barred by any applicable statutes of limitations from prosecuting a perpetrator of the sexual assault to which the sample relates;</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide3b7c470-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/2/B/iv\"><num value=\"iv\">(iv)</num><chapeau> provide that—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ide3b7eb81-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/2/B/iv/I\"><num value=\"I\">(I)</num><content> the chief law enforcement officer of the State or unit of local government, respectively, is the individual responsible for the compliance of the State or unit of local government, respectively, with the reporting requirements described in clause (v); or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ide3b7eb82-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/2/B/iv/II\"><num value=\"II\">(II)</num><content> the designee of such officer may fulfill the responsibility described in subclause (I) so long as such designee is an employee of the State or unit of local government, respectively, and is not an employee of any governmental laboratory or non-governmental vendor laboratory; and</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide3b7eb83-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/2/B/v\"><num value=\"v\">(v)</num><content> comply with all grantee reporting requirements described in paragraph (4).</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ide3b7eb84-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Extension of initial deadline</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Attorney General may grant an extension of the deadline under paragraph (2)(B)(i) to a State or unit of local government that demonstrates that more time is required for compliance with such paragraph.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ide3b7eb85-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Sexual assault forensic evidence reports</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ide3b7eb86-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/4/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">For not less than 12 months after the completion of an initial count of sexual assault evidence that is awaiting testing during an audit referred to in paragraph (1)(A), a State or unit of local government that receives a grant award under subsection (a)(7) shall, not less than every 60 days, submit a report to the Department of Justice, on a form prescribed by the Attorney General, which shall contain the information required under subparagraph (B).</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ide3b7eb87-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/4/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Contents of reports</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">A report under this paragraph shall contain the following information:</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide3b7eb88-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/4/B/i\"><num value=\"i\">(i)</num><content> The name of the State or unit of local government filing the report.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide3b7eb89-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/4/B/ii\"><num value=\"ii\">(ii)</num><content> The period of dates covered by the report.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide3b7eb8a-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/4/B/iii\"><num value=\"iii\">(iii)</num><chapeau> The cumulative total number of samples of sexual assault evidence that, at the end of the reporting period—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ide3b7eb8b-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/4/B/iii/I\"><num value=\"I\">(I)</num><content> are in the possession of the State or unit of local government at the reporting period;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ide3b7eb8c-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/4/B/iii/II\"><num value=\"II\">(II)</num><content> are awaiting testing; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ide3b8129d-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/4/B/iii/III\"><num value=\"III\">(III)</num><content> the State or unit of local government has determined should undergo DNA or other appropriate forensic analyses.</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide3b8129e-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/4/B/iv\"><num value=\"iv\">(iv)</num><content> The cumulative total number of samples of sexual assault evidence in the possession of the State or unit of local government that, at the end of the reporting period, the State or unit of local government has determined should not undergo DNA or other appropriate forensic analyses, provided that the reporting form shall allow for the State or unit of local government, at its sole discretion, to explain the reasoning for this determination in some or all cases.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide3b8129f-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/4/B/v\"><num value=\"v\">(v)</num><content> The cumulative total number of samples of sexual assault evidence in a total under clause (iii) that have been submitted to a laboratory for DNA or other appropriate forensic analyses.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide3b812a0-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/4/B/vi\"><num value=\"vi\">(vi)</num><content> The cumulative total number of samples of sexual assault evidence identified by an audit referred to in paragraph (1)(A) or under paragraph (2)(B)(ii) for which DNA or other appropriate forensic analysis has been completed at the end of the reporting period.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide3b812a1-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/4/B/vii\"><num value=\"vii\">(vii)</num><content> The total number of samples of sexual assault evidence identified by the State or unit of local government under paragraph (2)(B)(ii), since the previous reporting period.