<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idaf58d92f-3b2b-11eb-8a99-86c9feb5d7f6" identifier="/us/usc/t39/s2003"><num value="2003">§ 2003.</num><heading> The Postal Service Fund</heading><subsection style="-uslm-lc:I11" class="indent0" id="idaf58d930-3b2b-11eb-8a99-86c9feb5d7f6" identifier="/us/usc/t39/s2003/a"><num value="a">(a)</num><content> There is established in the Treasury of the United States a revolving fund to be called the Postal Service Fund which shall be available to the Postal Service without fiscal-year limitation to carry out the purposes, functions, and powers authorized by this title (other than any of the purposes, functions, or powers for which the Competitive Products Fund is available).</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idaf590041-3b2b-11eb-8a99-86c9feb5d7f6" identifier="/us/usc/t39/s2003/b"><num value="b">(b)</num><chapeau> Except as otherwise provided in section 2011, there shall be deposited in the Fund, subject to withdrawal by check by the Postal Service—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idaf590042-3b2b-11eb-8a99-86c9feb5d7f6" identifier="/us/usc/t39/s2003/b/1"><num value="1">(1)</num><content> revenues from postal and nonpostal services rendered by the Postal Service;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaf590043-3b2b-11eb-8a99-86c9feb5d7f6" identifier="/us/usc/t39/s2003/b/2"><num value="2">(2)</num><content> amounts received from obligations issued by the Postal Service;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaf590044-3b2b-11eb-8a99-86c9feb5d7f6" identifier="/us/usc/t39/s2003/b/3"><num value="3">(3)</num><content> amounts appropriated for the use of the Postal Service;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaf590045-3b2b-11eb-8a99-86c9feb5d7f6" identifier="/us/usc/t39/s2003/b/4"><num value="4">(4)</num><content> interest which may be earned on investments of the Fund;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaf592756-3b2b-11eb-8a99-86c9feb5d7f6" identifier="/us/usc/t39/s2003/b/5"><num value="5">(5)</num><content> any other receipts of the Postal Service;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaf592757-3b2b-11eb-8a99-86c9feb5d7f6" identifier="/us/usc/t39/s2003/b/6"><num value="6">(6)</num><content> the balance in the Post Office Department Fund established under former <ref href="/us/usc/t39/s2202">section 2202 of title 39</ref> as of the commencement of operations of the Postal Service;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaf592758-3b2b-11eb-8a99-86c9feb5d7f6" identifier="/us/usc/t39/s2003/b/7"><num value="7">(7)</num><content> amounts (including proceeds from the sale of forfeited items) from any civil forfeiture conducted by the Postal Service;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaf592759-3b2b-11eb-8a99-86c9feb5d7f6" identifier="/us/usc/t39/s2003/b/8"><num value="8">(8)</num><content> any transfers from the Secretary of the Treasury from the Department of the Treasury Forfeiture Fund which shall be available to the Postmaster General only for Federal law enforcement related purposes; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaf59275a-3b2b-11eb-8a99-86c9feb5d7f6" identifier="/us/usc/t39/s2003/b/9"><num value="9">(9)</num><content> any amounts collected under section 3018.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idaf59275b-3b2b-11eb-8a99-86c9feb5d7f6" identifier="/us/usc/t39/s2003/c"><num value="c">(c)</num><content> If the Postal Service determines that the moneys of the Fund are in excess of current needs, it may request the investment of such amounts as it deems advisable by the Secretary of the Treasury in obligations of, or obligations guaranteed by, the Government of the United States, and, with the approval of the Secretary, in such other obligations or securities as it deems appropriate.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idaf594e6c-3b2b-11eb-8a99-86c9feb5d7f6" identifier="/us/usc/t39/s2003/d"><num value="d">(d)</num><content> With the approval of the Secretary of the Treasury, the Postal Service may deposit moneys of the Fund in any Federal Reserve bank, any depository for public funds, or in such other places and in such manner as the Postal Service and the Secretary may mutually agree.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idaf594e6d-3b2b-11eb-8a99-86c9feb5d7f6" identifier="/us/usc/t39/s2003/e"><num value="e">(e)</num><paragraph style="-uslm-lc:I11" class="indent0" id="idaf594e6e-3b2b-11eb-8a99-86c9feb5d7f6" identifier="/us/usc/t39/s2003/e/1"><num value="1">(1)</num><content> The Fund shall be available for the payment of (A) all expenses incurred by the Postal Service in carrying out its functions as provided by law, subject to the same limitation as set forth in the parenthetical matter under subsection (a); (B) all expenses of the Postal Regulatory Commission, subject to the availability of amounts appropriated under section 504(d); and (C) all expenses of the Office of Inspector General, subject to the availability of amounts appropriated under section 8G(f) of the Inspector General Act of 1978. The Postmaster General shall transfer from the Fund to the Secretary of the Treasury for deposit in the Department of the Treasury Forfeiture Fund amounts appropriate to reflect the degree of participation of Department of the Treasury law enforcement organizations (described in section 9705(<i>o</i>) of title 31) in the law enforcement effort resulting in the forfeiture pursuant to laws enforced or administered by the Postal Service. Neither the Fund nor any of the funds credited to it shall be subject to apportionment under the provisions of subchapter II of chapter 15 of title 31.