<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id9f536920-9cee-11e3-9d75-b809dddfb88d" identifier="/us/usc/t37/s352"><num value="352">§ 352.</num><heading> Assignment pay or special duty pay</heading><subsection style="-uslm-lc:I11" class="indent0" id="id9f536921-9cee-11e3-9d75-b809dddfb88d" identifier="/us/usc/t37/s352/a"><num value="a">(a)</num><heading> <inline class="small-caps">Assignment or Special Duty Pay Authorized</inline>.—</heading><chapeau>The Secretary concerned may pay assignment or special duty pay under this section to a member of a regular or reserve component of the uniformed services who—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id9f536922-9cee-11e3-9d75-b809dddfb88d" identifier="/us/usc/t37/s352/a/1"><num value="1">(1)</num><content> is entitled to basic pay under <ref href="/us/usc/t37/s204">section 204 of this title</ref> or compensation under <ref href="/us/usc/t37/s206">section 206 of this title</ref>; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id9f536923-9cee-11e3-9d75-b809dddfb88d" identifier="/us/usc/t37/s352/a/2"><num value="2">(2)</num><content> performs duties in an assignment, location, or unit designated by, and under the conditions of service specified by, the Secretary concerned.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id9f539034-9cee-11e3-9d75-b809dddfb88d" identifier="/us/usc/t37/s352/b"><num value="b">(b)</num><heading> Maximum Amount and Method of Payment.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id9f539035-9cee-11e3-9d75-b809dddfb88d" identifier="/us/usc/t37/s352/b/1"><num value="1">(1)</num><heading> <inline class="small-caps">Lump sum or installments</inline>.—</heading><content>Assignment or special duty pay under subsection (a) may be paid monthly, in a lump sum, or in periodic installments other than monthly, as determined by the Secretary concerned. If paid monthly, the Secretary concerned may prorate the monthly amount of the assignment or special duty pay for a member who does not satisfy the eligibility requirement for an entire month to reflect the duration of the member’s actual qualifying service during the month.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id9f539036-9cee-11e3-9d75-b809dddfb88d" identifier="/us/usc/t37/s352/b/2"><num value="2">(2)</num><heading> <inline class="small-caps">Maximum monthly amount</inline>.—</heading><content>The maximum monthly amount of assignment or special duty pay may not exceed $5,000.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id9f539037-9cee-11e3-9d75-b809dddfb88d" identifier="/us/usc/t37/s352/b/3"><num value="3">(3)</num><heading> <inline class="small-caps">Maximum lump sum amount</inline>.—</heading><chapeau>The amount of a lump sum payment of assignment or special duty pay payable to a member may not exceed the amount equal to the product of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id9f539038-9cee-11e3-9d75-b809dddfb88d" identifier="/us/usc/t37/s352/b/3/A"><num value="A">(A)</num><content> the maximum monthly rate authorized under paragraph (2) at the time the member enters into a written agreement under subsection (c); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id9f539039-9cee-11e3-9d75-b809dddfb88d" identifier="/us/usc/t37/s352/b/3/B"><num value="B">(B)</num><content> the number of continuous months in the period for which assignment or special duty pay will be paid pursuant to the agreement.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id9f53903a-9cee-11e3-9d75-b809dddfb88d" identifier="/us/usc/t37/s352/b/4"><num value="4">(4)</num><heading> <inline class="small-caps">Maximum installment amount</inline>.—</heading><chapeau>The amount of each installment payment of assignment or special duty pay payable to a member on an installment basis may not exceed the amount equal to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id9f53b74b-9cee-11e3-9d75-b809dddfb88d" identifier="/us/usc/t37/s352/b/4/A"><num value="A">(A)</num><chapeau> the product of—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id9f53b74c-9cee-11e3-9d75-b809dddfb88d" identifier="/us/usc/t37/s352/b/4/A/i"><num value="i">(i)</num><content> a monthly rate specified in the written agreement entered into under subsection (c), which monthly rate may not exceed the maximum monthly rate authorized under paragraph (2) at the time the member enters into the agreement; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id9f53b74d-9cee-11e3-9d75-b809dddfb88d" identifier="/us/usc/t37/s352/b/4/A/ii"><num value="ii">(ii)</num><content> the number of continuous months in the period for which the assignment or special duty pay will be paid; divided by</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id9f53b74e-9cee-11e3-9d75-b809dddfb88d" identifier="/us/usc/t37/s352/b/4/B"><num value="B">(B)</num><content> the number of installments over such period.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id9f53b74f-9cee-11e3-9d75-b809dddfb88d" identifier="/us/usc/t37/s352/b/5"><num value="5">(5)</num><heading> <inline class="small-caps">Effect of extension</inline>.