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide3b812a2-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/4/B/viii\"><num value=\"viii\">(viii)</num><content> The cumulative total number of samples of sexual assault evidence described under clause (iii) for which the State or unit of local government will be barred within 12 months by any applicable statute of limitations from prosecuting a perpetrator of the sexual assault to which the sample relates.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ide3b812a3-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/4/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Publication of reports</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Not later than 7 days after the submission of a report under this paragraph by a State or unit of local government, the Attorney General shall, subject to subparagraph (D), publish and disseminate a facsimile of the full contents of such report on an appropriate internet website.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ide3b812a4-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/4/D\"><num value=\"D\" class=\"bold\">(D)</num><heading class=\"bold\"> Personally identifiable information</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The Attorney General shall ensure that any information published and disseminated as part of a report under this paragraph, which reports information under this subsection, does not include personally identifiable information or details about a sexual assault that might lead to the identification of the individuals involved.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ide3b839b5-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/4/E\"><num value=\"E\" class=\"bold\">(E)</num><heading class=\"bold\"> Optional reporting</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The Attorney General shall—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide3b839b6-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/4/E/i\"><num value=\"i\">(i)</num><content> at the discretion of a State or unit of local government required to file a report under subparagraph (A), allow such State or unit of local government, at their sole discretion, to submit such reports on a more frequent basis; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide3b839b7-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/4/E/ii\"><num value=\"ii\">(ii)</num><content> make available to all States and units of local government the reporting form created pursuant to subparagraph (A), whether or not they are required to submit such reports, and allow such States or units of local government, at their sole discretion, to submit such reports for publication.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ide3b839b8-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/4/F\"><num value=\"F\" class=\"bold\">(F)</num><heading class=\"bold\"> Samples exempt from reporting requirement</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The reporting requirements described in paragraph (2) shall not apply to a sample of sexual assault evidence that—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide3b839b9-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/4/F/i\"><num value=\"i\">(i)</num><content> is not considered criminal evidence (such as a sample collected anonymously from a victim who is unwilling to make a criminal complaint); or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide3b839ba-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/4/F/ii\"><num value=\"ii\">(ii)</num><content> relates to a sexual assault for which the prosecution of each perpetrator is barred by a statute of limitations.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ide3b839bb-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Definitions</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">In this subsection:</chapeau><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ide3b839bc-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/5/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Awaiting testing</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The term “awaiting testing” means, with respect to a sample of sexual assault evidence, that—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide3b839bd-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/5/A/i\"><num value=\"i\">(i)</num><content> the sample has been collected and is in the possession of a State or unit of local government;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide3b839be-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/5/A/ii\"><num value=\"ii\">(ii)</num><content> DNA and other appropriate forensic analyses have not been performed on such sample; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide3b839bf-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/5/A/iii\"><num value=\"iii\">(iii)</num><content> the sample is related to a criminal case or investigation in which final disposition has not yet been reached.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ide3b839c0-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/5/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Final disposition</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The term “final disposition” means, with respect to a criminal case or investigation to which a sample of sexual assault evidence relates—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide3b839c1-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/5/B/i\"><num value=\"i\">(i)</num><content> the conviction or acquittal of all suspected perpetrators of the crime involved;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide3b860d2-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/5/B/ii\"><num value=\"ii\">(ii)</num><content> a determination by the State or unit of local government in possession of the sample that the case is unfounded; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide3b860d3-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/5/B/iii\"><num value=\"iii\">(iii)</num><content> a declaration by the victim of the crime involved that the act constituting the basis of the crime was not committed.