L. 110–298, § 2, July 31, 2008, 122 Stat. 2985.)","seq_in_title":693,"parent_identifier":"/us/usc/t34/stV/ch503","ancestors":[{"identifier":"/us/usc/t34","level":"title","num":"Title 34—","heading":"CRIME CONTROL AND LAW ENFORCEMENT","status":null,"is_section":false},{"identifier":"/us/usc/t34/stV","level":"subtitle","num":"Subtitle V—","heading":"Law Enforcement and Criminal Justice Personnel","status":null,"is_section":false},{"identifier":"/us/usc/t34/stV/ch503","level":"chapter","num":"CHAPTER 503—","heading":"LAW ENFORCEMENT CONGRESSIONAL BADGE OF BRAVERY","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id2705c96f-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s50301\"><num value=\"50301\">§ 50301.</num><heading> Definitions</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In this chapter:</chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2705c970-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s50301/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Federal agency head</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “Federal agency head” means the head of any executive, legislative, or judicial branch Government entity that employs Federal law enforcement officers.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2705c971-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s50301/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Federal Board</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “Federal Board” means the Federal Law Enforcement Congressional Badge of Bravery Board established under <ref href=\"/us/usc/t34/s50313/a\">section 50313(a) of this title</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2705c972-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s50301/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Federal Board members</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “Federal Board members” means the members of the Federal Board appointed under <ref href=\"/us/usc/t34/s50313/c\">section 50313(c) of this title</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2705c973-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s50301/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Federal Law Enforcement Badge</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “Federal Law Enforcement Badge” means the Federal Law Enforcement Congressional Badge of Bravery described in <ref href=\"/us/usc/t34/s50311\">section 50311 of this title</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2705c974-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s50301/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Federal law enforcement officer</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “Federal law enforcement officer”—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2705c975-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s50301/5/A\"><num value=\"A\">(A)</num><chapeau> means a Federal employee—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id2705c976-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s50301/5/A/i\"><num value=\"i\">(i)</num><content> who has statutory authority to make arrests or apprehensions;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id2705c977-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s50301/5/A/ii\"><num value=\"ii\">(ii)</num><content> who is authorized by the agency of the employee to carry firearms; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id2705c978-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s50301/5/A/iii\"><num value=\"iii\">(iii)</num><chapeau> whose duties are primarily—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id2705c979-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s50301/5/A/iii/I\"><num value=\"I\">(I)</num><content> engagement in or supervision of the prevention, detection, investigation, or prosecution of, or the incarceration of any person for, any violation of law; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id2705f08a-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s50301/5/A/iii/II\"><num value=\"II\">(II)</num><content> the protection of Federal, State, local, or foreign government officials against threats to personal safety; and</content>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2705f08b-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s50301/5/B\"><num value=\"B\">(B)</num><content> includes a law enforcement officer employed by the Amtrak Police Department or Federal Reserve.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2705f08c-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s50301/6\"><num value=\"6\" class=\"bold\">(6)</num><heading class=\"bold\"> Office</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “Office” means the Congressional Badge of Bravery Office established under <ref href=\"/us/usc/t34/s50331/a\">section 50331(a) of this title</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2705f08d-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s50301/7\"><num value=\"7\" class=\"bold\">(7)</num><heading class=\"bold\"> State and Local Board</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “State and Local Board” means the State and Local Law Enforcement Congressional Badge of Bravery Board established under <ref href=\"/us/usc/t34/s50323/a\">section 50323(a) of this title</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2705f08e-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s50301/8\"><num value=\"8\" class=\"bold\">(8)</num><heading class=\"bold\"> State and Local Board members</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “State and Local Board members” means the members of the State and Local Board appointed under <ref href=\"/us/usc/t34/s50323/c\">section 50323(c) of this title</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2705f08f-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s50301/9\"><num value=\"9\" class=\"bold\">(9)</num><heading class=\"bold\"> State and Local Law Enforcement Badge</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “State and Local Law Enforcement Badge” means the State and Local Law Enforcement Congressional Badge of Bravery described in <ref href=\"/us/usc/t34/s50321\">section 50321 of this title</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2705f090-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s50301/10\"><num value=\"10\" class=\"bold\">(10)</num><heading class=\"bold\"> State or local agency head</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “State or local agency head” means the head of any executive, legislative, or judicial branch entity of a State or local government that employs State or local law enforcement officers.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2705f091-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s50301/11\"><num value=\"11\" class=\"bold\">(11)</num><heading class=\"bold\"> State or local law enforcement officer</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “State or local law enforcement officer” means an employee of a State or local government—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2705f092-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s50301/11/A\"><num value=\"A\">(A)</num><content> who has statutory authority to make arrests or apprehensions;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2705f093-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s50301/11/B\"><num value=\"B\">(B)</num><content> who is authorized by the agency of the employee to carry firearms; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id270617a4-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s50301/11/C\"><num value=\"C\">(C)</num><chapeau> whose duties are primarily—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id270617a5-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s50301/11/C/i\"><num value=\"i\">(i)</num><content> engagement in or supervision of the prevention, detection, investigation, or prosecution of, or the incarceration of any person for, any violation of law;