—</heading><content>If a member extends an assignment or performance of duty specified in an agreement with the Secretary concerned under subsection (c), assignment or special duty pay for the period of the extension may be paid on a monthly basis, in a lump sum, or in installments, consistent with this subsection.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id9f53b750-9cee-11e3-9d75-b809dddfb88d" identifier="/us/usc/t37/s352/c"><num value="c">(c)</num><heading> Written Agreement.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id9f53b751-9cee-11e3-9d75-b809dddfb88d" identifier="/us/usc/t37/s352/c/1"><num value="1">(1)</num><heading> <inline class="small-caps">Discretionary for monthly payments</inline>.—</heading><content>The Secretary concerned may require a member to enter into a written agreement with the Secretary in order to qualify for the payment of assignment or special duty pay on a monthly basis. The written agreement shall specify the period for which the assignment or special duty pay will be paid to the member and the monthly rate of the assignment or special duty pay.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id9f540572-9cee-11e3-9d75-b809dddfb88d" identifier="/us/usc/t37/s352/c/2"><num value="2">(2)</num><heading> <inline class="small-caps">Required for lump sum or installment payments</inline>.—</heading><content>The Secretary concerned shall require a member to enter into a written agreement with the Secretary in order to qualify for payment of assignment or special duty pay on a lump sum or installment basis. The written agreement shall specify the period for which the assignment or special duty pay will be paid to the member and the amount of the lump sum or each periodic installment.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id9f540573-9cee-11e3-9d75-b809dddfb88d" identifier="/us/usc/t37/s352/d"><num value="d">(d)</num><heading> <inline class="small-caps">Reserve Component Members Performing Inactive Duty Training</inline>.—</heading><content>A member of a reserve component entitled to compensation under <ref href="/us/usc/t37/s206">section 206 of this title</ref> who is authorized assignment or special duty pay under this section may be paid an amount of assignment or special duty pay that is proportionate to the compensation received by the member under <ref href="/us/usc/t37/s206">section 206 of this title</ref> for inactive-duty training.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id9f540574-9cee-11e3-9d75-b809dddfb88d" identifier="/us/usc/t37/s352/e"><num value="e">(e)</num><heading> <inline class="small-caps">Relationship to Other Pay and Allowances</inline>.—</heading><content>Assignment or special duty pay paid to a member under this section is in addition to any other pay and allowances to which the member is entitled.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id9f540575-9cee-11e3-9d75-b809dddfb88d" identifier="/us/usc/t37/s352/f"><num value="f">(f)</num><heading> <inline class="small-caps">Repayment</inline>.—</heading><content>A member who receives assignment or special duty pay under this section and who fails to fulfill the eligibility requirements under subsection (a) for receipt of such pay shall be subject to the repayment provisions of <ref href="/us/usc/t37/s373">section 373 of this title</ref>.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id9f540576-9cee-11e3-9d75-b809dddfb88d" identifier="/us/usc/t37/s352/g"><num value="g">(g)</num><heading> <inline class="small-caps">Termination of Authority</inline>.—</heading><content>No agreement may be entered into under this section after <date date="2014-12-31">December 31, 2014</date>.</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Reporting Requirements</inline>.—</heading><chapeau>The Secretary shall submit to Congress an annual report on the use of the authority provided under subsection (a) during the preceding year, including—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> the number of members of the Armed Forces receiving assignment pay or special duty pay under <ref href="/us/usc/t37/s352">section 352 of title 37</ref>, United States Code, in excess of the maximum amount otherwise authorized under such section; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> an assessment of the impact of the use of such authority on the effectiveness and efficiency in achieving the United States mission in Afghanistan.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Duration of Authority</inline>.—</heading><content>The authority provided by subsection (a) to offer additional assignment pay or special duty pay under <ref href="/us/usc/t37/s352">section 352 of title 37</ref>, United States Code, expires on <date date="2012-12-31">December 31, 2012</date>. The expiration of such authority shall not affect the terms or duration of any agreement entered into before that date to provide additional assignment pay or special duty pay under such section.”</content>