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ide3b860d4-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/5/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Possession</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ide3b860d5-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/5/C/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">The term “possession”, used with respect to possession of a sample of sexual assault evidence by a State or unit of local government, includes possession by an individual who is acting as an agent of the State or unit of local government for the collection of the sample.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ide3b860d6-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/n/5/C/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Rule of construction</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">Nothing in clause (i) shall be construed to create or amend any Federal rights or privileges for non-governmental vendor laboratories described in regulations promulgated under <ref href=\"/us/usc/t34/s12591\">section 12591 of this title</ref>.</p>\n</content>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ide3b860d7-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/o\"><num value=\"o\" class=\"bold\">(o)</num><heading class=\"bold\"> Establishment of protocols, technical assistance, and definitions</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ide3b860d8-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/o/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Protocols and practices</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Not later than 18 months after <date date=\"2013-03-07\">March 7, 2013</date>, the Director, in consultation with Federal, State, and local law enforcement agencies and government laboratories, shall develop and publish a description of protocols and practices the Director considers appropriate for the accurate, timely, and effective collection and processing of DNA evidence, including protocols and practices specific to sexual assault cases, which shall address appropriate steps in the investigation of cases that might involve DNA evidence, including—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide3b860d9-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/o/1/A\"><num value=\"A\">(A)</num><chapeau> how to determine—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide3b860da-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/o/1/A/i\"><num value=\"i\">(i)</num><content> which evidence is to be collected by law enforcement personnel and forwarded for testing;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide3b860db-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/o/1/A/ii\"><num value=\"ii\">(ii)</num><content> the preferred order in which evidence from the same case is to be tested; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide3b860dc-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/o/1/A/iii\"><num value=\"iii\">(iii)</num><content> what information to take into account when establishing the order in which evidence from different cases is to be tested;</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide3b860dd-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/o/1/B\"><num value=\"B\">(B)</num><content> the establishment of a reasonable period of time in which evidence is to be forwarded by emergency response providers, law enforcement personnel, and prosecutors to a laboratory for testing;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide3b887ee-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/o/1/C\"><num value=\"C\">(C)</num><content> the establishment of reasonable periods of time in which each stage of analytical laboratory testing is to be completed;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide3b887ef-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/o/1/D\"><num value=\"D\">(D)</num><content> systems to encourage communication within a State or unit of local government among emergency response providers, law enforcement personnel, prosecutors, courts, defense counsel, crime laboratory personnel, and crime victims regarding the status of crime scene evidence to be tested; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide3b887f0-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/o/1/E\"><num value=\"E\">(E)</num><content> standards for conducting the audit of the backlog for DNA case work in sexual assault cases required under subsection (n).</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ide3b887f1-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/o/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Technical assistance and training</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Director shall make available technical assistance and training to support States and units of local government in adopting and implementing the protocols and practices developed under paragraph (1) on and after the date on which the protocols and practices are published.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ide3b887f2-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s40701/o/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Definitions</heading><content><p The Inspector General shall determine the appropriate number of grantees to be audited each year.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Mandatory exclusion</inline>.—</heading><content>A recipient of grant funds under this title that is found to have an unresolved audit finding shall not be eligible to receive grant funds under this title during the 2 fiscal years beginning after the 12-month period described in paragraph (5).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><heading> <inline class=\"small-caps\">Priority</inline>.—</heading><content>In awarding grants under this title, the Attorney General shall give priority to eligible entities that, during the 3 fiscal years before submitting an application for a grant under this title, did not have an unresolved audit finding showing a violation in the terms or conditions of a Department of Justice grant program.