L. 115–334, title VI, § 6304(b), Dec. 20, 2018, 132 Stat. 4749.)","seq_in_title":389,"parent_identifier":"/us/usc/t40/stV/ch155","ancestors":[{"identifier":"/us/usc/t40","level":"title","num":"Title 40—","heading":"PUBLIC BUILDINGS, PROPERTY, AND WORKS","status":null,"is_section":false},{"identifier":"/us/usc/t40/stV","level":"subtitle","num":"SUBTITLE V—","heading":"REGIONAL ECONOMIC AND INFRASTRUCTURE DEVELOPMENT","status":null,"is_section":false},{"identifier":"/us/usc/t40/stV/ch155","level":"chapter","num":"CHAPTER 155—","heading":"FINANCIAL ASSISTANCE","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idf0ce7163-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15501\"><num value=\"15501\">§ 15501.</num><heading> Economic and infrastructure development grants</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf0ce7164-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15501/a\"><num value=\"a\">(a)</num><heading> <inline class=\"small-caps\">In General</inline>.—</heading><chapeau>A Commission may make grants to States and local governments, Indian tribes, and public and nonprofit organizations for projects, approved in accordance with section 15503—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0ce7165-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15501/a/1\"><num value=\"1\">(1)</num><content> to develop the transportation infrastructure of its region;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0ce7166-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15501/a/2\"><num value=\"2\">(2)</num><content> to develop the basic public infrastructure of its region;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0ce7167-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15501/a/3\"><num value=\"3\">(3)</num><content> to develop the telecommunications infrastructure of its region;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0ce7168-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15501/a/4\"><num value=\"4\">(4)</num><content> to assist its region in obtaining job skills training, skills development and employment-related education, entrepreneurship, technology, and business development;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0ce7169-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15501/a/5\"><num value=\"5\">(5)</num><content> to provide assistance to severely economically distressed and underdeveloped areas of its region that lack financial resources for improving basic health care and other public services;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0ce716a-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15501/a/6\"><num value=\"6\">(6)</num><content> to promote resource conservation, tourism, recreation, and preservation of open space in a manner consistent with economic development goals;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0ce716b-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15501/a/7\"><num value=\"7\">(7)</num><content> to promote the development of renewable and alternative energy sources;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0ce716c-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15501/a/8\"><num value=\"8\">(8)</num><content> to grow the capacity for successful community economic development in its region; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0ce716d-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15501/a/9\"><num value=\"9\">(9)</num><content> to otherwise achieve the purposes of this subtitle.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf0ce716e-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15501/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Allocation of Funds</inline>.—</heading><content>A Commission shall allocate at least 40 percent of any grant amounts provided by the Commission in a fiscal year for projects described in paragraph (1), (2), (3), or (7) of subsection (a).</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf0ce716f-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15501/c\"><num value=\"c\">(c)</num><heading> <inline class=\"small-caps\">Sources of Grants</inline>.—</heading><content>Grant amounts may be provided entirely from appropriations to carry out this subtitle, in combination with amounts available under other Federal grant programs, or from any other source.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf0ce7170-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15501/d\"><num value=\"d\">(d)</num><heading> <inline class=\"small-caps\">Maximum Commission Contributions.—</inline></heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0ce7171-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15501/d/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>Subject to paragraphs (2) and (3), the Commission may contribute not more than 50 percent of a project or activity cost eligible for financial assistance under this section from amounts appropriated to carry out this subtitle.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0ce7172-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15501/d/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Distressed counties</inline>.—</heading><content>The maximum Commission contribution for a project or activity to be carried out in a county for which a distressed county designation is in effect under section 15702 may be increased to 80 percent.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0ce7173-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15501/d/3\"><num value=\"3\">(3)</num><heading> <inline class=\"small-caps\">Special rule for regional projects</inline>.