L. 110–389, title II, § 222(a), Oct. 10, 2008, 122 Stat. 4156.)","seq_in_title":40,"parent_identifier":"/us/usc/t38/ptI/ch3","ancestors":[{"identifier":"/us/usc/t38","level":"title","num":"Title 38—","heading":"VETERANS’ BENEFITS","status":null,"is_section":false},{"identifier":"/us/usc/t38/ptI","level":"part","num":"PART I—","heading":"GENERAL PROVISIONS","status":null,"is_section":false},{"identifier":"/us/usc/t38/ptI/ch3","level":"chapter","num":"CHAPTER 3—","heading":"DEPARTMENT OF VETERANS AFFAIRS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id544634a4-f67d-11e5-8cc7-9b652666228a\" identifier=\"/us/usc/t38/s321\"><num value=\"321\">§ 321.</num><heading> Office of Survivors Assistance</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id544634a5-f67d-11e5-8cc7-9b652666228a\" identifier=\"/us/usc/t38/s321/a\"><num value=\"a\">(a)</num><heading> <inline class=\"small-caps\">Establishment</inline>.—</heading><chapeau>The Secretary shall establish in the Department an Office of Survivors Assistance (in this section referred to as the “Office”) to serve as a resource regarding all benefits and services furnished by the Department—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id544634a6-f67d-11e5-8cc7-9b652666228a\" identifier=\"/us/usc/t38/s321/a/1\"><num value=\"1\">(1)</num><content> to survivors and dependents of deceased veterans; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id544634a7-f67d-11e5-8cc7-9b652666228a\" identifier=\"/us/usc/t38/s321/a/2\"><num value=\"2\">(2)</num><content> to survivors and dependents of deceased members of the Armed Forces.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id544634a8-f67d-11e5-8cc7-9b652666228a\" identifier=\"/us/usc/t38/s321/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Advisory Duties</inline>.—</heading><content>The Office shall serve as a primary advisor to the Secretary on all matters related to the policies, programs, legislative issues, and other initiatives affecting the survivors and dependents described in subsection (a).</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id544634a9-f67d-11e5-8cc7-9b652666228a\" identifier=\"/us/usc/t38/s321/c\"><num value=\"c\">(c)</num><heading> <inline class=\"small-caps\">Guidance From Stakeholders</inline>.—</heading><content>In establishing the Office, the Secretary shall seek guidance from interested stakeholders.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id544634aa-f67d-11e5-8cc7-9b652666228a\" identifier=\"/us/usc/t38/s321/d\"><num value=\"d\">(d)</num><heading> <inline class=\"small-caps\">Resources</inline>.—</heading><content>The Secretary shall ensure that appropriate personnel, funding, and other resources are provided to the Office to carry out its responsibilities.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id544634ab-f67d-11e5-8cc7-9b652666228a\" identifier=\"/us/usc/t38/s321/e\"><num value=\"e\">(e)</num><heading> <inline class=\"small-caps\">Inclusion of Information on Office in Annual Report on Department Activities</inline>.—</heading><content>The Secretary shall include in each annual Performance and Accountability report submitted by the Secretary to Congress a description of the activities of the Office during the fiscal year covered by such report.</content>\n</subsection>\n<sourceCredit id=\"id544634ac-f67d-11e5-8cc7-9b652666228a\">(Added <ref href=\"/us/pl/110/389/tII\">Pub.