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><heading> <inline class=\"small-caps\">Reimbursement</inline>.—</heading><chapeau>If an entity is awarded grant funds under this Act [<ref href=\"/us/pl/113/4\">Pub. L. 113–4</ref>, see Tables for classification] during the 2-fiscal-year period in which the entity is barred from receiving grants under paragraph (2), the Attorney General shall—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> deposit an amount equal to the grant funds that were improperly awarded to the grantee into the General Fund of the Treasury; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> seek to recoup the costs of the repayment to the fund from the grant recipient that was erroneously awarded grant funds.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"5\">“(5)</num><heading> <inline class=\"small-caps\">Defined term</inline>.—</heading><content>In this section, the term ‘unresolved audit finding’ means an audit report finding in the final audit report of the Inspector General of the Department of Justice that the grantee has utilized grant funds for an unauthorized expenditure or otherwise unallowable cost that is not closed or resolved within a 12-month period beginning on the date when the final audit report is issued.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"6\">“(6)</num><heading> <inline class=\"small-caps\">Nonprofit organization requirements.—</inline></heading><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><heading> <inline class=\"small-caps\">Definition</inline>.—</heading><content>For purposes of this section and the grant programs described in this title, the term ‘nonprofit organization’ means an organization that is described in section 501(c)(3) of the Internal Revenue Code of 1986 [<ref href=\"/us/usc/t26/s501/c/3\">26 U.S.C. 501(c)(3)</ref>] and is exempt from taxation under section 501(a) of such Code.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><heading> <inline class=\"small-caps\">Prohibition</inline>.—</heading><content>The Attorney General shall not award a grant under any grant program described in this title to a nonprofit organization that holds money in offshore accounts for the purpose of avoiding paying the tax described in section 511(a) of the Internal Revenue Code of 1986 [<ref href=\"/us/usc/t26/s511/a\">26 U.S.C. 511(a)</ref>].</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><heading> <inline class=\"small-caps\">Disclosure</inline>.—</heading><content>Each nonprofit organization that is awarded a grant under a grant program described in this title and uses the procedures prescribed in regulations to create a rebuttable presumption of reasonableness for the compensation of its officers, directors, trustees and key employees, shall disclose to the Attorney General, in the application for the grant, the process for determining such compensation, including the independent persons involved in reviewing and approving such compensation, the comparability data used, and contemporaneous substantiation of the deliberation and decision. Upon request, the Attorney General shall make the information disclosed under this subsection available for public inspection.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"7\">“(7)</num><heading> <inline class=\"small-caps\">Administrative expenses</inline>.—</heading><content>Unless otherwise explicitly provided in authorizing legislation, not more than 7.5 percent of the amounts authorized to be appropriated under this title may be used by the Attorney General for salaries and administrative expenses of the Department of Justice.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"8\">“(8)</num><heading> <inline class=\"small-caps\">Conference expenditures.—</inline></heading><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><heading> <inline class=\"small-caps\">Limitation</inline>.—</heading><content>No amounts authorized to be appropriated to the Department of Justice under this title may be used by the Attorney General or by any individual or organization awarded discretionary funds through a cooperative agreement under this Act, to host or support any expenditure for conferences that uses more than $20,000 in Department funds, unless the Deputy Attorney General or the appropriate Assistant Attorney General, Director, or principal deputy as the Deputy Attorney General may designate, provides prior written authorization that the funds may be expended to host a conference.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><heading> <inline class=\"small-caps\">Written approval</inline>.—</heading><content>Written approval under subparagraph (A) shall include a written estimate of all costs associated with the conference, including the cost of all food and beverages, audio/visual equipment, honoraria for speakers, and any entertainment.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><heading> <inline class=\"small-caps\">Report</inline>.—</heading><content>The Deputy Attorney General shall submit an annual report to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives on all conference expenditures approved by operation of this paragraph.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"9\">“(9)</num><heading> <inline class=\"small-caps\">Prohibition on lobbying activity.—</inline></heading><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><chapeau>Amounts authorized to be appropriated under this title may not be utilized by any grant recipient to—</chapeau><clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"i\">“(i)</num><content> lobby any representative of the Department of Justice regarding the award of grant funding; or</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"ii\">“(ii)</num><content> lobby any representative of a Federal, state, local, or tribal government regarding the award of grant funding.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><heading> <inline class=\"small-caps\">Penalty</inline>.