<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id15988026-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s60502"><num value="60502">§ 60502.</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I11" class="indent0">In this Act—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id15988027-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s60502/1"><num value="1">(1)</num><chapeau> the term “exoneree” means an individual who—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id15988028-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s60502/1/A"><num value="A">(A)</num><content> has been convicted of a Federal, tribal, or State offense that is punishable by a term of imprisonment of more than 1 year;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id15988029-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s60502/1/B"><num value="B">(B)</num><content> has served a term of imprisonment for not less than 6 months in a Federal, tribal, or State prison or correctional facility as a result of the conviction described in subparagraph (A); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id1598802a-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s60502/1/C"><num value="C">(C)</num><content> has been determined to be factually innocent of the offense described in subparagraph (A);</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1598802b-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s60502/2"><num value="2">(2)</num><content> the term “Indian tribe” has the meaning given in <ref href="/us/usc/t34/s10251">section 10251 of this title</ref>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1598802c-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s60502/3"><num value="3">(3)</num><content> the term “offender” includes an exoneree; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1598802d-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s60502/4"><num value="4">(4)</num><chapeau> the term “Transitional Jobs strategy” means an employment strategy for youth and adults who are chronically unemployed or those that have barriers to employment that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id1598802e-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s60502/4/A"><num value="A">(A)</num><content> is conducted by State, tribal, and local governments, State, tribal, and local workforce boards, and nonprofit organizations;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id1598802f-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s60502/4/B"><num value="B">(B)</num><content> provides time-limited employment using individual placements, team placements, and social enterprise placements, without displacing existing employees;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id15988030-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s60502/4/C"><num value="C">(C)</num><content> pays wages in accordance with applicable law, but in no event less than the higher of the rate specified in <ref href="/us/usc/t29/s206/a/1">section 206(a)(1) of title 29</ref> or the applicable State or local minimum wage law, which are subsidized, in whole or in part, by public funds;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id15988031-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s60502/4/D"><num value="D">(D)</num><content> combines time-limited employment with activities that promote skill development, remove barriers to employment, and lead to unsubsidized employment such as a thorough orientation and individual assessment, job readiness and life skills training, case management and supportive services, adult education and training, child support-related services, job retention support and incentives, and other similar activities;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id15988032-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s60502/4/E"><num value="E">(E)</num><content> places participants into unsubsidized employment; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id15988033-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s60502/4/F"><num value="F">(F)</num><content> provides job retention, re-employment services, and continuing and vocational education to ensure continuing participation in unsubsidized employment and identification of opportunities for advancement.</content>
