and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0ed3af69-f33a-11ed-9bd1-c690c2d82fb9\" identifier=\"/us/usc/t35/s2/a/2\"><num value=\"2\">(2)</num><content> shall be responsible for disseminating to the public information with respect to patents and trademarks.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0ed3af6a-f33a-11ed-9bd1-c690c2d82fb9\" identifier=\"/us/usc/t35/s2/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Specific Powers</inline>.—</heading><chapeau>The Office—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0ed3af6b-f33a-11ed-9bd1-c690c2d82fb9\" identifier=\"/us/usc/t35/s2/b/1\"><num value=\"1\">(1)</num><content> shall adopt and use a seal of the Office, which shall be judicially noticed and with which letters patent, certificates of trademark registrations, and papers issued by the Office shall be authenticated;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0ed3af6c-f33a-11ed-9bd1-c690c2d82fb9\" identifier=\"/us/usc/t35/s2/b/2\"><num value=\"2\">(2)</num><chapeau> may establish regulations, not inconsistent with law, which—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0ed3af6d-f33a-11ed-9bd1-c690c2d82fb9\" identifier=\"/us/usc/t35/s2/b/2/A\"><num value=\"A\">(A)</num><content> shall govern the conduct of proceedings in the Office;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0ed3af6e-f33a-11ed-9bd1-c690c2d82fb9\" identifier=\"/us/usc/t35/s2/b/2/B\"><num value=\"B\">(B)</num><content> shall be made in accordance with <ref href=\"/us/usc/t5/s553\">section 553 of title 5</ref>;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0ed3af6f-f33a-11ed-9bd1-c690c2d82fb9\" identifier=\"/us/usc/t35/s2/b/2/C\"><num value=\"C\">(C)</num><content> shall facilitate and expedite the processing of patent applications, particularly those which can be filed, stored, processed, searched, and retrieved electronically, subject to the provisions of section 122 relating to the confidential status of applications;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0ed3af70-f33a-11ed-9bd1-c690c2d82fb9\" identifier=\"/us/usc/t35/s2/b/2/D\"><num value=\"D\">(D)</num><content> may govern the recognition and conduct of agents, attorneys, or other persons representing applicants or other parties before the Office, and may require them, before being recognized as representatives of applicants or other persons, to show that they are of good moral character and reputation and are possessed of the necessary qualifications to render to applicants or other persons valuable service, advice, and assistance in the presentation or prosecution of their applications or other business before the Office;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0ed3af71-f33a-11ed-9bd1-c690c2d82fb9\" identifier=\"/us/usc/t35/s2/b/2/E\"><num value=\"E\">(E)</num><content> shall recognize the public interest in continuing to safeguard broad access to the United States patent system through the reduced fee structure for small entities under section 41(h)(1);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0ed3af72-f33a-11ed-9bd1-c690c2d82fb9\" identifier=\"/us/usc/t35/s2/b/2/F\"><num value=\"F\">(F)</num><content> provide for the development of a performance-based process that includes quantitative and qualitative measures and standards for evaluating cost-effectiveness and is consistent with the principles of impartiality and competitiveness; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0ed5f963-f33a-11ed-9bd1-c690c2d82fb9\" identifier=\"/us/usc/t35/s2/b/2/G\"><num value=\"G\">(G)</num><content> may, subject to any conditions prescribed by the Director and at the request of the patent applicant, provide for prioritization of examination of applications for products, processes, or technologies that are important to the national economy or national competitiveness without recovering the aggregate extra cost of providing such prioritization, notwithstanding section 41 or any other provision of law;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0ed5f964-f33a-11ed-9bd1-c690c2d82fb9\" identifier=\"/us/usc/t35/s2/b/3\"><num value=\"3\">(3)</num><content> may acquire, construct, purchase, lease, hold, manage, operate, improve, alter, and renovate any real, personal, or mixed property, or any interest therein, as it considers necessary to carry out its functions;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0ed5f965-f33a-11ed-9bd1-c690c2d82fb9\" identifier=\"/us/usc/t35/s2/b/4\"><num value=\"4\">(4)</num><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0ed5f966-f33a-11ed-9bd1-c690c2d82fb9\" identifier=\"/us/usc/t35/s2/b/4/A\"><num value=\"A\">(A)</num><content> may make such purchases, contracts for the construction, maintenance, or management and operation of facilities, and contracts for supplies or services, without regard to the provisions of subtitle I and chapter 33 of title 40, division C (except sections 3302, 3501(b), 3509, 3906, 4710, and 4711) of subtitle I of title 41, and the McKinney-Vento Homeless Assistance Act (<ref href=\"/us/usc/t42/s11301\">42 U.S.C. 11301</ref> et seq.); and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0ed5f967-f33a-11ed-9bd1-c690c2d82fb9\" identifier=\"/us/usc/t35/s2/b/4/B\"><num value=\"B\">(B)</num><content> may enter into and perform