<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id335b95d6-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701"><num value="1701">§ 1701.</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I11" class="indent0">For the purposes of this chapter—</chapeau><paragraph style="-uslm-lc:I11" class="indent0" id="id335b95d7-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/1"><num value="1">(1)</num><content> The term “disability” means a disease, injury, or other physical or mental defect.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id335b95d8-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/2"><num value="2">(2)</num><content> The term “veteran of any war” includes any veteran awarded the Medal of Honor.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id335ddfc9-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/3"><num value="3">(3)</num><chapeau> The term “facilities of the Department” means—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id335ddfca-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/3/A"><num value="A">(A)</num><content> facilities over which the Secretary has direct jurisdiction;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id335ddfcb-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/3/B"><num value="B">(B)</num><content> Government facilities for which the Secretary contracts; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id335ddfcc-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/3/C"><num value="C">(C)</num><content> public or private facilities at which the Secretary provides recreational activities for patients receiving care under <ref href="/us/usc/t38/s1710">section 1710 of this title</ref>.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id335ddfcd-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/4"><num value="4">(4)</num><content> The term “non-Department facilities” means facilities other than Department facilities.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id335ddfce-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/5"><num value="5">(5)</num><chapeau> The term “hospital care” includes—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id335ddfcf-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/5/A"><num value="A">(A)</num><clause style="-uslm-lc:I12" class="indent1" id="id335ddfd0-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/5/A/i"><num value="i">(i)</num><content> medical services rendered in the course of the hospitalization of any veteran, and (ii) travel and incidental expenses pursuant to the provisions of <ref href="/us/usc/t38/s111">section 111 of this title</ref>;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id335ddfd1-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/5/B"><num value="B">(B)</num><content> such mental health services, consultation, professional counseling, marriage and family counseling, and training for the members of the immediate family or legal guardian of a veteran, or the individual in whose household such veteran certifies an intention to live, as the Secretary considers appropriate for the effective treatment and rehabilitation of a veteran or dependent or survivor of a veteran receiving care under the last sentence of <ref href="/us/usc/t38/s1781/b">section 1781(b) of this title</ref>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id335ddfd2-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/5/C"><num value="C">(C)</num><clause style="-uslm-lc:I12" class="indent1" id="id335ddfd3-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/5/C/i"><num value="i">(i)</num><content> medical services rendered in the course of the hospitalization of a dependent or survivor of a veteran receiving care under the last sentence of <ref href="/us/usc/t38/s1781/b">section 1781(b) of this title</ref>, and (ii) travel and incidental expenses for such dependent or survivor under the terms and conditions set forth in <ref href="/us/usc/t38/s111">section 111 of this title</ref>.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id335ddfd4-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/6"><num value="6">(6)</num><chapeau> The term “medical services” includes, in addition to medical examination, treatment, and rehabilitative services, the following:</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id335ddfd5-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/6/A"><num value="A">(A)</num><content> Surgical services.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id335ddfd6-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/6/B"><num value="B">(B)</num><content> Dental services and appliances as described in sections 1710 and 1712 of this title.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id335ddfd7-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/6/C"><num value="C">(C)</num><content> Optometric and podiatric services.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id335ddfd8-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/6/D"><num value="D">(D)</num><content> Preventive health services.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id335ddfd9-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/6/E"><num value="E">(E)</num><content> Noninstitutional extended care services, including alternatives to institutional extended care that the Secretary may furnish directly, by contract, or through provision of case management by another provider or payer.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id335ddfda-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/6/F"><num value="F">(F)</num><chapeau> In the case of a person otherwise receiving care or services under this chapter—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="id335ddfdb-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/6/F/i"><num value="i">(i)</num><content> wheelchairs, artificial limbs, trusses, and similar appliances;</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id335ddfdc-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/6/F/ii"><num value="ii">(ii)</num><content> special clothing made necessary by the wearing of prosthetic appliances; and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id335ddfdd-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/6/F/iii"><num value="iii">(iii)</num><content> such other supplies or services as the Secretary determines to be reasonable and necessary.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id335ddfde-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/6/G"><num value="G">(G)</num><content> Travel and incidental expenses pursuant to <ref href="/us/usc/t38/s111">section 111 of this title</ref>.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id335ddfdf-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/7"><num value="7">(7)</num><content> The term “domiciliary care” includes necessary medical services and travel and incidental expenses pursuant to the provisions of <ref href="/us/usc/t38/s111">section 111 of this title</ref>.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id335ddfe0-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/8"><num value="8">(8)</num><content> The term “rehabilitative services” means such professional, counseling, and guidance services and treatment programs as are necessary to restore, to the maximum extent possible, the physical, mental, and psychological functioning of an ill or disabled person.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id335ddfe1-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/9"><num value="9">(9)</num><chapeau> The term “preventive health services” means—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id335ddfe2-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/9/A"><num value="A">(A)</num><content> periodic medical and dental examinations;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id335ddfe3-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/9/B"><num value="B">(B)</num><content> patient health education (including nutrition education);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id335ddfe4-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/9/C"><num value="C">(C)</num><content> maintenance of drug use profiles, patient drug monitoring, and drug utilization education;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id335ddfe5-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/9/D"><num value="D">(D)</num><content> mental health preventive services;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id335ddfe6-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/9/E"><num value="E">(E)</num><content> substance abuse prevention measures;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id335ddfe7-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/9/F"><num value="F">(F)</num><content> immunizations against infectious disease;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id335ddfe8-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/9/G"><num value="G">(G)</num><content> prevention of musculoskeletal deformity or other gradually developing disabilities of a metabolic or degenerative nature;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id335ddfe9-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/9/H"><num value="H">(H)</num><content> genetic counseling concerning inheritance of genetically determined diseases;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id335ddfea-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/9/I"><num value="I">(I)</num><content> routine vision testing and eye care services;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id335ddfeb-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/9/J"><num value="J">(J)</num><content> periodic reexamination of members of likely target populations (high-risk groups) for selected diseases and for functional decline of sensory organs, together with attendant appropriate remedial intervention; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id335ddfec-3271-11e3-b273-de5e065aa472" identifier="/us/usc/t38/s1701/9/K"><num value="K">(K)</num><content> such other health-care services as the Secretary may determine to be necessary to provide effective and economical preventive health care.</content>
