L. 101–647, title XXV, § 2546, Nov. 29, 1990, 104 Stat. 4885.)","seq_in_title":667,"parent_identifier":"/us/usc/t34/stIV/ch413","ancestors":[{"identifier":"/us/usc/t34","level":"title","num":"Title 34—","heading":"CRIME CONTROL AND LAW ENFORCEMENT","status":null,"is_section":false},{"identifier":"/us/usc/t34/stIV","level":"subtitle","num":"Subtitle IV—","heading":"Criminal Records and Information","status":null,"is_section":false},{"identifier":"/us/usc/t34/stIV/ch413","level":"chapter","num":"CHAPTER 413—","heading":"CRIME REPORTS AND STATISTICS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"ide3cf44c8-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s41306\"><num value=\"41306\">§ 41306.</num><heading> Report to Congress on banking law offenses</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ide3cf44c9-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s41306/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ide3cf44ca-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s41306/a/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Data collection</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Attorney General shall compile and collect data concerning—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide3cf44cb-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s41306/a/1/A\"><num value=\"A\">(A)</num><content> the nature and number of civil and criminal investigations, prosecutions, and related proceedings, and civil enforcement and recovery proceedings, in progress with respect to banking law offenses under sections 981, 1008, 1032, and 3322(d) of title 18 and <ref href=\"/us/usc/t12/s1833a\">section 1833a of title 12</ref> and conspiracies to commit any such offense, including inactive investigations of such offenses;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide3cf44cc-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s41306/a/1/B\"><num value=\"B\">(B)</num><chapeau> the number of—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide3cf44cd-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s41306/a/1/B/i\"><num value=\"i\">(i)</num><content> investigations, prosecutions, and related proceedings described in subparagraph (A) which are inactive as of the close of the reporting period but have not been closed or declined; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ide3cf44ce-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s41306/a/1/B/ii\"><num value=\"ii\">(ii)</num><content> unaddressed referrals which allege criminal misconduct involving offenses described in subparagraph (A),</content>\n</clause>\n\n<continuation style=\"-uslm-lc:I32\" class=\"indent2 firstIndent0\">and the reasons such matters are inactive and the referrals unaddressed;</continuation>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide3cf6bdf-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s41306/a/1/C\"><num value=\"C\">(C)</num><content> the nature and number of such matters closed, settled, or litigated to conclusion; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide3cf6be0-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s41306/a/1/D\"><num value=\"D\">(D)</num><content> the results achieved, including convictions and pretrial diversions, fines and penalties levied, restitution assessed and collected, and damages recovered, in such matters.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ide3cf6be1-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s41306/a/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Analysis and report</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Attorney General shall analyze and report to the Congress on the data described in paragraph (1) and its coordination and other related activities named in section 41501(c)(2) <ref class=\"footnoteRef\" idref=\"fn002215\">1</ref><note type=\"footnote\" id=\"fn002215\"><num>1</num> So in original. Probably should be “41501(c)(3)”.</note> of this title and shall provide such report on the data monthly through <date date=\"1991-12-31\">December 31, 1991</date>, and quarterly after such date.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ide3cfb902-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s41306/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Specifics of report</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The report required by subsection (a) shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide3cfb903-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s41306/b/1\"><num value=\"1\">(1)</num><content> categorize data as to various types of financial institutions and appropriate dollar loss categories;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide3cfb904-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s41306/b/2\"><num value=\"2\">(2)</num><content> disclose data for each Federal judicial district;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide3cfb905-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s41306/b/3\"><num value=\"3\">(3)</num><content> describe the activities of the Financial Institution Fraud Unit; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide3cfb906-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s41306/b/4\"><num value=\"4\">(4)</num><chapeau> list—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide3cfb907-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s41306/b/4/A\"><num value=\"A\">(A)</num><content> the number of institutions, categorized by failed and open institutions, in which evidence of significant fraud, unlawful activity, insider abuse or serious misconduct has been alleged or detected;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide3cfb908-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s41306/b/4/B\"><num value=\"B\">(B)</num><content> civil, criminal, and administrative enforcement actions, including those of the Federal financial institutions regulatory agencies, brought against offenders;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide3cfb909-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s41306/b/4/C\"><num value=\"C\">(C)</num><content> any settlements or judgments obtained against offenders;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide3cfb90a-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s41306/b/4/D\"><num value=\"D\">(D)</num><content> indictments, guilty pleas, or verdicts obtained against offenders; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide3cfb90b-4aa6-11eb-b55f-d70c2cfce33a\" identifier=\"/us/usc/t34/s41306/b/4/E\"><num value=\"E\">(E)</num><content> the resources allocated in pursuit of investigations, prosecutions, and sentencings (including indictments, guilty pleas, or verdicts obtained against offenders) and related proceedings.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<sourceCredit id=\"ide3cfe01c-4aa6-11eb-b55f-d70c2cfce33a\">(<ref href=\"/us/pl/101/647/tXXV/s2546\">Pub.
