L. 107–217, Aug. 21, 2002, 116 Stat. 1240.)","seq_in_title":326,"parent_identifier":"/us/usc/t40/stIII/ch113/schII","ancestors":[{"identifier":"/us/usc/t40","level":"title","num":"Title 40—","heading":"PUBLIC BUILDINGS, PROPERTY, AND WORKS","status":null,"is_section":false},{"identifier":"/us/usc/t40/stIII","level":"subtitle","num":"SUBTITLE III—","heading":"INFORMATION TECHNOLOGY MANAGEMENT","status":null,"is_section":false},{"identifier":"/us/usc/t40/stIII/ch113","level":"chapter","num":"CHAPTER 113—","heading":"RESPONSIBILITY FOR ACQUISITIONS OF INFORMATION TECHNOLOGY","status":null,"is_section":false},{"identifier":"/us/usc/t40/stIII/ch113/schII","level":"subchapter","num":"SUBCHAPTER II—","heading":"EXECUTIVE AGENCIES","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idf0c4d457-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s11313\"><num value=\"11313\">§ 11313.</num><heading> Performance and results-based management</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In fulfilling the responsibilities under <ref href=\"/us/usc/t44/s3506/h\">section 3506(h) of title 44</ref>, the head of an executive agency shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0c4d458-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s11313/1\"><num value=\"1\">(1)</num><content> establish goals for improving the efficiency and effectiveness of agency operations and, as appropriate, the delivery of services to the public through the effective use of information technology;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0c4d459-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s11313/2\"><num value=\"2\">(2)</num><content> prepare an annual report, to be included in the executive agency’s budget submission to Congress, on the progress in achieving the goals;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0c4d45a-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s11313/3\"><num value=\"3\">(3)</num><chapeau> ensure that performance measurements—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf0c4d45b-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s11313/3/A\"><num value=\"A\">(A)</num><content> are prescribed for information technology used by, or to be acquired for, the executive agency; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf0c4d45c-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s11313/3/B\"><num value=\"B\">(B)</num><content> measure how well the information technology supports programs of the executive agency;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0c4d45d-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s11313/4\"><num value=\"4\">(4)</num><content> where comparable processes and organizations in the public or private sectors exist, quantitatively benchmark agency process performance against those processes in terms of cost, speed, productivity, and quality of outputs and outcomes;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0c4d45e-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s11313/5\"><num value=\"5\">(5)</num><content> analyze the missions of the executive agency and, based on the analysis, revise the executive agency’s mission-related processes and administrative processes as appropriate before making significant investments in information technology to be used in support of the performance of those missions; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0c4d45f-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s11313/6\"><num value=\"6\">(6)</num><content> ensure that the information security policies, procedures, and practices of the executive agency are adequate.</content>\n</paragraph>\n<sourceCredit id=\"idf0c4d460-b211-11e9-9941-df2837ad0631\">(<ref href=\"/us/pl/107/217\">Pub.
