L. 110–180, title I, § 105, Jan. 8, 2008, 121 Stat. 2569.)","seq_in_title":650,"parent_identifier":"/us/usc/t34/stIV/ch409/schI","ancestors":[{"identifier":"/us/usc/t34","level":"title","num":"Title 34—","heading":"CRIME CONTROL AND LAW ENFORCEMENT","status":null,"is_section":false},{"identifier":"/us/usc/t34/stIV","level":"subtitle","num":"Subtitle IV—","heading":"Criminal Records and Information","status":null,"is_section":false},{"identifier":"/us/usc/t34/stIV/ch409","level":"chapter","num":"CHAPTER 409—","heading":"NATIONAL INSTANT CRIMINAL BACKGROUND CHECK SYSTEM","status":null,"is_section":false},{"identifier":"/us/usc/t34/stIV/ch409/schI","level":"subchapter","num":"SUBCHAPTER I—","heading":"TRANSMITTAL OF RECORDS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id26fc7a73-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40915\"><num value=\"40915\">§ 40915.</num><heading> Relief from disabilities program required as condition for participation in grant programs</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26fca184-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40915/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Program described</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">A relief from disabilities program is implemented by a State in accordance with this section if the program—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26fca185-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40915/a/1\"><num value=\"1\">(1)</num><content> permits a person who, pursuant to State law, has been adjudicated as described in subsection (g)(4) of <ref href=\"/us/usc/t18/s922\">section 922 of title 18</ref> or has been committed to a mental institution, to apply to the State for relief from the disabilities imposed by subsections (d)(4) and (g)(4) of such section by reason of the adjudication or commitment;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26fca186-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40915/a/2\"><num value=\"2\">(2)</num><content> provides that a State court, board, commission, or other lawful authority shall grant the relief, pursuant to State law and in accordance with the principles of due process, if the circumstances regarding the disabilities referred to in paragraph (1), and the person’s record and reputation, are such that the person will not be likely to act in a manner dangerous to public safety and that the granting of the relief would not be contrary to the public interest; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26fca187-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40915/a/3\"><num value=\"3\">(3)</num><content> permits a person whose application for the relief is denied to file a petition with the State court of appropriate jurisdiction for a de novo judicial review of the denial.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26fca188-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s40915/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Authority to provide relief from certain disabilities with respect to firearms</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">If, under a State relief from disabilities program implemented in accordance with this section, an application for relief referred to in subsection (a)(1) of this section is granted with respect to an adjudication or a commitment to a mental institution or based upon a removal of a record under <ref href=\"/us/usc/t34/s40912/c/1/B\">section 40912(c)(1)(B) of this title</ref>, the adjudication or commitment, as the case may be, is deemed not to have occurred for purposes of subsections (d)(4) and (g)(4) of <ref href=\"/us/usc/t18/s922\">section 922 of title 18</ref>.</p>\n</content>\n</subsection>\n<sourceCredit id=\"id26fca189-0f21-11eb-9212-a1a9175aa019\">(<ref href=\"/us/pl/110/180/tI/s105\">Pub.
