<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idf0ccc3bb-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s14526"><num value="14526">§ 14526.</num><heading> Distressed, at-risk, and economically strong counties</heading><subsection style="-uslm-lc:I11" class="indent0" id="idf0ccc3bc-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s14526/a"><num value="a">(a)</num><heading> <inline class="small-caps">Designations.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="idf0ccc3bd-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s14526/a/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>The Appalachian Regional Commission, in accordance with criteria the Commission may establish, each year shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf0ccc3be-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s14526/a/1/A"><num value="A">(A)</num><content> designate as “distressed counties” those counties in the Appalachian region that are the most severely and persistently distressed;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf0ccc3bf-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s14526/a/1/B"><num value="B">(B)</num><content> designate as “at-risk counties” those counties in the Appalachian region that are most at risk of becoming economically distressed; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf0ccc3c0-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s14526/a/1/C"><num value="C">(C)</num><chapeau> designate two categories of economically strong counties, consisting of—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idf0ccc3c1-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s14526/a/1/C/i"><num value="i">(i)</num><content> “competitive counties”, which shall be those counties in the region that are approaching economic parity with the rest of the United States; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf0ccc3c2-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s14526/a/1/C/ii"><num value="ii">(ii)</num><content> “attainment counties”, which shall be those counties in the region that have attained or exceeded economic parity with the rest of the United States.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf0ccc3c3-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s14526/a/2"><num value="2">(2)</num><heading> <inline class="small-caps">Annual review of designations</inline>.—</heading><chapeau>The Commission shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf0ccc3c4-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s14526/a/2/A"><num value="A">(A)</num><content> conduct an annual review of each designation of a county under paragraph (1) to determine if the county still meets the criteria for the designation; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf0ccc3c5-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s14526/a/2/B"><num value="B">(B)</num><content> renew the designation for another one-year period only if the county still meets the criteria.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idf0ccc3c6-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s14526/b"><num value="b">(b)</num><heading> <inline class="small-caps">Distressed Counties</inline>.—</heading><content>In program and project development and implementation and in the allocation of appropriations made available to carry out this subtitle, the Commission shall give special consideration to the needs of counties for which a distressed county designation is in effect under this section.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idf0ccc3c7-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s14526/c"><num value="c">(c)</num><heading> <inline class="small-caps">Economically Strong Counties.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="idf0ccc3c8-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s14526/c/1"><num value="1">(1)</num><heading> <inline class="small-caps">Competitive counties</inline>.—</heading><content>Except as provided in paragraphs (3) and (4), assistance under this subtitle for a project that is carried out in a county for which a competitive county designation is in effect under this section shall not be more than 30 percent of the project cost.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf0ccc3c9-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s14526/c/2"><num value="2">(2)</num><heading> <inline class="small-caps">Attainment counties</inline>.—</heading><content>Except as provided in paragraphs (3) and (4), amounts may not be provided under this subtitle for a project that is carried out in a county for which an attainment county designation is in effect under this section.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf0ccc3ca-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s14526/c/3"><num value="3">(3)</num><heading> <inline class="small-caps">Exceptions</inline>.—</heading><chapeau>Paragraphs (1) and (2) do not apply to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf0ccc3cb-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s14526/c/3/A"><num value="A">(A)</num><content> a project on the Appalachian development highway system authorized by <ref href="/us/usc/t40/s14501">section 14501 of this title</ref>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf0ccc3cc-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s14526/c/3/B"><num value="B">(B)</num><content> a local development district administrative project assisted under <ref href="/us/usc/t40/s14321/a/1/A">section 14321(a)(1)(A) of this title</ref>; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf0ccc3cd-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s14526/c/3/C"><num value="C">(C)</num><chapeau> a multicounty project that is carried out in at least two counties designated under this section if—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idf0ccc3ce-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s14526/c/3/C/i"><num value="i">(i)</num><content> at least one of the participating counties is designated as a distressed county under this section; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf0ccc3cf-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s14526/c/3/C/ii"><num value="ii">(ii)</num><content> the project will be of substantial direct benefit to at least one distressed county.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf0ccc3d0-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s14526/c/4"><num value="4">(4)</num><heading> <inline class="small-caps">Waiver.—</inline></heading><subparagraph style="-uslm-lc:I13" class="indent2" id="idf0ccc3d1-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s14526/c/4/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>The Commission may waive the requirements of paragraphs (1) and (2) for a project when the recipient of assistance for the project shows the existence of any of the following:</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idf0ccc3d2-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s14526/c/4/A/i"><num value="i">(i)</num><content> a significant pocket of distress in the part of the county in which the project is carried out.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf0cce9e3-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s14526/c/4/A/ii"><num value="ii">(ii)</num><content> a significant potential benefit from the project in at least one area of the region outside the designated county.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf0cce9e4-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s14526/c/4/B"><num value="B">(B)</num><heading> <inline class="small-caps">Reports to congress</inline>.—</heading><content>The Commission shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives an annual report describing each waiver granted under subparagraph (A) during the period covered by the report.</content>
</subparagraph>
