<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id270ef0d8-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s60303"><num value="60303">§ 60303.</num><heading> Applications</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id270ef0d9-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s60303/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I11" class="indent0">The Attorney General shall establish a process through which a State may apply for a grant under this chapter.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id270ef0da-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s60303/b"><num value="b" class="bold">(b)</num><heading class="bold"> Application</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id270ef0db-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s60303/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">A State desiring a grant under this chapter shall submit an application to the Attorney General at such time, in such manner, and containing such information as the Attorney General may reasonably require.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id270f17ec-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s60303/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Contents</heading><chapeau style="-uslm-lc:I12" class="indent1">Each application submitted under paragraph (1) shall contain—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id270f17ed-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s60303/b/2/A"><num value="A">(A)</num><content> a certification by an appropriate officer of the State that the State authorizes capital punishment under its laws and conducts, or will conduct, prosecutions in which capital punishment is sought;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id270f17ee-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s60303/b/2/B"><num value="B">(B)</num><content> a description of the communities to be served by the grant, including the nature of existing capital defender services and capital prosecution programs within such communities;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id270f17ef-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s60303/b/2/C"><num value="C">(C)</num><chapeau> a long-term statewide strategy and detailed implementation plan that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id270f17f0-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s60303/b/2/C/i"><num value="i">(i)</num><content> reflects consultation with the judiciary, the organized bar, and State and local prosecutor and defender organizations; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id270f17f1-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s60303/b/2/C/ii"><num value="ii">(ii)</num><content> establishes as a priority improvement in the quality of trial-level representation of indigents charged with capital crimes and trial-level prosecution of capital crimes;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id270f17f2-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s60303/b/2/D"><num value="D">(D)</num><content> in the case of a State that employs a statutory procedure described in <ref href="/us/usc/t34/s60301/e/1/C">section 60301(e)(1)(C) of this title</ref>, a certification by an appropriate officer of the State that the State is in substantial compliance with the requirements of the applicable State statute; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id270f17f3-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s60303/b/2/E"><num value="E">(E)</num><chapeau> assurances that Federal funds received under this chapter shall be—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id270f3f04-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s60303/b/2/E/i"><num value="i">(i)</num><content> used to supplement and not supplant non-Federal funds that would otherwise be available for activities funded under this chapter; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id270f3f05-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s60303/b/2/E/ii"><num value="ii">(ii)</num><content> allocated in accordance with <ref href="/us/usc/t34/s60306/b">section 60306(b) of this title</ref>.</content>
