<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id4f93f1bf-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A"><num value="1784A">§ 1784A.</num><heading> Examination and treatment for emergency medical conditions and women in labor</heading><subsection style="-uslm-lc:I11" class="indent0" id="id4f93f1c0-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/a"><num value="a">(a)</num><heading> <inline class="small-caps">In General</inline>.—</heading><content>In the case of a hospital of the Department that has an emergency department, if any individual comes to the hospital or the campus of the hospital and a request is made on behalf of the individual for examination or treatment for a medical condition, the hospital must provide for an appropriate medical screening examination within the capability of the emergency department, including ancillary services routinely available to the emergency department, to determine whether or not an emergency medical condition exists.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id4f93f1c1-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/b"><num value="b">(b)</num><heading> <inline class="small-caps">Necessary Stabilizing Treatment for Emergency Medical Conditions and Labor</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id4f93f1c2-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/b/1"><num value="1">(1)</num><chapeau> If any individual comes to a hospital of the Department that has an emergency department or the campus of such a hospital and the hospital determines that the individual has an emergency medical condition, the hospital must provide either—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id4f93f1c3-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/b/1/A"><num value="A">(A)</num><content> within the staff and facilities available at the hospital, for such further medical examination and such treatment as may be required to stabilize the medical condition; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id4f93f1c4-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/b/1/B"><num value="B">(B)</num><content> for transfer of the individual to another medical facility in accordance with subsection (c).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id4f93f1c5-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/b/2"><num value="2">(2)</num><content> A hospital is deemed to meet the requirement of paragraph (1)(A) with respect to an individual if the hospital offers the individual the further medical examination and treatment described in that paragraph and informs the individual (or a person acting on behalf of the individual) of the risks and benefits to the individual of such examination and treatment, but the individual (or a person acting on behalf of the individual) refuses to consent to the examination and treatment. The hospital shall take all reasonable steps to secure the written informed consent of the individual (or person) to refuse such examination and treatment.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id4f93f1c6-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/b/3"><num value="3">(3)</num><content> A hospital is deemed to meet the requirement of paragraph (1)(B) with respect to an individual if the hospital offers to transfer the individual to another medical facility in accordance with subsection (c) and informs the individual (or a person acting on behalf of the individual) of the risks and benefits to the individual of such transfer, but the individual (or a person acting on behalf of the individual) refuses to consent to the transfer. The hospital shall take all reasonable steps to secure the written informed consent of the individual (or person) to refuse such transfer.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id4f93f1c7-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/c"><num value="c">(c)</num><heading> <inline class="small-caps">Restricting Transfers Until Individual Stabilized</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id4f93f1c8-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/c/1"><num value="1">(1)</num><chapeau> If an individual at a hospital of the Department has an emergency medical condition that has not been stabilized, the hospital may not transfer the individual unless—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id4f93f1c9-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/c/1/A"><num value="A">(A)</num><clause style="-uslm-lc:I12" class="indent1" id="id4f93f1ca-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/c/1/A/i"><num value="i">(i)</num><content> the individual (or a legally responsible person acting on behalf of the individual), after being informed of the obligations of the hospital under this section and of the risk of transfer, requests, in writing, transfer to another medical facility;</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="id4f93f1cb-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/c/1/A/ii"><num value="ii">(ii)</num><content> a physician of the Department has signed a certification that, based upon the information available at the time of transfer, the medical benefits reasonably expected from the provision of appropriate medical treatment at another medical facility outweigh the increased risks to the individual and, in the case of labor, to the unborn child from effecting the transfer; or</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="id4f93f1cc-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/c/1/A/iii"><num value="iii">(iii)</num><content> if a physician of the Department is not physically present in the emergency department at the time an individual is transferred, a qualified medical person (as defined by the Secretary for purposes of this section) has signed a certification described in clause (ii) after a physician of the Department, in consultation with the person, has made the determination described in such clause, and subsequently countersigns the certification; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id4f93f1cd-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/c/1/B"><num value="B">(B)</num><content> the transfer is an appropriate transfer to that facility.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id4f93f1ce-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/c/2"><num value="2">(2)</num><content> A certification described in clause (ii) or (iii) of paragraph (1)(A) shall include a summary of the risks and benefits upon which the certification is based.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id4f93f1cf-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/c/3"><num value="3">(3)</num><chapeau> For purposes of paragraph (1)(B), an appropriate transfer to a medical facility is a transfer—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id4f93f1d0-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/c/3/A"><num value="A">(A)</num><content> in which the transferring hospital provides the medical treatment within its capacity that minimizes the risks to the health of the individual and, in the case of a woman in labor, the health of the unborn child;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id4f93f1d1-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/c/3/B"><num value="B">(B)</num><chapeau> in which the receiving facility—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="id4f93f1d2-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/c/3/B/i"><num value="i">(i)</num><content> has available space and qualified personnel for the treatment of the individual; and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id4f93f1d3-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/c/3/B/ii"><num value="ii">(ii)</num><content> has agreed to accept transfer of the individual and to provide appropriate medical treatment;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id4f93f1d4-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/c/3/C"><num value="C">(C)</num><chapeau> in which the transferring hospital sends to the receiving facility all medical records (or copies thereof) available at the time of the transfer relating to the emergency medical condition for which the individual has