Not less than 3 percent, and no more than 10 percent of each grant under this paragraph shall be used to maintain the relief from disabilities program in accordance with <ref href=\"/us/usc/t34/s40915\">section 40915 of this title</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26fc0518-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40913/a/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Grants to Indian tribes</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Up to 5 percent of the grant funding available under this section may be reserved for Indian tribal governments, including tribal judicial systems.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26fc0519-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40913/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Use of grant amounts</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Grants awarded to States or Indian tribes under this section may only be used to—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26fc051a-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40913/b/1\"><num value=\"1\">(1)</num><content> create electronic systems, which provide accurate and up-to-date information which is directly related to checks under the National Instant Criminal Background Check System (referred to in this section as “NICS”), including court disposition and corrections records;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26fc051b-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40913/b/2\"><num value=\"2\">(2)</num><content> assist States in establishing or enhancing their own capacities to perform NICS background checks;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26fc051c-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40913/b/3\"><num value=\"3\">(3)</num><content> supply accurate and timely information to the Attorney General concerning final dispositions of criminal records to databases accessed by NICS, including through increased efforts to pre-validate the contents of those records to expedite eligibility determinations;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26fc051d-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40913/b/4\"><num value=\"4\">(4)</num><content> supply accurate and timely information to the Attorney General concerning the identity of persons who are prohibited from obtaining a firearm under <ref href=\"/us/usc/t18/s922/g/4\">section 922(g)(4) of title 18</ref> to be used by the Federal Bureau of Investigation solely to conduct NICS background checks;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26fc2c2e-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40913/b/5\"><num value=\"5\">(5)</num><content> supply accurate and timely court orders and records of misdemeanor crimes of domestic violence for inclusion in Federal and State law enforcement databases used to conduct NICS background checks;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26fc2c2f-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40913/b/6\"><num value=\"6\">(6)</num><content> collect and analyze data needed to demonstrate levels of State compliance with this chapter; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26fc2c30-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40913/b/7\"><num value=\"7\">(7)</num><content> maintain the relief from disabilities program in accordance with <ref href=\"/us/usc/t34/s40915\">section 40915 of this title</ref>, but not less than 3 percent, and no more than 10 percent of each grant shall be used for this purpose.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26fc2c31-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40913/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Eligibility</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">To be eligible for a grant under this section, a State shall certify, to the satisfaction of the Attorney General, that the State has implemented a relief from disabilities program in accordance with <ref href=\"/us/usc/t34/s40915\">section 40915 of this title</ref>.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26fc2c32-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40913/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Condition</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">As a condition of receiving a grant under this section, a State shall specify the projects for which grant amounts will be used, and shall use such amounts only as specified. A State that violates this subsection shall be liable to the Attorney General for the full amount of the grant received under this section.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26fc2c33-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40913/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Authorization of appropriations</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26fc2c34-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40913/e/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">There are authorized to be appropriated to carry out this section $125,000,000 for fiscal year 2009, $250,000,000 for fiscal year 2010, $250,000,000 for fiscal year 2011, $125,000,000 for fiscal year 2012, $125,000,000 for fiscal year 2013, and $125,000,000 for each of fiscal years 2018 through 2022.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26fc2c35-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40913/e/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Domestic Abuse and Violence Prevention Initiative</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id26fc2c36-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40913/e/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Establishment</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">For each of fiscal years 2018 through 2022, the Attorney General shall create a priority area under the NICS Act Record Improvement Program (commonly known as “NARIP”) for a Domestic Abuse and Violence Prevention Initiative that emphasizes the need for grantees to identify and upload all felony conviction records and domestic violence records.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id26fc2c37-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40913/e/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Funding</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The Attorney General—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26fc2c38-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40913/e/2/B/i\"><num value=\"i\">(i)</num><content> may use not more than 50 percent of the amounts made available under this subsection for each of fiscal years 2018 through 2022 to carry out the initiative described in subparagraph (A); and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26fc2c39-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40913/e/2/B/ii\"><num value=\"ii\">(ii)</num><chapeau> shall give a funding preference under NARIP to States that—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id26fc2c3a-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40913/e/2/B/ii/I\"><num value=\"I\">(I)</num><content> have established an implementation plan under <ref href=\"/us/usc/t34/s40917\">section 40917 of this title</ref>; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id26fc534b-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40913/e/2/B/ii/II\"><num value=\"II\">(II)</num><content> will use amounts made available under this subparagraph to improve efforts to identify and upload all felony conviction records and domestic violence records described in clauses (i), (v), and (vi) of <ref href=\"/us/usc/t34/s40912/b/1/C\">section 40912(b)(1)(C) of this title</ref> by not later than <date date=\"2022-09-30\">September 30, 2022</date>.</content>\n</subclause>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26fc534c-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40913/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> User fee</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Federal Bureau of Investigation shall not charge a user fee for background checks pursuant to <ref href=\"/us/usc/t18/s922/t\">section 922(t) of title 18</ref>.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26fc534d-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40913/g\"><num value=\"g\" class=\"bold\">(g)</num><heading class=\"bold\"> Technical assistance</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Attorney General shall direct the Office of Justice Programs, the Bureau of Alcohol, Tobacco, Firearms, and Explosives, and the Federal Bureau of Investigation to—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26fc534e-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40913/g/1\"><num value=\"1\">(1)</num><content> assist States that are not currently eligible for grants under this section to achieve compliance with all eligibility requirements; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26fc534f-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40913/g/2\"><num value=\"2\">(2)</num><content> provide technical assistance and training services to grantees under this section.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id26fc5350-0f21-11eb-9212-a1a9175aa019\">(<ref href=\"/us/pl/110/180/tI/s103\">Pub.
