<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id54925929-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1728"><num value="1728">§ 1728.</num><heading> Reimbursement of certain medical expenses</heading><subsection style="-uslm-lc:I11" class="indent0" id="id5492592a-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1728/a"><num value="a">(a)</num><chapeau> The Secretary shall, under such regulations as the Secretary prescribes, reimburse veterans eligible for hospital care or medical services under this chapter for the customary and usual charges of emergency treatment (including travel and incidental expenses under the terms and conditions set forth in <ref href="/us/usc/t38/s111">section 111 of this title</ref>) for which such veterans have made payment, from sources other than the Department, where such emergency treatment was rendered to such veterans in need thereof for any of the following:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id5492592b-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1728/a/1"><num value="1">(1)</num><content> An adjudicated service-connected disability.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id5492592c-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1728/a/2"><num value="2">(2)</num><content> A non-service-connected disability associated with and held to be aggravating a service-connected disability.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id5492592d-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1728/a/3"><num value="3">(3)</num><content> Any disability of a veteran if the veteran has a total disability permanent in nature from a service-connected disability.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id5492592e-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1728/a/4"><num value="4">(4)</num><chapeau> Any illness, injury, or dental condition of a veteran who—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id5492592f-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1728/a/4/A"><num value="A">(A)</num><content> is a participant in a vocational rehabilitation program (as defined in <ref href="/us/usc/t38/s3101/9">section 3101(9) of this title</ref>); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id54925930-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1728/a/4/B"><num value="B">(B)</num><content> is medically determined to have been in need of care or treatment to make possible the veteran’s entrance into a course of training, or prevent interruption of a course of training, or hasten the return to a course of training which was interrupted because of such illness, injury, or dental condition.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id54925931-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1728/b"><num value="b">(b)</num><chapeau> In any case where reimbursement would be in order under subsection (a) of this section, the Secretary may, in lieu of reimbursing such veteran, make payment of the reasonable value of emergency treatment directly—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id54925932-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1728/b/1"><num value="1">(1)</num><content> to the hospital or other health facility furnishing the emergency treatment; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id54925933-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1728/b/2"><num value="2">(2)</num><content> to the person or organization making such expenditure on behalf of such veteran.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id54925934-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1728/c"><num value="c">(c)</num><content> In this section, the term “emergency treatment” has the meaning given such term in <ref href="/us/usc/t38/s1725/f/1">section 1725(f)(1) of this title</ref>.</content>
