L. 108–458, title VIII, § 8401(3), Dec. 17, 2004, 118 Stat. 3869.)","seq_in_title":325,"parent_identifier":"/us/usc/t40/stIII/ch113/schII","ancestors":[{"identifier":"/us/usc/t40","level":"title","num":"Title 40—","heading":"PUBLIC BUILDINGS, PROPERTY, AND WORKS","status":null,"is_section":false},{"identifier":"/us/usc/t40/stIII","level":"subtitle","num":"SUBTITLE III—","heading":"INFORMATION TECHNOLOGY MANAGEMENT","status":null,"is_section":false},{"identifier":"/us/usc/t40/stIII/ch113","level":"chapter","num":"CHAPTER 113—","heading":"RESPONSIBILITY FOR ACQUISITIONS OF INFORMATION TECHNOLOGY","status":null,"is_section":false},{"identifier":"/us/usc/t40/stIII/ch113/schII","level":"subchapter","num":"SUBCHAPTER II—","heading":"EXECUTIVE AGENCIES","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idf0c4ad39-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s11312\"><num value=\"11312\">§ 11312.</num><heading> Capital planning and investment control</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf0c4ad3a-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s11312/a\"><num value=\"a\">(a)</num><heading> <inline class=\"small-caps\">Design of Process</inline>.—</heading><content>In fulfilling the responsibilities assigned under <ref href=\"/us/usc/t44/s3506/h\">section 3506(h) of title 44</ref>, the head of each executive agency shall design and implement in the executive agency a process for maximizing the value, and assessing and managing the risks, of the information technology acquisitions of the executive agency.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf0c4ad3b-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s11312/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Content of Process</inline>.—</heading><chapeau>The process of an executive agency shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0c4ad3c-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s11312/b/1\"><num value=\"1\">(1)</num><content> provide for the selection of investments in information technology (including information security needs) to be made by the executive agency, the management of those investments, and the evaluation of the results of those investments;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0c4ad3d-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s11312/b/2\"><num value=\"2\">(2)</num><content> be integrated with the processes for making budget, financial, and program management decisions in the executive agency;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0c4ad3e-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s11312/b/3\"><num value=\"3\">(3)</num><content> include minimum criteria to be applied in considering whether to undertake a particular investment in information systems, including criteria related to the quantitatively expressed projected net, risk-adjusted return on investment and specific quantitative and qualitative criteria for comparing and prioritizing alternative information systems investment projects;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0c4ad3f-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s11312/b/4\"><num value=\"4\">(4)</num><content> identify information systems investments that would result in shared benefits or costs for other federal agencies or state or local governments;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0c4ad40-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s11312/b/5\"><num value=\"5\">(5)</num><content> identify quantifiable measurements for determining the net benefits and risks of a proposed investment; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0c4ad41-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s11312/b/6\"><num value=\"6\">(6)</num><content> provide the means for senior management personnel of the executive agency to obtain timely information regarding the progress of an investment in an information system, including a system of milestones for measuring progress, on an independently verifiable basis, in terms of cost, capability of the system to meet specified requirements, timeliness, and quality.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"idf0c4d452-b211-11e9-9941-df2837ad0631\">(<ref href=\"/us/pl/107/217\">Pub.