—</heading><chapeau>A Commission may increase to 60 percent under paragraph (1) and 90 percent under paragraph (2) the maximum Commission contribution for a project or activity if—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf0ce7174-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15501/d/3/A\"><num value=\"A\">(A)</num><content> the project or activity involves 3 or more counties or more than one State; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf0ce7175-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15501/d/3/B\"><num value=\"B\">(B)</num><content> the Commission determines in accordance with section 15302(a) that the project or activity will bring significant interstate or multicounty benefits to a region.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf0ce7176-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15501/e\"><num value=\"e\">(e)</num><heading> <inline class=\"small-caps\">Maintenance of Effort</inline>.—</heading><content>Funds may be provided by a Commission for a program or project in a State under this section only if the Commission determines that the level of Federal or State financial assistance provided under a law other than this subtitle, for the same type of program or project in the same area of the State within region, will not be reduced as a result of funds made available by this subtitle.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf0ce9887-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s15501/f\"><num value=\"f\">(f)</num><heading> <inline class=\"small-caps\">No Relocation Assistance</inline>.—</heading><content>Financial assistance authorized by this section may not be used to assist a person or entity in relocating from one area to another, except that financial assistance may be used as otherwise authorized by this subtitle to attract businesses to the region from outside the United States.</content>\n</subsection>\n<sourceCredit id=\"idf0ce9888-b211-11e9-9941-df2837ad0631\">(Added <ref href=\"/us/pl/110/234/tXIV/s14217/a/2\">Pub. L. 115–334, title VI, § 6304(c)</ref>, <date date=\"2018-12-20\">Dec. 20, 2018</date>, <ref href=\"/us/stat/132/4750\">132 Stat. 4750</ref>, provided that:<quotedContent origin=\"/us/pl/115/334/tVI/s6304/c\">\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">Definitions</inline>.—</heading><chapeau>In this subsection:</chapeau><subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"A\">“(A)</num><heading> <inline class=\"small-caps\">Commission</inline>.—</heading><content>The term ‘Commission’ means the Northern Border Regional Commission established by <ref href=\"/us/usc/t40/s15301/a/3\">section 15301(a)(3) of title 40</ref>, United States Code.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"B\">“(B)</num><heading> <inline class=\"small-caps\">Commission state</inline>.—</heading><content>The term ‘Commission State’ means each of the States of Maine, New Hampshire, New York, and Vermont.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"C\">“(C)</num><heading> <inline class=\"small-caps\">Eligible county</inline>.—</heading><content>The term ‘eligible county’ means a county described in <ref href=\"/us/usc/t40/s15733\">section 15733 of title 40</ref>, United States Code.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"D\">“(D)</num><heading> <inline class=\"small-caps\">Program</inline>.—</heading><content>The term ‘program’ means the State capacity building grant program established under paragraph (2).</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Establishment</inline>.—</heading><content>Not later than 180 days after the date of enactment of this Act [<date date=\"2018-12-20\">Dec. 20, 2018</date>], the Commission shall establish a State capacity building grant program to provide grants to Commission States to carry out the purpose under paragraph (3).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"3\">“(3)</num><heading> <inline class=\"small-caps\">Purpose</inline>.—</heading><chapeau>The purpose of the program is to support the efforts of the Commission—</chapeau><subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"A\">“(A)</num><content> to better support business retention and expansion in eligible counties;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"B\">“(B)</num><content> to create programs to encourage job creation and workforce development in eligible counties;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"C\">“(C)</num><content> to prepare economic and infrastructure plans for eligible counties;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"D\">“(D)</num><content> to expand access to high-speed broadband in eligible counties;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"E\">“(E)</num><content> to provide technical assistance that results in Commission investments in transportation, water, wastewater, and other critical infrastructure;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"F\">“(F)</num><content> to create initiatives to increase the effectiveness of local development districts in eligible counties; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"G\">“(G)</num><content> to implement new or innovative economic development practices that will better position the eligible counties of Commission States to compete in the global economy.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"4\">“(4)</num><heading> <inline class=\"small-caps\">Use of funds.—</inline></heading><subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"A\">“(A)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>Funds from a grant under the program may be used to support a project, program, or related expense of the Commission State in an eligible county.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"B\">“(B)</num><heading> <inline class=\"small-caps\">Limitation</inline>.