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idaf59757f-3b2b-11eb-8a99-86c9feb5d7f6" identifier="/us/usc/t39/s2003/e/2"><num value="2">(2)</num><content> Funds appropriated to the Postal Service under <ref href="/us/usc/t39/s2401">section 2401 of this title</ref> shall be apportioned as provided in this paragraph. From the total amounts appropriated to the Postal Service for any fiscal year under the authorizations contained in <ref href="/us/usc/t39/s2401">section 2401 of this title</ref>, the Secretary of the Treasury shall make available to the Postal Service 25 percent of such amount at the beginning of each quarter of such fiscal year.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idaf599c90-3b2b-11eb-8a99-86c9feb5d7f6" identifier="/us/usc/t39/s2003/f"><num value="f">(f)</num><content> Notwithstanding any other provision of this section, any amounts appropriated to the Postal Service under subsection (d) of <ref href="/us/usc/t39/s2401">section 2401 of this title</ref> and deposited into the Fund shall be expended by the Postal Service only for the purposes provided in such subsection.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idaf599c91-3b2b-11eb-8a99-86c9feb5d7f6" identifier="/us/usc/t39/s2003/g"><num value="g">(g)</num><content> Notwithstanding any provision of <ref href="/us/usc/t5/s8147">section 8147 of title 5</ref>, whenever the Secretary of Labor furnishes a statement to the Postal Service indicating an amount due from the Postal Service under subsection (b) of that section, the Postal Service shall make the deposit required pursuant to that statement (and any additional payment under subsection (c) of that section, to the extent that it relates to the period covered by such statement) not later than 30 days after the date on which such statement is so furnished. Any deposit (and any additional payment) which is subject to the preceding sentence shall, once made, remain available without fiscal year limitation.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idaf59c3a2-3b2b-11eb-8a99-86c9feb5d7f6" identifier="/us/usc/t39/s2003/h"><num value="h">(h)</num><content> Liabilities of the former Post Office Department to the Employees’ Compensation Fund (appropriations for which were authorized by former section 2004, as in effect before the effective date of this subsection) shall be liabilities of the Postal Service payable out of the Fund.</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="a">“(a)</num><heading> <inline class="small-caps">Establishment of Postal Service Escrow Fund</inline>.—</heading><chapeau>There is established as a separate account in the United States Treasury, the ‘Postal Service Escrow Fund’. Such Fund shall—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> have such amounts described under subsection (b)(2) deposited no later than <date date="1988-10-31">October 31, 1988</date>;</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> not be available for expenditures of any amounts therein during the existence of such Fund; and</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> cease to exist on <date date="1989-10-01">October 1, 1989</date>, and on such date all amounts deposited in such Fund under subsection (b)(2) shall be deposited in the Postal Service Fund established under <ref href="/us/usc/t39/s2003">section 2003 of title 39</ref>, United States Code.</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Deposit of Certain Savings in Certain Funds.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">Fiscal year 1988</inline>.—</heading><content>From all funds available to the United States Postal Service in fiscal year 1988, the Postal Service shall deposit into the Civil Service Retirement and Disability Fund established under <ref href="/us/usc/t5/s8348">section 8348 of title 5</ref>, United States Code, an amount of $350,000,000 in fiscal year 1988, in addition to any amount deposited pursuant to subsection (h) of such section.</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Fiscal year 1989</inline>.—</heading><content>From all funds available to the United States Postal Service in fiscal year 1989, the Postal Service shall deposit into the Postal Service Escrow Fund an amount of $465,000,000 no later than <date date="1988-10-31">October 31, 1988</date>.</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Capital Limitations for Fiscal Years</inline> 1988 <inline class="small-caps">and</inline> 1989.—</heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><chapeau> The United States Postal Service may not make any commitment or obligation to expend any monies deposited in the Postal Service Fund established under <ref href="/us/usc/t39/s2003">section 2003 of title 39</ref>, United States Code, for the capital investment program—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> in excess of $625,000,000 in fiscal year 1988; and</content>

<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> in excess of $1,995,000,000 in fiscal year 1989.</content>
</subparagraph>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Capital investment programs</inline>.—</heading><content>For the purposes of paragraph (1) the term ‘capital investment program’ shall include all investments in long-term assets and capital investment expenditures (including direct and indirect costs associated with such investments and expenditures, such as obligations through contracts).”</content>
