L. 107–217, Aug. 21, 2002, 116 Stat. 1290.)","seq_in_title":437,"parent_identifier":"/us/usc/t40/stVI/ch179","ancestors":[{"identifier":"/us/usc/t40","level":"title","num":"Title 40—","heading":"PUBLIC BUILDINGS, PROPERTY, AND WORKS","status":null,"is_section":false},{"identifier":"/us/usc/t40/stVI","level":"subtitle","num":"SUBTITLE VI—","heading":"MISCELLANEOUS","status":null,"is_section":false},{"identifier":"/us/usc/t40/stVI/ch179","level":"chapter","num":"CHAPTER 179—","heading":"ALASKA FEDERAL-CIVILIAN ENERGY EFFICIENCY SWAP","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id38fb7aef-56ae-11e3-9436-86e561d18d41\" identifier=\"/us/usc/t40/s17904\"><num value=\"17904\">§ 17904.</num><heading> Implementation powers and limitations</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id38fb7af0-56ae-11e3-9436-86e561d18d41\" identifier=\"/us/usc/t40/s17904/a\"><num value=\"a\">(a)</num><heading> <inline class=\"small-caps\">Accommodation of Needs for Electric Energy</inline>.—</heading><content>This chapter does not require or authorize a federal agency to construct a new electric generating facility or related facility, to modify an existing facility, or to employ reserve or standby equipment to accommodate the needs of a non-federal person for electric energy.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id38fb7af1-56ae-11e3-9436-86e561d18d41\" identifier=\"/us/usc/t40/s17904/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Availability of Revenue From Sales</inline>.—</heading><content>Revenue received by a federal agency pursuant to <ref href=\"/us/usc/t40/s17902\">section 17902 of this title</ref> from the sale of electric energy generated from a facility of that agency is available to the agency without fiscal year limitation to purchase fuel and for operation, maintenance, and other costs associated with that facility.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id38fb7af2-56ae-11e3-9436-86e561d18d41\" identifier=\"/us/usc/t40/s17904/c\"><num value=\"c\">(c)</num><heading> <inline class=\"small-caps\">Exercise of Authorities</inline>.—</heading><chapeau>The authority under this chapter shall be exercised for those periods and pursuant to terms and conditions that the head of the federal agency concerned decides are necessary consistent with—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id38fb7af3-56ae-11e3-9436-86e561d18d41\" identifier=\"/us/usc/t40/s17904/c/1\"><num value=\"1\">(1)</num><content> this chapter; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id38fb7af4-56ae-11e3-9436-86e561d18d41\" identifier=\"/us/usc/t40/s17904/c/2\"><num value=\"2\">(2)</num><content> responsibilities of the head of the federal agency under other law.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id38fb7af5-56ae-11e3-9436-86e561d18d41\" identifier=\"/us/usc/t40/s17904/d\"><num value=\"d\">(d)</num><heading> <inline class=\"small-caps\">Negotiation and Execution of Contracts and Other Agreements</inline>.—</heading><content>A contract or other agreement executed under this chapter shall be negotiated and executed by the head of the federal agency selling or purchasing electric energy under this chapter.</content>\n</subsection>\n<sourceCredit id=\"id38fb7af6-56ae-11e3-9436-86e561d18d41\">(<ref href=\"/us/pl/107/217\">Pub.