such purchases and contracts for printing services, including the process of composition, platemaking, presswork, silk screen processes, binding, microform, and the products of such processes, as it considers necessary to carry out the functions of the Office, without regard to sections 501 through 517 and 1101 through 1123 of title 44;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0ed5f968-f33a-11ed-9bd1-c690c2d82fb9\" identifier=\"/us/usc/t35/s2/b/5\"><num value=\"5\">(5)</num><content> may use, with their consent, services, equipment, personnel, and facilities of other departments, agencies, and instrumentalities of the Federal Government, on a reimbursable basis, and cooperate with such other departments, agencies, and instrumentalities in the establishment and use of services, equipment, and facilities of the Office;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0ed5f969-f33a-11ed-9bd1-c690c2d82fb9\" identifier=\"/us/usc/t35/s2/b/6\"><num value=\"6\">(6)</num><content> may, when the Director determines that it is practicable, efficient, and cost-effective to do so, use, with the consent of the United States and the agency, instrumentality, Patent and Trademark Office, or international organization concerned, the services, records, facilities, or personnel of any State or local government agency or instrumentality or foreign patent and trademark office or international organization to perform functions on its behalf;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0ed5f96a-f33a-11ed-9bd1-c690c2d82fb9\" identifier=\"/us/usc/t35/s2/b/7\"><num value=\"7\">(7)</num><content> may retain and use all of its revenues and receipts, including revenues from the sale, lease, or disposal of any real, personal, or mixed property, or any interest therein, of the Office;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0ed5f96b-f33a-11ed-9bd1-c690c2d82fb9\" identifier=\"/us/usc/t35/s2/b/8\"><num value=\"8\">(8)</num><content> shall advise the President, through the Secretary of Commerce, on national and certain international intellectual property policy issues;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0ed5f96c-f33a-11ed-9bd1-c690c2d82fb9\" identifier=\"/us/usc/t35/s2/b/9\"><num value=\"9\">(9)</num><content> shall advise Federal departments and agencies on matters of intellectual property policy in the United States and intellectual property protection in other countries;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0ed5f96d-f33a-11ed-9bd1-c690c2d82fb9\" identifier=\"/us/usc/t35/s2/b/10\"><num value=\"10\">(10)</num><content> shall provide guidance, as appropriate, with respect to proposals by agencies to assist foreign governments and international intergovernmental organizations on matters of intellectual property protection;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0ed5f96e-f33a-11ed-9bd1-c690c2d82fb9\" identifier=\"/us/usc/t35/s2/b/11\"><num value=\"11\">(11)</num><content> may conduct programs, studies, or exchanges of items or services regarding domestic and international intellectual property law and the effectiveness of intellectual property protection domestically and throughout the world, and the Office is authorized to expend funds to cover the subsistence expenses and travel-related expenses, including per diem, lodging costs, and transportation costs, of persons attending such programs who are not Federal employees;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0ed5f96f-f33a-11ed-9bd1-c690c2d82fb9\" identifier=\"/us/usc/t35/s2/b/12\"><num value=\"12\">(12)</num><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0ed5f970-f33a-11ed-9bd1-c690c2d82fb9\" identifier=\"/us/usc/t35/s2/b/12/A\"><num value=\"A\">(A)</num><content> shall advise the Secretary of Commerce on programs and studies relating to intellectual property policy that are conducted, or authorized to be conducted, cooperatively with foreign intellectual property offices and international intergovernmental organizations; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0ed5f971-f33a-11ed-9bd1-c690c2d82fb9\" identifier=\"/us/usc/t35/s2/b/12/B\"><num value=\"B\">(B)</num><content> may conduct programs and studies described in subparagraph (A); and</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0ed5f972-f33a-11ed-9bd1-c690c2d82fb9\" identifier=\"/us/usc/t35/s2/b/13\"><num value=\"13\">(13)</num><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0ed5f973-f33a-11ed-9bd1-c690c2d82fb9\" identifier=\"/us/usc/t35/s2/b/13/A\"><num value=\"A\">(A)</num><content> in coordination with the Department of State, may conduct programs and studies cooperatively with foreign intellectual property offices and international intergovernmental organizations; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0ed5f974-f33a-11ed-9bd1-c690c2d82fb9\" identifier=\"/us/usc/t35/s2/b/13/B\"><num value=\"B\">(B)</num><content> with the concurrence of the Secretary of State, may authorize the transfer of not to exceed $100,000 in any year to the Department of State for the purpose of making special payments to international intergovernmental organizations for studies and programs for advancing international cooperation concerning patents, trademarks, and other matters.