<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id54900fa1-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1722"><num value="1722">§ 1722.</num><heading> Determination of inability to defray necessary expenses; income thresholds</heading><subsection style="-uslm-lc:I11" class="indent0" id="id54900fa2-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1722/a"><num value="a">(a)</num><chapeau> For the purposes of <ref href="/us/usc/t38/s1710/a/2/G">section 1710(a)(2)(G) of this title</ref>, a veteran shall be considered to be unable to defray the expenses of necessary care if—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id54900fa3-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1722/a/1"><num value="1">(1)</num><content> the veteran is eligible to receive medical assistance under a State plan approved under title XIX of the Social Security Act (<ref href="/us/usc/t42/s1396">42 U.S.C. 1396</ref> et seq.);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id54900fa4-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1722/a/2"><num value="2">(2)</num><content> the veteran is in receipt of pension under <ref href="/us/usc/t38/s1521">section 1521 of this title</ref>; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id54900fa5-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1722/a/3"><num value="3">(3)</num><content> the veteran’s attributable income is not greater than the amount set forth in subsection (b).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id54900fa6-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1722/b"><num value="b">(b)</num><paragraph style="-uslm-lc:I11" class="indent0" id="id54900fa7-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1722/b/1"><num value="1">(1)</num><chapeau> For purposes of subsection (a)(3), the income threshold for the calendar year beginning on <date date="1990-01-01">January 1, 1990</date>, is—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id54900fa8-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1722/b/1/A"><num value="A">(A)</num><content> $17,240 in the case of a veteran with no dependents; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id54900fa9-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1722/b/1/B"><num value="B">(B)</num><content> $20,688 in the case of a veteran with one dependent, plus $1,150 for each additional dependent.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id54900faa-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1722/b/2"><num value="2">(2)</num><content> For a calendar year beginning after <date date="1990-12-31">December 31, 1990</date>, the amounts in effect for purposes of this subsection shall be the amounts in effect for the preceding calendar year as adjusted under subsection (c) of this section.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id54900fab-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1722/c"><num value="c">(c)</num><content> Effective on January 1 of each year, the amounts in effect under subsection (b) of this section shall be increased by the percentage by which the maximum rates of pension were increased under <ref href="/us/usc/t38/s5312/a">section 5312(a) of this title</ref> during the preceding calendar year.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id54900fac-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1722/d"><num value="d">(d)</num><paragraph style="-uslm-lc:I11" class="indent0" id="id54900fad-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1722/d/1"><num value="1">(1)</num><content> Notwithstanding the attributable income of a veteran, the Secretary may refuse to make a determination described in paragraph (2) of this subsection if the corpus of the estate of the veteran is such that under all the circumstances it is reasonable that some part of the corpus of the estate of the veteran be consumed for the veteran’s maintenance.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id54900fae-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1722/d/2"><num value="2">(2)</num><content> A determination described in this paragraph is a determination that for purposes of subsection (a)(3) of this section a veteran’s attributable income is not greater than the amount determined under subsection (b) of this section.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id54900faf-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1722/d/3"><num value="3">(3)</num><content> For the purposes of paragraph (1) of this subsection, the corpus of the estate of a veteran shall be determined in the same manner as the manner in which determinations are made of the corpus of the estates of persons under <ref href="/us/usc/t38/s1522">section 1522 of this title</ref>.</content>

</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id54900fb0-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1722/e"><num value="e">(e)</num><paragraph style="-uslm-lc:I11" class="indent0" id="id54900fb1-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1722/e/1"><num value="1">(1)</num><content> In order to avoid a hardship to a veteran described in paragraph (2) of this subsection, the Secretary may deem the veteran to have an attributable income during the previous year not greater than the amount determined under subsection (b) of this section.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id54900fb2-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1722/e/2"><num value="2">(2)</num><chapeau> A veteran is described in this paragraph for the purposes of subsection (a) of this section if—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id54900fb3-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1722/e/2/A"><num value="A">(A)</num><content> the veteran has an attributable income greater than the amount determined under subsection (b) of this section; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id54900fb4-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1722/e/2/B"><num value="B">(B)</num><content> the current projections of such veteran’s income for the current year are that the veteran’s income for such year will be substantially below the amount determined under subsection (b).</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id54900fb5-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1722/f"><num value="f">(f)</num><chapeau> For purposes of this section:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id54900fb6-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1722/f/1"><num value="1">(1)</num><content> The term “attributable income” means the income of a veteran for the most recent year for which information is available determined in the same manner as the manner in which a determination is made of the total amount of income by which the rate of pension for such veteran under <ref href="/us/usc/t38/s1521">section 1521 of this title</ref> would be reduced if such veteran were eligible for pension under that section.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id54900fb7-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1722/f/2"><num value="2">(2)</num><content> The term “corpus of the estate of the veteran” includes the corpus of the estates of the veteran’s spouse and dependent children, if any.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id54900fb8-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1722/f/3"><num value="3">(3)</num><content> The term “previous year” means the calendar year preceding the year in which the veteran applies for care or services under <ref href="/us/usc/t38/s1710/a">section 1710(a) of this title</ref>.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id54900fb9-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1722/g"><num value="g">(g)</num><chapeau> For the purposes of <ref href="/us/usc/t38/s1724/c">section 1724(c) of this title</ref>, the fact that a veteran is—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id54900fba-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1722/g/1"><num value="1">(1)</num><content> eligible to receive medical assistance under a State plan approved under title XIX of the Social Security Act (<ref href="/us/usc/t42/s1396">42 U.S.C. 1396</ref> et seq.);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id54900fbb-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1722/g/2"><num value="2">(2)</num><content> a veteran with a service-connected disability; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id54900fbc-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1722/g/3"><num value="3">(3)</num><content> in receipt of pension under any law administered by the Secretary,</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">shall be accepted as sufficient evidence of such veteran’s inability to defray necessary expenses.</continuation>
