L. 113–287, § 5(j)(4), Dec. 19, 2014, 128 Stat. 3269.)","seq_in_title":115,"parent_identifier":"/us/usc/t40/stI/ch13","ancestors":[{"identifier":"/us/usc/t40","level":"title","num":"Title 40—","heading":"PUBLIC BUILDINGS, PROPERTY, AND WORKS","status":null,"is_section":false},{"identifier":"/us/usc/t40/stI","level":"subtitle","num":"SUBTITLE I—","heading":"FEDERAL PROPERTY AND ADMINISTRATIVE SERVICES","status":null,"is_section":false},{"identifier":"/us/usc/t40/stI/ch13","level":"chapter","num":"CHAPTER 13—","heading":"PUBLIC PROPERTY","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idf0a083a3-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s1314\"><num value=\"1314\">§ 1314.</num><heading> Easements</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf0a083a4-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s1314/a\"><num value=\"a\">(a)</num><heading> <inline class=\"small-caps\">Definitions</inline>.—</heading><chapeau>In this section—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0a083a5-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s1314/a/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">Executive agency</inline>.—</heading><content>The term “executive agency” means an executive department or independent establishment in the executive branch of the Federal Government, including a wholly owned Government corporation.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0a083a6-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s1314/a/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Real property of the government</inline>.—</heading><chapeau>The term “real property of the Government” excludes—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf0a083a7-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s1314/a/2/A\"><num value=\"A\">(A)</num><chapeau> public land (including minerals, vegetative, and other resources) in the United States, including—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf0a083a8-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s1314/a/2/A/i\"><num value=\"i\">(i)</num><content> land reserved or dedicated for national forest purposes;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf0a083a9-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s1314/a/2/A/ii\"><num value=\"ii\">(ii)</num><content> land the Secretary of the Interior administers or supervises in accordance with section 100101(a), chapter 1003, and sections 100751(a), 100752, 100753, and 102101 of title 54;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf0a083aa-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s1314/a/2/A/iii\"><num value=\"iii\">(iii)</num><content> Indian-owned trust and restricted land; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf0a083ab-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s1314/a/2/A/iv\"><num value=\"iv\">(iv)</num><content> land the Government acquires primarily for fish and wildlife conservation purposes and the Secretary administers;</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf0a083ac-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s1314/a/2/B\"><num value=\"B\">(B)</num><content> land withdrawn from the public domain primarily under the jurisdiction of the Secretary; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf0a083ad-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s1314/a/2/C\"><num value=\"C\">(C)</num><content> land acquired for national forest purposes.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0a083ae-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s1314/a/3\"><num value=\"3\">(3)</num><heading> <inline class=\"small-caps\">State</inline>.—</heading><content>The term “State” means a State of the United States, the District of Columbia, Puerto Rico, and the territories and possessions of the United States.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf0a083af-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s1314/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Grant of Easement</inline>.—</heading><content>When a State, a political subdivision or agency of a State, or a person applies for the grant of an easement in, over, or on real property of the Government, the executive agency having control of the real property may grant to the applicant, on behalf of the Government, an easement that the head of the agency decides will not be adverse to the interests of the Government, subject to reservations, exceptions, limitations, benefits, burdens, terms, or conditions that the head of the agency considers necessary to protect the interests of the Government. The grant may be made without consideration, or with monetary or other consideration, including an interest in real property.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf0a0a9c0-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s1314/c\"><num value=\"c\">(c)</num><heading> <inline class=\"small-caps\">Relinquishment of Legislative Jurisdiction</inline>.—</heading><content>In connection with the grant of an easement, the executive agency concerned may relinquish to the State in which the real property is located legislative jurisdiction that the executive agency considers necessary or desirable. Relinquishment of legislative jurisdiction may be accomplished by filing with the chief executive officer of the State a notice of relinquishment to take effect upon acceptance or by proceeding in the manner that the laws applicable to the State may provide.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf0a0a9c1-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s1314/d\"><num value=\"d\">(d)</num><heading> <inline class=\"small-caps\">Termination of Easement.—</inline></heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0a0a9c2-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s1314/d/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">When termination occurs</inline>.—</heading><chapeau>The instrument granting the easement may provide for termination of any part of the easement if there has been—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf0a0a9c3-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s1314/d/1/A\"><num value=\"A\">(A)</num><content> a failure to comply with a term or condition of the grant;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf0a0a9c4-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s1314/d/1/B\"><num value=\"B\">(B)</num><content> a nonuse of the easement for a consecutive 2-year period for the purpose for which granted; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf0a0a9c5-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s1314/d/1/C\"><num value=\"C\">(C)</num><content> an abandonment of the easement.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0a0a9c6-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s1314/d/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Notice required</inline>.—</heading><content>If a termination provision is included, it shall require that written notice of the termination be given to the grantee, or its successors or assigns.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0a0a9c7-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s1314/d/3\"><num value=\"3\">(3)</num><heading> <inline class=\"small-caps\">Effective date</inline>.—</heading><content>The termination is effective as of the date of the notice.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf0a0a9c8-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s1314/e\"><num value=\"e\">(e)</num><heading> <inline class=\"small-caps\">Additional Easement Authority</inline>.—</heading><content>The authority conferred by this section is in addition to, and shall not affect or be subject to, any other law under which an executive agency may grant easements.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf0a0a9c9-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s1314/f\"><num value=\"f\">(f)</num><heading> <inline class=\"small-caps\">Limitation on Issuance of Rights of Way</inline>.—</heading><content>Rights of way over, under, and through public lands and lands in the National Forest System may not be granted under this section.</content>\n</subsection>\n<sourceCredit id=\"idf0a0a9ca-b211-11e9-9941-df2837ad0631\">(<ref href=\"/us/pl/107/217\">Pub.
