L. 107–217, Aug. 21, 2002, 116 Stat. 1280.)","seq_in_title":407,"parent_identifier":"/us/usc/t40/stVI/ch173","ancestors":[{"identifier":"/us/usc/t40","level":"title","num":"Title 40—","heading":"PUBLIC BUILDINGS, PROPERTY, AND WORKS","status":null,"is_section":false},{"identifier":"/us/usc/t40/stVI","level":"subtitle","num":"SUBTITLE VI—","heading":"MISCELLANEOUS","status":null,"is_section":false},{"identifier":"/us/usc/t40/stVI/ch173","level":"chapter","num":"CHAPTER 173—","heading":"GOVERNMENT LOSSES IN SHIPMENT","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idf0d01eeb-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s17301\"><num value=\"17301\">§ 17301.</num><heading> Definitions</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In this chapter, the following definitions apply:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0d01eec-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s17301/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">Replacement</inline>.—</heading><content>The term “replacement” means payment, reimbursement, replacement, or duplication or the expenses incident to payment, reimbursement, replacement, or duplication.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0d01eed-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s17301/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Shipment</inline>.—</heading><chapeau>The term “shipment”—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf0d01eee-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s17301/2/A\"><num value=\"A\">(A)</num><content> means the transportation, or the effecting of transportation, of valuables, without limitation as to the means or facilities used or by which the transportation is effected or the person to whom it is made; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf0d045ff-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s17301/2/B\"><num value=\"B\">(B)</num><content> includes shipments made to any executive department, independent establishment, agency, wholly owned or mixed-ownership Government corporation, officer, or employee of the Federal Government, or any person acting on behalf of, or at the direction of, the executive department, independent establishment, agency, wholly or partly owned Government corporation, officer, or employee.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0d04600-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s17301/3\"><num value=\"3\">(3)</num><heading> <inline class=\"small-caps\">Valuables.—</inline></heading><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf0d04601-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s17301/3/A\"><num value=\"A\">(A)</num><heading> <inline class=\"small-caps\">Definition</inline>.—</heading><chapeau>The term “valuables” means any articles or things or representatives of value—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf0d04602-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s17301/3/A/i\"><num value=\"i\">(i)</num><content> in which the Government, its executive departments, independent establishments, and agencies, including wholly owned Government corporations, and officers and employees of the Government or its executive departments, independent establishments, and agencies while acting in their official capacity, have any interest, or in connection with which they have any obligation or responsibility; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf0d04603-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s17301/3/A/ii\"><num value=\"ii\">(ii)</num><content> which the Secretary of the Treasury declares to be valuables within the meaning of this chapter.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf0d04604-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s17301/3/B\"><num value=\"B\">(B)</num><heading> <inline class=\"small-caps\">Requirement for declaring articles or things valuable</inline>.—</heading><content>The Secretary shall not declare articles or things that are lost, destroyed, or damaged in the course of shipment to be valuables unless the Secretary determines that replacement of the articles or things in accordance with the procedure established in this chapter would be in the public interest.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf0d04605-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s17301/4\"><num value=\"4\">(4)</num><heading> <inline class=\"small-caps\">Wholly owned government corporation</inline>.—</heading><chapeau>The term “wholly owned Government corporation”—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf0d04606-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s17301/4/A\"><num value=\"A\">(A)</num><content> means any corporation, regardless of the law under which it is incorporated, the capital of which is entirely owned by the Government; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf0d04607-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s17301/4/B\"><num value=\"B\">(B)</num><content> includes the authorized officers, employees, and agents of the corporation.</content>\n</subparagraph>\n</paragraph>\n<sourceCredit id=\"idf0d04608-b211-11e9-9941-df2837ad0631\">(<ref href=\"/us/pl/107/217\">Pub.
