<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ide3d0556a-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s41309"><num value="41309">§ 41309.</num><heading> Reporting on human trafficking</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ide3d0556b-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s41309/a"><num value="a" class="bold">(a)</num><heading class="bold"> Trafficking offense classification</heading><chapeau style="-uslm-lc:I11" class="indent0">The Director of the Federal Bureau of Investigation shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ide3d0556c-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s41309/a/1"><num value="1">(1)</num><content> classify the offense of human trafficking as a Part I crime in the Uniform Crime Reports;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ide3d0556d-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s41309/a/2"><num value="2">(2)</num><chapeau> to the extent feasible, establish subcategories for State sex crimes that involve—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ide3d0556e-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s41309/a/2/A"><num value="A">(A)</num><content> a person who is younger than 18 years of age;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ide3d0556f-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s41309/a/2/B"><num value="B">(B)</num><content> the use of force, fraud or coercion; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ide3d05570-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s41309/a/2/C"><num value="C">(C)</num><content> neither of the elements described in subparagraphs (A) and (B); and</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="ide3d05571-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s41309/a/3"><num value="3">(3)</num><content> classify the offense of human trafficking as a Group A offense for purpose of the National Incident-Based Reporting System.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ide3d05572-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s41309/b"><num value="b" class="bold">(b)</num><heading class="bold"> Additional information</heading><chapeau style="-uslm-lc:I11" class="indent0">The Director of the Federal Bureau of Investigation shall revise the Uniform Crime Reporting System <ref class="footnoteRef" idref="fn002217">1</ref><note type="footnote" id="fn002217"><num>1</num> So in original. Probably should be “Program”.</note> and the National Incident-Based Reporting System to distinguish between reports of—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ide3d05573-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s41309/b/1"><num value="1">(1)</num><chapeau> incidents of assisting or promoting prostitution, which shall include crimes committed by persons who—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ide3d07c84-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s41309/b/1/A"><num value="A">(A)</num><content> do not directly engage in commercial sex acts; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ide3d07c85-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s41309/b/1/B"><num value="B">(B)</num><content> direct, manage, or profit from such acts, such as State pimping and pandering crimes;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ide3d07c86-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s41309/b/2"><num value="2">(2)</num><content> incidents of purchasing prostitution, which shall include crimes committed by persons who purchase or attempt to purchase or trade anything of value for commercial sex acts;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ide3d07c87-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s41309/b/3"><num value="3">(3)</num><content> incidents of prostitution, which shall include crimes committed by persons providing or attempting to provide commercial sex acts;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ide3d07c88-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s41309/b/4"><num value="4">(4)</num><content> incidents of assisting or promoting prostitution, child labor that is a violation of law, or forced labor of an individual under the age of 18 as described in paragraph (1); and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ide3d07c89-4aa6-11eb-b55f-d70c2cfce33a" identifier="/us/usc/t34/s41309/b/5"><num value="5">(5)</num><content> incidents of purchasing or soliciting commercial sex acts, child labor that is a violation of law, or forced labor with an individual under the age of 18 as described in paragraph (2).</content>
