and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id270f3f0c-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s60304/a/2\"><num value=\"2\">(2)</num><content> explains how each activity complies with the terms and conditions of the grant.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id270f3f0d-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s60304/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Capital representation improvement grants</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">With respect to the funds provided under <ref href=\"/us/usc/t34/s60301\">section 60301 of this title</ref>, a report under subsection (a) shall include—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id270f3f0e-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s60304/b/1\"><num value=\"1\">(1)</num><content> an accounting of all amounts expended;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id270f3f0f-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s60304/b/2\"><num value=\"2\">(2)</num><chapeau> an explanation of the means by which the State—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id270f3f10-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s60304/b/2/A\"><num value=\"A\">(A)</num><content> invests the responsibility for identifying and appointing qualified attorneys to represent indigents in capital cases in a program described in <ref href=\"/us/usc/t34/s60301/e/1/A\">section 60301(e)(1)(A) of this title</ref>, an entity described in <ref href=\"/us/usc/t34/s60301/e/1/B\">section 60301(e)(1)(B) of this title</ref>, or a selection committee or similar entity described in <ref href=\"/us/usc/t34/s60301/e/1/C\">section 60301(e)(1)(C) of this title</ref>; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id270f6621-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s60304/b/2/B\"><num value=\"B\">(B)</num><chapeau> requires such program, entity, or selection committee or similar entity, or other appropriate entity designated pursuant to the statutory procedure described in <ref href=\"/us/usc/t34/s60301/e/1/C\">section 60301(e)(1)(C) of this title</ref>, to—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id270f6622-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s60304/b/2/B/i\"><num value=\"i\">(i)</num><content> establish qualifications for attorneys who may be appointed to represent indigents in capital cases in accordance with <ref href=\"/us/usc/t34/s60301/e/2/A\">section 60301(e)(2)(A) of this title</ref>;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id270f6623-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s60304/b/2/B/ii\"><num value=\"ii\">(ii)</num><content> establish and maintain a roster of qualified attorneys in accordance with <ref href=\"/us/usc/t34/s60301/e/2/B\">section 60301(e)(2)(B) of this title</ref>;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id270f6624-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s60304/b/2/B/iii\"><num value=\"iii\">(iii)</num><content> assign attorneys from the roster in accordance with <ref href=\"/us/usc/t34/s60301/e/2/C\">section 60301(e)(2)(C) of this title</ref>;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id270f6625-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s60304/b/2/B/iv\"><num value=\"iv\">(iv)</num><content> conduct, sponsor, or approve specialized training programs for attorneys representing defendants in capital cases in accordance with <ref href=\"/us/usc/t34/s60301/e/2/D\">section 60301(e)(2)(D) of this title</ref>;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id270f6626-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s60304/b/2/B/v\"><num value=\"v\">(v)</num><content> monitor the performance and training program attendance of appointed attorneys, and remove from the roster attorneys who fail to deliver effective representation or fail to comply with such requirements as such program, entity, or selection committee or similar entity may establish regarding participation in training programs, in accordance with <ref href=\"/us/usc/t34/s60301/e/2/E\">section 60301(e)(2)(E) of this title</ref>; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id270f8d37-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s60304/b/2/B/vi\"><num value=\"vi\">(vi)</num><chapeau> ensure funding for the cost of competent legal representation by the defense team and outside experts selected by counsel, in accordance with <ref href=\"/us/usc/t34/s60301/e/2/F\">section 60301(e)(2)(F) of this title</ref>, including a statement setting forth—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id270f8d38-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s60304/b/2/B/vi/I\"><num value=\"I\">(I)</num><content> if the State employs a public defender program under <ref href=\"/us/usc/t34/s60301/e/1/A\">section 60301(e)(1)(A) of this title</ref>, the salaries received by the attorneys employed by such program and the salaries received by attorneys in the prosecutor’s office in the jurisdiction;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id270f8d39-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s60304/b/2/B/vi/II\"><num value=\"II\">(II)</num><content> if the State employs appointed attorneys under <ref href=\"/us/usc/t34/s60301/e/1/B\">section 60301(e)(1)(B) of this title</ref>, the hourly fees received by such attorneys for actual time and