—</heading><chapeau>Funds from a grant under the program shall not be used for—</chapeau><clause style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"i\">“(i)</num><content> the purchase of furniture, fixtures, or equipment;</content>\n</clause>\n<clause style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"ii\">“(ii)</num><chapeau> the compensation of—</chapeau><subclause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"I\">“(I)</num><content> any State member of the Commission (as described in <ref href=\"/us/usc/t40/s15301/b/1/B\">section 15301(b)(1)(B) of title 40</ref>, United States Code); or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"II\">“(II)</num><content> any State alternate member of the Commission (as described in <ref href=\"/us/usc/t40/s15301/b/2/B\">section 15301(b)(2)(B) of title 40</ref>, United States Code); or</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"iii\">“(iii)</num><content> the cost of supplanting existing State programs.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"5\">“(5)</num><heading> <inline class=\"small-caps\">Annual work plan.—</inline></heading><subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"A\">“(A)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>For each fiscal year, before providing a grant under the program, each Commission State shall provide to the Commission an annual work plan that includes the proposed use of the grant.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"B\">“(B)</num><heading> <inline class=\"small-caps\">Approval</inline>.—</heading><content>No grant under the program shall be provided to a Commission State unless the Commission has approved the annual work plan of the State.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"6\">“(6)</num><heading> <inline class=\"small-caps\">Amount of grant.—</inline></heading><subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"A\">“(A)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><chapeau>The amount of a grant provided to a Commission State under the program for a fiscal year shall be based on the proportion that—</chapeau><clause style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"i\">“(i)</num><content> the amount paid by the Commission State (including any amounts paid on behalf of the Commission State by a nonprofit organization) for administrative expenses for the applicable fiscal year (as determined under <ref href=\"/us/usc/t40/s15304/c\">section 15304(c) of title 40</ref>, United States Code); bears to</content>\n</clause>\n<clause style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"ii\">“(ii)</num><content> the amount paid by all Commission States (including any amounts paid on behalf of a Commission State by a nonprofit organization) for administrative expenses for that fiscal year (as determined under that section).</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"B\">“(B)</num><heading> <inline class=\"small-caps\">Requirement</inline>.—</heading><content>To be eligible to receive a grant under the program for a fiscal year, a Commission State (or a nonprofit organization on behalf of the Commission State) shall pay the amount of administrative expenses of the Commission State for the applicable fiscal year (as determined under <ref href=\"/us/usc/t40/s15304/c\">section 15304(c) of title 40</ref>, United States Code).</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"C\">“(C)</num><heading> <inline class=\"small-caps\">Approval</inline>.—</heading><content>For each fiscal year, a grant provided under the program shall be approved and made available as part of the approval of the annual budget of the Commission.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"7\">“(7)</num><heading> <inline class=\"small-caps\">Grant availability</inline>.—</heading><content>Funds from a grant under the program shall be available only during the fiscal year for which the grant is provided.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"8\">“(8)</num><heading> <inline class=\"small-caps\">Report</inline>.—</heading><content>Each fiscal year, each Commission State shall submit to the Commission and make publicly available a report that describes the use of the grant funds and the impact of the program in the State.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"9\">“(9)</num><heading> <inline class=\"small-caps\">Funding.—</inline></heading><subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"A\">“(A)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>There is authorized to be appropriated to carry out this subsection $5,000,000 for each of fiscal years 2019 through 2023.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"B\">“(B)</num><heading> <inline class=\"small-caps\">Supplement, not supplant</inline>.—</heading><content>Funds made available to carry out this subsection shall supplement and not supplant funds made available for the Commission and other activities of the Commission.”</content>\n</subparagraph>\n</paragraph>\n</quotedContent>\n</p>\n</note>\n</notes>\n</section>","provision":null,"duplicates":[],"release":{"label":"116-252","currency_date":"2020-12-22","congress":116,"law_num":252,"excluded_laws":[],"update_num":null,"seq":222,"is_partial":false,"caveat":null,"titles_affected":["18","20","31","34","40","42"],"ingested_titles":[]},"served_from":{"label":"116-252","currency_date":"2020-12-22","congress":116,"law_num":252,"excluded_laws":[],"update_num":null,"seq":222,"is_partial":false,"caveat":null,"titles_affected":["18","20","31","34","40","42"],"ingested_titles":[]},"content_first_seen":{"label":"116-33","currency_date":"2019-07-25","congress":116,"law_num":33,"excluded_laws":[],"update_num":null,"seq":178,"is_partial":false,"caveat":null,"titles_affected":["12","18","26","28","34","38","40","44"],"ingested_titles":[]},"is_exact":true,"note":null}