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0ed5f975-f33a-11ed-9bd1-c690c2d82fb9\" identifier=\"/us/usc/t35/s2/c\"><num value=\"c\">(c)</num><heading> <inline class=\"small-caps\">Clarification of Specific Powers</inline>.—</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0ed5f976-f33a-11ed-9bd1-c690c2d82fb9\" identifier=\"/us/usc/t35/s2/c/1\"><num value=\"1\">(1)</num><content> The special payments under subsection (b)(13)(B) shall be in addition to any other payments or contributions to international organizations described in subsection (b)(13)(B) and shall not be subject to any limitations imposed by law on the amounts of such other payments or contributions by the United States Government.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0ed5f977-f33a-11ed-9bd1-c690c2d82fb9\" identifier=\"/us/usc/t35/s2/c/2\"><num value=\"2\">(2)</num><content> Nothing in subsection (b) shall derogate from the duties of the Secretary of State or from the duties of the United States Trade Representative as set forth in section 141 of the Trade Act of 1974 (<ref href=\"/us/usc/t19/s2171\">19 U.S.C. 2171</ref>).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0ed5f978-f33a-11ed-9bd1-c690c2d82fb9\" identifier=\"/us/usc/t35/s2/c/3\"><num value=\"3\">(3)</num><content> Nothing in subsection (b) shall derogate from the duties and functions of the Register of Copyrights or otherwise alter current authorities relating to copyright matters.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0ed5f979-f33a-11ed-9bd1-c690c2d82fb9\" identifier=\"/us/usc/t35/s2/c/4\"><num value=\"4\">(4)</num><content> In exercising the Director’s powers under paragraphs (3) and (4)(A) of subsection (b), the Director shall consult with the Administrator of General Services.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0ed5f97a-f33a-11ed-9bd1-c690c2d82fb9\" identifier=\"/us/usc/t35/s2/c/5\"><num value=\"5\">(5)</num><content> In exercising the Director’s powers and duties under this section, the Director shall consult with the Register of Copyrights on all copyright and related matters.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id0ed5f97b-f33a-11ed-9bd1-c690c2d82fb9\" identifier=\"/us/usc/t35/s2/d\"><num value=\"d\">(d)</num><heading> <inline class=\"small-caps\">Construction</inline>.—</heading><content>Nothing in this section shall be construed to nullify, void, cancel, or interrupt any pending request-for-proposal let or contract issued by the General Services Administration for the specific purpose of relocating or leasing space to the United States Patent and Trademark Office.</content>\n</subsection>\n<sourceCredit id=\"id0ed5f97c-f33a-11ed-9bd1-c690c2d82fb9\">(<ref href=\"/us/act/1952-07-19/ch950\">July 19, 1952, ch. 950</ref>, <ref href=\"/us/stat/66/792\">66 Stat. 792</ref>; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> submit the results of the study required under subparagraph (A) to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Scope of the study</inline>.—</heading><chapeau>The study required under paragraph (1)(A) shall—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><chapeau> assess—</chapeau><clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"i\">“(i)</num><content> whether the patent pro bono programs, as in effect on the date on which the study is commenced, are sufficiently serving prospective and existing participants;</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"ii\">“(ii)</num><content> whether the patent pro bono programs are sufficiently funded to serve prospective participants;</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"iii\">“(iii)</num><content> whether any participation requirement of the patent pro bono programs, including any requirement to demonstrate knowledge of the patent system, serves as a deterrent for prospective participants;</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"iv\">“(iv)</num><content> the degree to which prospective inventors are aware of the patent pro bono programs;</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"v\">“(v)</num><content> what factors, if any, deter attorneys from participating in the patent pro bono programs;</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"vi\">“(vi)</num><content> whether the patent pro bono programs would be improved by expanding those programs to include non-attorney advocates; and</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"vii\">“(vii)</num><content> any other issue the Director determines appropriate; and</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> make recommendations for such administrative and legislative action as may be appropriate.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Use of Results</inline>.—</heading><content>Upon completion of the study required under subsection (a), the Director shall work with the Pro Bono Advisory Council, the operators of the patent pro bono programs, and intellectual property law associations across the United States to update the patent pro bono programs in response to the findings of the study.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Expansion of Income Eligibility.