value=\"40703\">§ 40703.</num><heading> Collection and use of DNA identification information from certain District of Columbia offenders</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26f61153-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40703/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Collection of DNA samples</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26f61154-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40703/a/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> From individuals in custody</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Director of the Bureau of Prisons shall collect a DNA sample from each individual in the custody of the Bureau of Prisons who is, or has been, convicted of a qualifying District of Columbia offense (as determined under subsection (d)).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26f61155-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40703/a/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> From individuals on release, parole, or probation</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Director of the Court Services and Offender Supervision Agency for the District of Columbia shall collect a DNA sample from each individual under the supervision of the Agency who is on supervised release, parole, or probation who is, or has been, convicted of a qualifying District of Columbia offense (as determined under subsection (d)).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26f61156-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40703/a/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Individuals already in CODIS</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">For each individual described in paragraph (1) or (2), if the Combined DNA Index System (in this section referred to as “CODIS”) of the Federal Bureau of Investigation contains a DNA analysis with respect to that individual, the Director of the Bureau of Prisons or Agency (as applicable) may (but need not) collect a DNA sample from that individual.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26f61157-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40703/a/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Collection procedures</heading><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26f61158-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40703/a/4/A\"><num value=\"A\">(A)</num><content> The Director of the Bureau of Prisons or Agency (as applicable) may use or authorize the use of such means as are reasonably necessary to detain, restrain, and collect a DNA sample from an individual who refuses to cooperate in the collection of the sample.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26f63869-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40703/a/4/B\"><num value=\"B\">(B)</num><content> The Director of the Bureau of Prisons or Agency, as appropriate, may enter into agreements with units of State or local government or with private entities to provide for the collection of the samples described in paragraph (1) or (2).</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26f6386a-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40703/a/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Criminal penalty</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">An individual from whom the collection of a DNA sample is authorized under this subsection who fails to cooperate in the collection of that sample shall be—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26f6386b-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40703/a/5/A\"><num value=\"A\">(A)</num><content> guilty of a class A misdemeanor; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26f6386c-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40703/a/5/B\"><num value=\"B\">(B)</num><content> punished in accordance with title 18.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26f6386d-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40703/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Analysis and use of samples</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Director of the Bureau of Prisons or Agency (as applicable) shall furnish each DNA sample collected under subsection (a) to the Director of the Federal Bureau of Investigation, who shall carry out a DNA analysis on each such DNA sample and include the results in CODIS. The Director of the Federal Bureau of Investigation may waive the requirements under this subsection if DNA samples are analyzed by means of Rapid DNA instruments and the results are included in CODIS.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26f6386e-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40703/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Definitions</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In this section:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26f6386f-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40703/c/1\"><num value=\"1\">(1)</num><content> The term “DNA sample” means a tissue, fluid, or other bodily sample of an individual on which a DNA analysis can be carried out.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26f63870-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40703/c/2\"><num value=\"2\">(2)</num><content> The term “DNA analysis” means analysis of the deoxyribonucleic acid (DNA) identification information in a bodily sample.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26f63871-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40703/c/3\"><num value=\"3\">(3)</num><content> The term “Rapid DNA instruments” means instrumentation that carries out a fully automated process to derive a DNA analysis from a DNA sample.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26f63872-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40703/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Qualifying District of Columbia offenses</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The government of the District of Columbia may determine those offenses under the District of Columbia Code that shall be treated for purposes of this section as qualifying District of Columbia offenses.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26f63873-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40703/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Commencement of collection</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Collection of DNA samples under subsection (a) shall, subject to the availability of appropriations, commence not later than the date that is 180 days after <date date=\"2000-12-19\">December 19, 2000</date>.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26f63874-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40703/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Authorization of appropriations</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">There are authorized to be appropriated to the Court Services and Offender Supervision Agency for the District of Columbia to carry out this section such sums as may be necessary for each of fiscal years 2001 through 2005.</p>\n</content>\n</subsection>\n<sourceCredit id=\"id26f65f85-0f21-11eb-9212-a1a9175aa019\">(<ref href=\"/us/pl/106/546/s4\">Pub.
