<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id2703cd32-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s50101"><num value="50101">§ 50101.</num><heading> Application for assistance</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2703f443-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s50101/a"><num value="a" class="bold">(a)</num><heading class="bold"> State as applicant</heading><content><p style="-uslm-lc:I11" class="indent0">In the event that a law enforcement emergency exists throughout a State or a part of a State, a State (on behalf of itself or another appropriate unit of government) may submit an application under this section for Federal law enforcement assistance.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2703f444-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s50101/b"><num value="b" class="bold">(b)</num><heading class="bold"> Execution of application; period for action of Attorney General on application</heading><content><p style="-uslm-lc:I11" class="indent0">An application for assistance under this section shall be submitted in writing by the chief executive officer of a State to the Attorney General, in a form prescribed by rules issued by the Attorney General. The Attorney General shall, after consultation with the Assistant Attorney General for the Office of Justice Programs and appropriate members of the Federal law enforcement community, approve or disapprove such application not later than 10 days after receiving such application.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2703f445-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s50101/c"><num value="c" class="bold">(c)</num><heading class="bold"> Criteria</heading><chapeau style="-uslm-lc:I11" class="indent0">Federal law enforcement assistance may be provided if such assistance is necessary to provide an adequate response to a law enforcement emergency. In determining whether to approve or disapprove an application for assistance under this section, the Attorney General shall consider—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id2703f446-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s50101/c/1"><num value="1">(1)</num><content> the nature and extent of such emergency throughout a State or in any part of a State,</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id2703f447-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s50101/c/2"><num value="2">(2)</num><content> the situation or extraordinary circumstances which produced such emergency,</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id2703f448-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s50101/c/3"><num value="3">(3)</num><content> the availability of State and local criminal justice resources to resolve the problem,</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id2703f449-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s50101/c/4"><num value="4">(4)</num><content> the cost associated with the increased Federal presence,</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id27041b5a-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s50101/c/5"><num value="5">(5)</num><content> the need to avoid unnecessary Federal involvement and intervention in matters primarily of State and local concern, and</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id27041b5b-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s50101/c/6"><num value="6">(6)</num><content> any assistance which the State or other appropriate unit of government has received, or could receive, under any provision of title I of the Omnibus Crime Control and Safe Streets Act of 1968 [<ref href="/us/usc/t34/s10101">34 U.S.C. 10101</ref> et seq.].</content>