presented, including—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="id4f93f1d5-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/c/3/C/i"><num value="i">(i)</num><content> observations of signs or symptoms;</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id4f93f1d6-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/c/3/C/ii"><num value="ii">(ii)</num><content> preliminary diagnosis;</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id4f93f1d7-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/c/3/C/iii"><num value="iii">(iii)</num><content> treatment provided;</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id4f93f1d8-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/c/3/C/iv"><num value="iv">(iv)</num><content> the results of any tests; and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id4f93f1d9-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/c/3/C/v"><num value="v">(v)</num><content> the informed written request or certification (or copy thereof) provided under paragraph (1)(A);</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id4f93f1da-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/c/3/D"><num value="D">(D)</num><content> in which the transfer is effected through qualified personnel and transportation equipment, including the use of necessary and medically appropriate life support measures during the transfer; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id4f93f1db-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/c/3/E"><num value="E">(E)</num><content> that meets such other requirements as the Secretary considers necessary in the interest of the health and safety of the individual or individuals transferred.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id4f93f1dc-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/d"><num value="d">(d)</num><heading> <inline class="small-caps">Payment to the Department</inline>.—</heading><content>The Secretary shall charge for any care or services provided under this section in accordance with billing and reimbursement authorities available to the Secretary under other provisions of law.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id4f93f1dd-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/e"><num value="e">(e)</num><heading> <inline class="small-caps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id4f93f1de-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/e/1"><num value="1">(1)</num><chapeau> The term “campus” means, with respect to a hospital of the Department—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id4f93f1df-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/e/1/A"><num value="A">(A)</num><content> the physical area immediately adjacent to the main buildings of the hospital;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id4f93f1e0-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/e/1/B"><num value="B">(B)</num><content> other areas and structures that are not strictly contiguous to the main buildings but are located not more than 250 yards from the main buildings; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id4f93f1e1-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/e/1/C"><num value="C">(C)</num><content> any other areas determined by the Secretary to be part of the campus of the hospital.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4f93f1e2-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/e/2"><num value="2">(2)</num><chapeau> The term “emergency medical condition” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id4f93f1e3-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/e/2/A"><num value="A">(A)</num><chapeau> a medical condition manifesting itself by acute symptoms of sufficient severity (including severe pain) such that the absence of immediate medical attention could reasonably be expected to result in—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id4f93f1e4-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/e/2/A/i"><num value="i">(i)</num><content> placing the health of the individual (or, with respect to a pregnant woman, the health of the woman or her unborn child) in serious jeopardy;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id4f93f1e5-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/e/2/A/ii"><num value="ii">(ii)</num><content> serious impairment to bodily functions; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id4f93f1e6-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/e/2/A/iii"><num value="iii">(iii)</num><content> serious dysfunction of any bodily organ or part; or</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id4f93f1e7-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/e/2/B"><num value="B">(B)</num><chapeau> in the case of a pregnant woman, a stage of labor that a medical provider determines indicates—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id4f93f1e8-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/e/2/B/i"><num value="i">(i)</num><content> that there is inadequate time to effect a safe transfer to another hospital before delivery; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id4f93f1e9-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/e/2/B/ii"><num value="ii">(ii)</num><content> that transfer may pose a threat to the health or safety of the woman or the unborn child.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4f93f1ea-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/e/3"><num value="3">(3)</num><subparagraph style="-uslm-lc:I12" class="indent1" id="id4f93f1eb-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/e/3/A"><num value="A">(A)</num><chapeau> The term “to stabilize” means—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="id4f93f1ec-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/e/3/A/i"><num value="i">(i)</num><content> with respect to an emergency medical condition described in paragraph (2)(A), to provide such medical treatment of the condition as may be necessary to assure, within reasonable medical probability, that no material deterioration of the condition is likely to result from or occur during the transfer of the individual from a facility; or</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id4f93f1ed-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/e/3/A/ii"><num value="ii">(ii)</num><content> with respect to an emergency medical condition described in paragraph (2)(B), to deliver (including the placenta).</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id4f93f1ee-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/e/3/B"><num value="B">(B)</num><chapeau> The term “stabilized” means—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="id4f93f1ef-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/e/3/B/i"><num value="i">(i)</num><content> with respect to an emergency medical condition described in paragraph (2)(A), that no material deterioration of the condition is likely, within reasonable medical probability, to result from or occur during the transfer of the individual from a facility; or</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id4f93f1f0-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/e/3/B/ii"><num value="ii">(ii)</num><content> with respect to an emergency medical condition described in paragraph (2)(B), that the woman has delivered (including the placenta).</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4f93f1f1-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/e/4"><num value="4">(4)</num><chapeau> The term “transfer” means the movement (including the discharge) of an individual outside the facilities of a hospital of the Department at the direction of any person employed by (or affiliated or associated, directly or indirectly, with) the hospital, but does not include such a movement of an individual who—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id4f93f1f2-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/e/4/A"><num value="A">(A)</num><content> has been declared dead; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id4f93f1f3-d8e3-11e6-99ef-e3cf53d8468e" identifier="/us/usc/t38/s1784A/e/4/B"><num value="B">(B)</num><content> leaves the facility without the permission of any such person.</content>
</subparagraph>