—</inline></heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>The Director shall work with and support, including by providing financial support to, existing patent pro bono programs and intellectual property law associations across the United States to expand eligibility for the patent pro bono programs to an individual living in a household, the gross household income of which is not more than 400 percent of the Federal poverty line.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Rule of construction</inline>.—</heading><content>Nothing in paragraph (1) may be construed to prevent a patent pro bono program from electing to establish a higher eligibility level, as compared to the level described in that paragraph.”</content>\n</paragraph>\n</subsection>\n</quotedContent>\n</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">[For definitions of terms used in <ref href=\"/us/pl/117/328/dW/s105\">section 105 of div. L. 116–136, div. B, title II, § 12004</ref>, <date date=\"2020-03-27\">Mar. 27, 2020</date>, <ref href=\"/us/stat/134/517\">134 Stat. 517</ref>, provided that:<quotedContent origin=\"/us/pl/116/136/dB/tII/s12004\">\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">In General</inline>.—</heading><chapeau>During the emergency period described in subsection (e), the Director may toll, waive, adjust, or modify, any timing deadline established by title 35, United States Code, the Trademark Act, section 18 of the Leahy-Smith America Invents Act [<ref href=\"/us/pl/112/29\">Pub. L. 112–29</ref>] (<ref href=\"/us/usc/t35/s321\">35 U.S.C. 321</ref> note), or regulations promulgated thereunder, in effect during such period, if the Director determines that the emergency related to such period—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> materially affects the functioning of the Patent and Trademark Office;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> prejudices the rights of applicants, registrants, patent owners, or others appearing before the Office; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> prevents applicants, registrants, patent owners, or others appearing before the Office from filing a document or fee with the Office.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Public Notice</inline>.—</heading><content>If the Director determines that tolling, waiving, adjusting, or modifying a timing deadline under subsection (a) is appropriate, the Director shall publish publicly a notice to such effect.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Statement Required</inline>.—</heading><content>Not later than 20 days after the Director tolls, waives, adjusts, or modifies a timing deadline under subsection (a) and such toll, waiver, adjustment, or modification is in effect for a consecutive or cumulative period exceeding 120 days, the Director shall submit to Congress a statement describing the action taken, relevant background, and rationale for the period of tolling, waiver, adjustment, or modification.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"d\">“(d)</num><heading> <inline class=\"small-caps\">Other Laws</inline>.—</heading><content>Notwithstanding section 301 of the National Emergencies Act (<ref href=\"/us/usc/t50/s1631\">50 U.S.C. 1631</ref>), the authority of the Director under subsection (a) is not contingent on a specification made by the President under such section or any other requirement under that Act [<ref href=\"/us/usc/t50/s1601\">50 U.S.C. 1601</ref> et seq.] (other than the emergency declaration under section 201(a) of such Act (<ref href=\"/us/usc/t50/s1621/a\">50 U.S.C. 1621(a)</ref>)). The authority described in this section supersedes the authority of title II of the National Emergencies Act (<ref href=\"/us/usc/t50/s1621\">50 U.S.C. 1621</ref> et seq.).</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"e\">“(e)</num><heading> <inline class=\"small-caps\">Emergency Period</inline>.—</heading><content>The emergency period described in this subsection includes the duration of the portion of the emergency declared by the President pursuant to the National Emergencies Act on <date date=\"2020-03-13\">March 13, 2020</date>, as a result of the COVID–19 outbreak (and any renewal thereof) beginning on or after the date of the enactment of this section [<date date=\"2020-03-27\">Mar. 27, 2020</date>] and the 60 day period following such duration.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"f\">“(f)</num><heading> <inline class=\"small-caps\">Rule of Construction</inline>.—</heading><content>Nothing in this section may be construed as limiting other statutory authorities the Director may have to grant relief regarding filings or deadlines.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"g\">“(g)</num><heading> <inline class=\"small-caps\">Sunset</inline>.—</heading><content>Notwithstanding subsection (a), the authorities provided under this section shall expire upon the expiration of the 2-year period after the date of the enactment of this section.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"h\">“(h)</num><heading> <inline class=\"small-caps\">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">Director</inline>.—</heading><content>The term ‘Director’ means the Under Secretary of Commerce for Intellectual Property and Director of the United States Patent and Trademark Office.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Trademark act</inline>.