<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idf07cce7d-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s102"><num value="102">§ 102.</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I11" class="indent0">Except as provided in subchapter VII of chapter 5 of this title, the following definitions apply in chapters 1 through 7 of this title and in division C (except sections 3302, 3501(b), 3509, 3906, 4710, and 4711) of subtitle I of title 41:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idf07cce7e-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s102/1"><num value="1">(1)</num><heading> <inline class="small-caps">Care and handling</inline>.—</heading><chapeau>The term “care and handling” includes—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf07cce7f-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s102/1/A"><num value="A">(A)</num><content> completing, repairing, converting, rehabilitating, operating, preserving, protecting, insuring, packing, storing, handling, conserving, and transporting excess and surplus property; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf07cce80-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s102/1/B"><num value="B">(B)</num><content> rendering innocuous, or destroying, property that is dangerous to public health or safety.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf07cce81-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s102/2"><num value="2">(2)</num><heading> <inline class="small-caps">Contractor inventory</inline>.—</heading><chapeau>The term “contractor inventory” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf07d1ca2-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s102/2/A"><num value="A">(A)</num><content> property, in excess of amounts needed to complete full performance, that is acquired by and in possession of a contractor or subcontractor under a contract pursuant to which title is vested in the Federal Government; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf07d1ca3-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s102/2/B"><num value="B">(B)</num><content> property that the Government is obligated or has the option to take over, under any type of contract, as a result of changes in specifications or plans under the contract, or as a result of termination of the contract (or a subcontract), prior to completion of the work, for the convenience or at the option of the Government.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf07d1ca4-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s102/3"><num value="3">(3)</num><heading> <inline class="small-caps">Excess property</inline>.—</heading><content>The term “excess property” means property under the control of a federal agency that the head of the agency determines is not required to meet the agency’s needs or responsibilities.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf07d1ca5-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s102/4"><num value="4">(4)</num><heading> <inline class="small-caps">Executive agency</inline>.—</heading><chapeau>The term “executive agency” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf07d1ca6-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s102/4/A"><num value="A">(A)</num><content> an executive department or independent establishment in the executive branch of the Government; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf07d43b7-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s102/4/B"><num value="B">(B)</num><content> a wholly owned Government corporation.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf07d43b8-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s102/5"><num value="5">(5)</num><heading> <inline class="small-caps">Federal agency</inline>.—</heading><content>The term “federal agency” means an executive agency or an establishment in the legislative or judicial branch of the Government (except the Senate, the House of Representatives, and the Architect of the Capitol, and any activities under the direction of the Architect of the Capitol).</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf07d43b9-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s102/6"><num value="6">(6)</num><heading> <inline class="small-caps">Foreign excess property</inline>.—</heading><content>The term “foreign excess property” means excess property that is not located in the States of the United States, the District of Columbia, Puerto Rico, American Samoa, Guam, the Northern Mariana Islands, the Federated States of Micronesia, the Marshall Islands, Palau, and the Virgin Islands.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf07d43ba-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s102/7"><num value="7">(7)</num><heading> <inline class="small-caps">Motor vehicle</inline>.—</heading><chapeau>The term “motor vehicle” means any vehicle, self-propelled or drawn by mechanical power, designed and operated principally for highway transportation of property or passengers, excluding—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf07d43bb-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s102/7/A"><num value="A">(A)</num><content> a vehicle designed or used for military field training, combat, or tactical purposes, or used principally within the confines of a regularly established military post, camp, or depot; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf07d43bc-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s102/7/B"><num value="B">(B)</num><content> a vehicle regularly used by an agency to perform investigative, law enforcement, or intelligence duties, if the head of the agency determines that exclusive control of the vehicle is essential for effective performance of duties.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf07d43bd-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s102/8"><num value="8">(8)</num><heading> <inline class="small-caps">Nonpersonal services</inline>.—</heading><content>The term “nonpersonal services” means contractual services designated by the Administrator of General Services, other than personal and professional services.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf07d43be-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s102/9"><num value="9">(9)</num><heading> <inline class="small-caps">Property</inline>.—</heading><chapeau>The term “property” means any interest in property except—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf07d6acf-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s102/9/A"><num value="A">(A)</num><clause style="-uslm-lc:I13" class="indent2" id="idf07d6ad0-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s102/9/A/i"><num value="i">(i)</num><content> the public domain;</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="idf07d6ad1-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s102/9/A/ii"><num value="ii">(ii)</num><content> land reserved or dedicated for national forest or national park purposes;</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="idf07d6ad2-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s102/9/A/iii"><num value="iii">(iii)</num><content> minerals in land or portions of land withdrawn or reserved from the public domain which the Secretary of the Interior determines are suitable for disposition under the public land mining and mineral leasing laws; and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="idf07d6ad3-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s102/9/A/iv"><num value="iv">(iv)</num><content> land withdrawn or reserved from the public domain except land or portions of land so withdrawn or reserved which the Secretary, with the concurrence of the Administrator, determines are not suitable for return to the public domain for disposition under the general public land laws because the lands are substantially changed in character by improvements or otherwise;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf07d6ad4-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s102/9/B"><num value="B">(B)</num><content> naval vessels that are battleships, cruisers, aircraft carriers, destroyers, or submarines; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf07d6ad5-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s102/9/C"><num value="C">(C)</num><content> records of the Government.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf07d6ad6-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s102/10"><num value="10">(10)</num><heading> <inline class="small-caps">Surplus property</inline>.—</heading><content>The term “surplus property” means excess property that the Administrator determines is not required to meet the needs or responsibilities of all federal agencies.</content>
