<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idf1d93a5f-8eec-11e6-96b6-c982656349eb" identifier="/us/usc/t38/s8161"><num value="8161">§ 8161.</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I11" class="indent0">For the purposes of this subchapter:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idf1d93a60-8eec-11e6-96b6-c982656349eb" identifier="/us/usc/t38/s8161/1"><num value="1">(1)</num><content> The term “enhanced-use lease” means a written lease entered into by the Secretary under this subchapter.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf1d93a61-8eec-11e6-96b6-c982656349eb" identifier="/us/usc/t38/s8161/2"><num value="2">(2)</num><content> The term “congressional veterans’ affairs committees” means the Committees on Veterans’ Affairs of the Senate and the House of Representatives.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf1d93a62-8eec-11e6-96b6-c982656349eb" identifier="/us/usc/t38/s8161/3"><num value="3">(3)</num><chapeau> The term “supportive housing” means housing that engages tenants in on-site and community-based support services for veterans or their families that are at risk of homelessness or are homeless. Such term may include the following:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf1d93a63-8eec-11e6-96b6-c982656349eb" identifier="/us/usc/t38/s8161/3/A"><num value="A">(A)</num><content> Transitional housing.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf1d93a64-8eec-11e6-96b6-c982656349eb" identifier="/us/usc/t38/s8161/3/B"><num value="B">(B)</num><content> Single-room occupancy.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf1d93a65-8eec-11e6-96b6-c982656349eb" identifier="/us/usc/t38/s8161/3/C"><num value="C">(C)</num><content> Permanent housing.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf1d93a66-8eec-11e6-96b6-c982656349eb" identifier="/us/usc/t38/s8161/3/D"><num value="D">(D)</num><content> Congregate living housing.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf1d93a67-8eec-11e6-96b6-c982656349eb" identifier="/us/usc/t38/s8161/3/E"><num value="E">(E)</num><content> Independent living housing.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf1d93a68-8eec-11e6-96b6-c982656349eb" identifier="/us/usc/t38/s8161/3/F"><num value="F">(F)</num><content> Assisted living housing.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf1d93a69-8eec-11e6-96b6-c982656349eb" identifier="/us/usc/t38/s8161/3/G"><num value="G">(G)</num><content> Other modalities of housing.</content>
</subparagraph>

<paragraph style="-uslm-lc:I12" class="indent1" id="idf1d93a6a-8eec-11e6-96b6-c982656349eb" identifier="/us/usc/t38/s8161/4"><num value="4">(4)</num><content> The term “lessee” means the party with whom the Secretary has entered into an enhanced-use lease under this subchapter.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="idf1d93a6b-8eec-11e6-96b6-c982656349eb" identifier="/us/usc/t38/s8161/5"><num value="5">(5)</num><content> The term “major enhanced-use lease” means an enhanced-use lease that includes consideration consisting of an average annual rent of more than $10,000,000.</content>

<paragraph style="-uslm-lc:I21" class="indent0"><num value="1">“(1)</num><content> The Secretary [of Veterans Affairs] shall take appropriate actions to secure from an appropriate entity (or entities) independent of the Department [of Veterans Affairs] an analysis (or analyses) of opportunities for the use of the enhanced-use lease authority under subchapter V of chapter 81 of title 38, United States Code.</content>

<paragraph style="-uslm-lc:I21" class="indent0"><num value="2">“(2)</num><chapeau> An analysis under paragraph (1) shall include—</chapeau><subparagraph style="-uslm-lc:I22" class="indent1"><num value="A">“(A)</num><content> a survey of facilities of the Department for purposes of identifying Department property that presents an opportunity for lease under the enhanced-use lease authority;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="B">“(B)</num><content> an assessment of the feasibility of entering into enhanced-use leases under that authority in the case of any property identified under subparagraph (A) as presenting an opportunity for such lease; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="C">“(C)</num><content> an assessment of the resources required at the Department facilities concerned, and at the Department Central Office, in order to facilitate the entering into of enhanced-used leases in the case of property so identified.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I21" class="indent0"><num value="3">“(3)</num><content> If as a result of a survey under paragraph (2)(A) an entity carrying out an analysis under this subsection determines that a particular Department property presents no opportunities for lease under the enhanced-use lease authority, the analysis shall include the entity’s explanation of that determination.</content>

<paragraph style="-uslm-lc:I21" class="indent0"><num value="4">“(4)</num><content> If as a result of such a survey an entity carrying out an analysis under this subsection determines that certain Department property presents an opportunity for lease under the enhanced-use lease authority, the analysis shall include a single integrated business plan, developed by the entity, that addresses the strategy and resources necessary to implement the plan for all property determined to present an opportunity for such lease.”</content>
