<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id5494ca01-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1741"><num value="1741">§ 1741.</num><heading> Criteria for payment</heading><subsection style="-uslm-lc:I11" class="indent0" id="id5494ca02-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1741/a"><num value="a">(a)</num><paragraph style="-uslm-lc:I11" class="indent0" id="id5494ca03-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1741/a/1"><num value="1">(1)</num><chapeau> Except as provided in <ref href="/us/usc/t38/s1745">section 1745 of this title</ref>, the Secretary shall pay each State at the per diem rate of—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id5494ca04-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1741/a/1/A"><num value="A">(A)</num><content> $8.70 for domiciliary care; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id5494ca05-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1741/a/1/B"><num value="B">(B)</num><content> $20.35 for nursing home care and hospital care,</content>
</subparagraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">for each veteran receiving such care in a State home, if such veteran is eligible for such care in a Department facility.</continuation>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id5494ca06-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1741/a/2"><num value="2">(2)</num><content> The Secretary may pay each State per diem at a rate determined by the Secretary for each veteran receiving extended care services described in any of paragraphs (4) through (6) of <ref href="/us/usc/t38/s1710B/a">section 1710B(a) of this title</ref> under a program administered by a State home, if such veteran is eligible for such care under laws administered by the Secretary.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id5494ca07-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1741/b"><num value="b">(b)</num><content> In no case shall the payments made with respect to any veteran under this section exceed one-half of the cost of the veterans’ care in such State home.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id5494ca08-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1741/c"><num value="c">(c)</num><content> Whenever the Secretary makes a determination pursuant to <ref href="/us/usc/t38/s1720/a/2/A">section 1720(a)(2)(A) of this title</ref> that the cost of care furnished by the Department in a general hospital under the direct jurisdiction of the Secretary has increased, the Secretary may, effective no earlier than the date of such determination, increase the rates paid under subsection (a) of this section by a percentage not greater than the percentage by which the Secretary has determined that such cost of care has increased.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id5494ca09-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1741/d"><num value="d">(d)</num><content> Subject to <ref href="/us/usc/t38/s1743">section 1743 of this title</ref>, the payment of per diem for care furnished in a State home facility shall commence on the date of the completion of the inspection for recognition of the facility under <ref href="/us/usc/t38/s1742/a">section 1742(a) of this title</ref> if the Secretary determines, as a result of that inspection, that the State home meets the standards described in such section.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id5494ca0a-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1741/e"><num value="e">(e)</num><content> Payments to States pursuant to this section shall not be considered a liability of a third party, or otherwise be used to offset or reduce any other payment made to assist veterans.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id5494ca0b-f67d-11e5-8cc7-9b652666228a" identifier="/us/usc/t38/s1741/f"><num value="f">(f)</num><content> Any State home that requests payment or reimbursement for services provided to a veteran under this section shall provide to the Secretary such information as the Secretary considers necessary to identify each individual veteran eligible for payment under such section.</content>