—</heading><chapeau>If the Attorney General determines that any recipient of a grant under this title has violated subparagraph (A), the Attorney General shall—</chapeau><clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"i\">“(i)</num><content> require the grant recipient to repay the grant in full; and</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"ii\">“(ii)</num><content> prohibit the grant recipient from receiving another grant under this title for not less than 5 years.”</content>\n</clause>\n</subparagraph>\n</paragraph>\n</quotedContent>\n</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"ide3b9c07c-4aa6-11eb-b55f-d70c2cfce33a\"><heading class=\"centered smallCaps\">Sense of Congress Regarding the Obligation of Grantee States to Ensure Access to Post-Conviction DNA Testing and Competent Counsel in Capital Cases</heading><p><ref href=\"/us/pl/106/561/s4\">Pub. L. 106–561, § 4</ref>, <date date=\"2000-12-21\">Dec. 21, 2000</date>, <ref href=\"/us/stat/114/2791\">114 Stat. 2791</ref>, provided that:<quotedContent origin=\"/us/pl/106/561/s4\">\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">Findings</inline>.—</heading><chapeau>Congress finds that—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> over the past decade, deoxyribonucleic acid testing (referred to in this section as ‘DNA testing’) has emerged as the most reliable forensic technique for identifying criminals when biological material is left at a crime scene;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> because of its scientific precision, DNA testing can, in some cases, conclusively establish the guilt or innocence of a criminal defendant;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> in other cases, DNA testing may not conclusively establish guilt or innocence, but may have significant probative value to a finder of fact;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><content> DNA testing was not widely available in cases tried prior to 1994;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"5\">“(5)</num><content> new forensic DNA testing procedures have made it possible to get results from minute samples that could not previously be tested, and to obtain more informative and accurate results than earlier forms of forensic DNA testing could produce, resulting in some cases of convicted inmates being exonerated by new DNA tests after earlier tests had failed to produce definitive results;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"6\">“(6)</num><content> DNA testing can and has resulted in the post-conviction exoneration of more than 75 innocent men and women, including some under sentence of death;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"7\">“(7)</num><content> in more than a dozen cases, post-conviction DNA testing that has exonerated an innocent person has also enhanced public safety by providing evidence that led to the apprehension of the actual perpetrator;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"8\">“(8)</num><content> experience has shown that it is not unduly burdensome to make DNA testing available to inmates in appropriate cases;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"9\">“(9)</num><content> under current Federal and State law, it is difficult to obtain post-conviction DNA testing because of time limits on introducing newly discovered evidence;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"10\">“(10)</num><content> the National Commission on the Future of DNA Evidence, a Federal panel established by the Department of Justice and comprised of law enforcement, judicial, and scientific experts, has urged that post-conviction DNA testing be permitted in the relatively small number of cases in which it is appropriate, notwithstanding procedural rules that could be invoked to preclude such testing, and notwithstanding the inability of an inmate to pay for the testing;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"11\">“(11)</num><content> only a few States have adopted post-conviction DNA testing procedures;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"12\">“(12)</num><content> States have received millions of dollars in DNA-related grants, and more funding is needed to improve State forensic facilities and to reduce the nationwide backlog of DNA samples from convicted offenders and crime scenes that need to be tested or retested using upgraded methods;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"13\">“(13)</num><content> States that accept such financial assistance should not deny the promise of truth and justice for both sides of our adversarial system that DNA testing offers;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"14\">“(14)</num><content> post-conviction DNA testing and other post-conviction investigative techniques have shown that innocent people have been sentenced to death in this country;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"15\">“(15)</num><content> a constitutional error in capital cases is incompetent defense lawyers who fail to present important evidence that the defendant may have been innocent or does not deserve to be sentenced to death; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"16\">“(16)</num><content> providing quality representation to defendants facing loss of liberty or life is essential to fundamental due process and the speedy final resolution of judicial proceedings.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Sense of Congress</inline>.—</heading><chapeau>It is the sense of Congress that—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> Congress should condition forensic science-related grants to a State or State forensic facility on the State’s agreement to ensure post-conviction DNA testing in appropriate cases; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> Congress should work with the States to improve the quality of legal representation in capital cases through the establishment of standards that will assure the timely appointment of competent counsel with adequate resources to represent defendants in capital cases at each stage of the proceedings.”</content>\n</paragraph>\n</subsection>\n</quotedContent>\n</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\"><ref href=\"/us/pl/106/546/s11\">Pub.
