L. 115–334, title VI, § 6304(f), Dec. 20, 2018, 132 Stat. 4752.)","seq_in_title":381,"parent_identifier":"/us/usc/t40/stV/ch153","ancestors":[{"identifier":"/us/usc/t40","level":"title","num":"Title 40—","heading":"PUBLIC BUILDINGS, PROPERTY, AND WORKS","status":null,"is_section":false},{"identifier":"/us/usc/t40/stV","level":"subtitle","num":"SUBTITLE V—","heading":"REGIONAL ECONOMIC AND INFRASTRUCTURE DEVELOPMENT","status":null,"is_section":false},{"identifier":"/us/usc/t40/stV/ch153","level":"chapter","num":"CHAPTER 153—","heading":"REGIONAL COMMISSIONS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idf0cd8678-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15301\"><num value=\"15301\">§ 15301.</num><heading> Establishment, membership, and employees</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf0cd8679-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15301/a\"><num value=\"a\">(a)</num><heading> <inline class=\"small-caps\">Establishment</inline>.—</heading><chapeau>There are established the following regional Commissions:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0cd867a-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15301/a/1\"><num value=\"1\">(1)</num><content> The Southeast Crescent Regional Commission.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0cd867b-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15301/a/2\"><num value=\"2\">(2)</num><content> The Southwest Border Regional Commission.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0cd867c-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15301/a/3\"><num value=\"3\">(3)</num><content> The Northern Border Regional Commission.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf0cd867d-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15301/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Membership.—</inline></heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0cd867e-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15301/b/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">Federal and state members</inline>.—</heading><chapeau>Each Commission shall be composed of the following members:</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf0cd867f-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15301/b/1/A\"><num value=\"A\">(A)</num><content> A Federal Cochairperson, to be appointed by the President, by and with the advice and consent of the Senate.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf0cd8680-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15301/b/1/B\"><num value=\"B\">(B)</num><content> The Governor of each participating State in the region of the Commission.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0cd8681-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15301/b/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Alternate members.—</inline></heading><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf0cd8682-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15301/b/2/A\"><num value=\"A\">(A)</num><heading> <inline class=\"small-caps\">Alternate federal cochairperson</inline>.—</heading><content>The President shall appoint an alternate Federal Cochairperson for each Commission. The alternate Federal Cochairperson, when not actively serving as an alternate for the Federal Cochairperson, shall perform such functions and duties as are delegated by the Federal Cochairperson.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf0cd8683-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15301/b/2/B\"><num value=\"B\">(B)</num><heading> <inline class=\"small-caps\">State alternates</inline>.—</heading><content>The State member of a participating State may have a single alternate, who shall be appointed by the Governor of the State from among the members of the Governor’s cabinet or personal staff.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf0cd8684-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15301/b/2/C\"><num value=\"C\">(C)</num><heading> <inline class=\"small-caps\">Voting</inline>.—</heading><content>An alternate member shall vote in the case of the absence, death, disability, removal, or resignation of the Federal or State member for which the alternate member is an alternate.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0cd8685-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15301/b/3\"><num value=\"3\">(3)</num><heading> <inline class=\"small-caps\">Cochairpersons</inline>.—</heading><chapeau>A Commission shall be headed by—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf0cd8686-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15301/b/3/A\"><num value=\"A\">(A)</num><content> the Federal Cochairperson, who shall serve as a liaison between the Federal Government and the Commission; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf0cd8687-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15301/b/3/B\"><num value=\"B\">(B)</num><content> a State Cochairperson, who shall be a Governor of a participating State in the region and shall be elected by the State members for a term of not less than 1 year.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0cd8688-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15301/b/4\"><num value=\"4\">(4)</num><heading> <inline class=\"small-caps\">Consecutive terms</inline>.—</heading><content>A State member may not be elected to serve as State Cochairperson for more than 2 consecutive terms.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf0cd8689-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15301/c\"><num value=\"c\">(c)</num><heading> <inline class=\"small-caps\">Compensation.—</inline></heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0cd868a-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15301/c/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">Federal cochairpersons</inline>.—</heading><content>Each Federal Cochairperson shall be compensated by the Federal Government at level III of the Executive Schedule as set out in <ref href=\"/us/usc/t5/s5314\">section 5314 of title 5</ref>.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0cd868b-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15301/c/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Alternate federal cochairpersons</inline>.—</heading><content>Each Federal Cochairperson’s alternate shall be compensated by the Federal Government at level V of the Executive Schedule as set out in <ref href=\"/us/usc/t5/s5316\">section 5316 of title 5</ref>.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0cd868c-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15301/c/3\"><num value=\"3\">(3)</num><heading> <inline class=\"small-caps\">State members and alternates</inline>.—</heading><content>Each State member and alternate shall be compensated by the State that they represent at the rate established by the laws of that State.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf0cd868d-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15301/d\"><num value=\"d\">(d)</num><heading> <inline class=\"small-caps\">Executive Director and Staff.—</inline></heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0cd868e-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15301/d/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>A Commission shall appoint and fix the compensation of an executive director and such other personnel as are necessary to enable the Commission to carry out its duties. Compensation under this paragraph may not exceed the maximum rate of basic pay established for the Senior Executive Service under <ref href=\"/us/usc/t5/s5382\">section 5382 of title 5</ref>, including any applicable locality-based comparability payment that may be authorized under section 5304(h)(2)(C) of that title.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0cd868f-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15301/d/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Executive director</inline>.—</heading><content>The executive director shall be responsible for carrying out the administrative duties of the Commission, directing the Commission staff, and such other duties as the Commission may assign.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf0cd8690-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15301/e\"><num value=\"e\">(e)</num><heading> <inline class=\"small-caps\">No Federal Employee Status</inline>.—</heading><content>No member, alternate, officer, or employee of a Commission (other than the Federal Cochairperson, the alternate Federal Cochairperson, staff of the Federal Cochairperson, and any Federal employee detailed to the Commission) shall be considered to be a Federal employee for any purpose.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf0cdada1-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15301/f\"><num value=\"f\">(f)</num><heading> <inline class=\"small-caps\">Succession</inline>.—</heading><content>Subject to the time limitations under <ref href=\"/us/usc/t5/s3346\">section 3346 of title 5</ref>, the Federal Cochairperson may designate a Federal employee of the Commission to perform the functions and duties of the office of the Federal Cochairperson temporarily in an acting capacity if both the Federal Cochairperson and the alternate Federal Cochairperson die, resign, or otherwise are unable to perform the functions and duties of their offices.</content>\n</subsection>\n<sourceCredit id=\"idf0cdada2-b211-11e9-9941-df2837ad0631\">(Added <ref href=\"/us/pl/110/234/tXIV/s14217/a/2\">Pub.