service and the basis on which the hourly rate was calculated;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id270f8d3a-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s60304/b/2/B/vi/III\"><num value=\"III\">(III)</num><content> the amounts paid to non-attorney members of the defense team, and the basis on which such amounts were determined; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id270f8d3b-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s60304/b/2/B/vi/IV\"><num value=\"IV\">(IV)</num><content> the amounts for which attorney and non-attorney members of the defense team were reimbursed for reasonable incidental expenses;</content>\n</subclause>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id270f8d3c-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s60304/b/3\"><num value=\"3\">(3)</num><content> in the case of a State that employs a statutory procedure described in <ref href=\"/us/usc/t34/s60301/e/1/C\">section 60301(e)(1)(C) of this title</ref>, an assessment of the extent to which the State is in compliance with the requirements of the applicable State statute; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id270fb44d-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s60304/b/4\"><num value=\"4\">(4)</num><content> a statement confirming that the funds have not been used to fund representation in specific capital cases or to supplant non-Federal funds.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id270fb44e-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s60304/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Capital prosecution improvement grants</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">With respect to the funds provided under <ref href=\"/us/usc/t34/s60302\">section 60302 of this title</ref>, a report under subsection (a) shall include—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id270fb44f-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s60304/c/1\"><num value=\"1\">(1)</num><content> an accounting of all amounts expended;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id270fb450-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s60304/c/2\"><num value=\"2\">(2)</num><chapeau> a description of the means by which the State has—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id270fb451-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s60304/c/2/A\"><num value=\"A\">(A)</num><content> designed and established training programs for State and local prosecutors to ensure effective representation in State capital cases in accordance with <ref href=\"/us/usc/t34/s60302/b/1/A\">section 60302(b)(1)(A) of this title</ref>;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id270fb452-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s60304/c/2/B\"><num value=\"B\">(B)</num><content> developed and implemented appropriate standards and qualifications for State and local prosecutors who litigate State capital cases in accordance with <ref href=\"/us/usc/t34/s60302/b/1/B\">section 60302(b)(1)(B) of this title</ref>;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id270fb453-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s60304/c/2/C\"><num value=\"C\">(C)</num><content> assessed the performance of State and local prosecutors who litigate State capital cases in accordance with <ref href=\"/us/usc/t34/s60302/b/1/C\">section 60302(b)(1)(C) of this title</ref>;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id270fb454-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s60304/c/2/D\"><num value=\"D\">(D)</num><content> identified and implemented any potential legal reforms that may be appropriate to minimize the potential for error in the trial of capital cases in accordance with <ref href=\"/us/usc/t34/s60302/b/1/D\">section 60302(b)(1)(D) of this title</ref>;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id270fdb65-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s60304/c/2/E\"><num value=\"E\">(E)</num><content> established a program under which State and local prosecutors conduct a systematic review of cases in which a death sentence was imposed in order to identify cases in which post-conviction DNA testing may be appropriate in accordance with <ref href=\"/us/usc/t34/s60302/b/1/E\">section 60302(b)(1)(E) of this title</ref>; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id270fdb66-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s60304/c/2/F\"><num value=\"F\">(F)</num><content> provided support and assistance to the families of murder victims; and</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id270fdb67-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s60304/c/3\"><num value=\"3\">(3)</num><content> a statement confirming that the funds have not been used to fund the prosecution of specific capital cases or to supplant non-Federal funds.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id270fdb68-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s60304/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Public disclosure of annual State reports</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The annual reports to the Attorney General submitted by any State under this section shall be made available to the public.</p>\n</content>\n</subsection>\n<sourceCredit id=\"id270fdb69-0f21-11eb-9212-a1a9175aa019\">(<ref href=\"/us/pl/108/405/tIV/s424\">Pub.