—</heading><content>The term ‘Trademark Act’ means the Act entitled ‘An Act to provide for the registration and protection of trademarks used in commerce, to carry out the provisions of certain international conventions, and for other purposes’, approved <date date=\"1946-07-05\">July 5, 1946</date> (<ref href=\"/us/usc/t15/s1051\">15 U.S.C. 1051</ref> et seq.).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"i\">“(i)</num><heading> <inline class=\"small-caps\">Emergency Requirement</inline>.—</heading><content>The amount provided by this section is designated by the Congress as being for an emergency requirement pursuant to section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985 [<ref href=\"/us/usc/t2/s901/b/2/A/i\">2 U.S.C. 901(b)(2)(A)(i)</ref>].”</content>\n</subsection>\n</quotedContent>\n</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"id0ed5f989-f33a-11ed-9bd1-c690c2d82fb9\"><heading class=\"centered smallCaps\">USPTO Law School Clinic Certification Program</heading><p><ref href=\"/us/pl/113/227/s1\">Pub. L. 113–227, § 1</ref>, <date date=\"2014-12-16\">Dec. 16, 2014</date>, <ref href=\"/us/stat/128/2114\">128 Stat. 2114</ref>, provided that:<quotedContent origin=\"/us/pl/113/227/s1\">\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">Establishment</inline>.—</heading><content>The Law School Clinic Certification Program of the United States Patent and Trademark Office, as implemented by the Office, is established as a program entitled the ‘Law School Clinic Certification Program’. The Program shall allow students enrolled in a participating law school’s clinic to practice patent and trademark law before the Office by drafting, filing, and prosecuting patent or trademark applications, or both, on a pro-bono basis for clients that qualify for assistance from the law school’s clinic. The Director shall establish regulations and procedures for application to and participation in the Program. All law schools accredited by the American Bar Association are eligible for participation in the Program, and shall be examined for acceptance using identical criteria established by the Director. The Program shall be in effect for the 10-year period beginning on the date of the enactment of this Act [<date date=\"2014-12-16\">Dec. 16, 2014</date>].</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Report on the Program</inline>.—</heading><content>The Director shall, not later than the last day of the 2-year period beginning on the date of the enactment of this Act, submit to the Committees on the Judiciary of the House of Representatives and the Senate a report on the Program, describing the number of law schools and law students participating in the Program, the work done through the Program, the benefits of the Program, and any recommendations of the Director for modifications to the Program.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">Office</inline>.—</heading><content>The term ‘Office’ means the United States Patent and Trademark Office.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Program</inline>.—</heading><content>The term ‘Program’ means the Law School Clinic Certification Program established in subsection (a).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><heading> <inline class=\"small-caps\">Director</inline>.—</heading><content>The term ‘Director’ means the Under Secretary of Commerce for Intellectual Property and Director of the United States Patent and Trademark Office.”</content>\n</paragraph>\n</subsection>\n</quotedContent>\n</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"id0ed5f98a-f33a-11ed-9bd1-c690c2d82fb9\"><heading class=\"centered smallCaps\">Patent Ombudsman Program for Small Business Concerns</heading><p><ref href=\"/us/pl/112/29/s28\">Pub. L. 107–273, div. C, title III, § 13103</ref>, <date date=\"2002-11-02\">Nov. 2, 2002</date>, <ref href=\"/us/stat/116/1899\">116 Stat. 1899</ref>, provided that:<quotedContent origin=\"/us/pl/107/273/dC/tIII/s13103\">\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">Electronic Filing and Processing</inline>.—</heading><chapeau>The Director [of the Patent and Trademark Office] shall, beginning not later than 90 days after the date of enactment of this Act [<date date=\"2002-11-02\">Nov. 2, 2002</date>], and during the 3-year period thereafter, develop an electronic system for the filing and processing of patent and trademark applications, that—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> is user friendly; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><chapeau> includes the necessary infrastructure—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> to allow examiners and applicants to send all communications electronically; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> to allow the Office to process, maintain, and search electronically the contents and history of each application.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Authorization of Appropriations</inline>.—</heading><content>Of amounts authorized under section 13102 [set out as a note under <ref href=\"/us/usc/t35/s42\">section 42 of this title</ref>], there is authorized to be appropriated to carry out subsection (a) of this section not more than $50,000,000 for each of fiscal years 2003, 2004, and 2005.
