L. 111–350, § 5(l)(5), Jan. 4, 2011, 124 Stat. 3851.)","seq_in_title":16,"parent_identifier":"/us/usc/t40/stI/ch3/schII","ancestors":[{"identifier":"/us/usc/t40","level":"title","num":"Title 40—","heading":"PUBLIC BUILDINGS, PROPERTY, AND WORKS","status":null,"is_section":false},{"identifier":"/us/usc/t40/stI","level":"subtitle","num":"SUBTITLE I—","heading":"FEDERAL PROPERTY AND ADMINISTRATIVE SERVICES","status":null,"is_section":false},{"identifier":"/us/usc/t40/stI/ch3","level":"chapter","num":"CHAPTER 3—","heading":"ORGANIZATION OF GENERAL SERVICES ADMINISTRATION","status":null,"is_section":false},{"identifier":"/us/usc/t40/stI/ch3/schII","level":"subchapter","num":"SUBCHAPTER II—","heading":"ADMINISTRATIVE","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id3844118b-56ae-11e3-9436-86e561d18d41\" identifier=\"/us/usc/t40/s311\"><num value=\"311\">§ 311.</num><heading> Personnel</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id3844118c-56ae-11e3-9436-86e561d18d41\" identifier=\"/us/usc/t40/s311/a\"><num value=\"a\">(a)</num><heading> <inline class=\"small-caps\">Appointment and Compensation</inline>.—</heading><content>The Administrator of General Services, subject to chapters 33 and 51 and subchapter III of chapter 53 of title 5, may appoint and fix the compensation of personnel necessary to carry out chapters 1, 3, and 5 of this title and division C (except sections 3302, 3501(b), 3509, 3906, 4710, and 4711) of subtitle I of title 41.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id3844118d-56ae-11e3-9436-86e561d18d41\" identifier=\"/us/usc/t40/s311/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Temporary Employment</inline>.—</heading><content>The Administrator may procure the temporary or intermittent services of experts or consultants under <ref href=\"/us/usc/t5/s3109\">section 3109 of title 5</ref> to the extent the Administrator finds necessary to carry out chapters 1, 3, and 5 of this title and division C (except sections 3302, 3501(b), 3509, 3906, 4710, and 4711) of subtitle I of title 41.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id3844118e-56ae-11e3-9436-86e561d18d41\" identifier=\"/us/usc/t40/s311/c\"><num value=\"c\">(c)</num><heading> <inline class=\"small-caps\">Personnel From Other Agencies</inline>.—</heading><content>Notwithstanding <ref href=\"/us/usc/t10/s973\">section 973 of title 10</ref> or any other law, in carrying out functions under this subtitle the Administrator may use the services of personnel (including armed services personnel) from an executive agency other than the General Services Administration with the consent of the head of the agency.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id3844118f-56ae-11e3-9436-86e561d18d41\" identifier=\"/us/usc/t40/s311/d\"><num value=\"d\">(d)</num><heading> <inline class=\"small-caps\">Detail of Field Personnel to District of Columbia</inline>.—</heading><content>The Administrator, in the Administrator’s discretion, may detail field personnel of the Administration to the District of Columbia for temporary duty for a period of not more than 30 days in any one case. The responsibilities of the Administrator of General Services under title V were given to the Archivist of the United States, National Historical Publications and Records Commission, and Advisory Committee on the Records of Congress.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">In subsection (a), the words “subject to chapters 33 and 51 and subchapter III of chapter 53 of title 5” are substituted for “subject to the civil-service and classification laws” because of <ref href=\"/us/act/1966-09-06/s7/b\">section 7(b) of the Act of September 6, 1966</ref> (<ref href=\"/us/pl/89/554\">Public Law 89–554</ref>, <ref href=\"/us/stat/80/631\">80 Stat. 631</ref>), the first section of which enacted Title 5, United States Code.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">In subsection (b), the words “under <ref href=\"/us/usc/t5/s3109\">section 3109 of title 5</ref>” are substituted for “(not in excess of one year)” and “or organizations thereof, including stenographic reporting services, by contract or appointment, and in such cases such service shall be without regard to the civil-service and classification laws, and except in the case of stenographic reporting services by organizations, without regard to <ref href=\"/us/usc/t41/s5\">section 5 of title 41</ref>” for clarity and to eliminate unnecessary words.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">In subsection (c), the words “<ref href=\"/us/usc/t10/s973\">section 973 of title 10</ref>” are substituted for “section 1222 of the Revised Statutes (10 U. S. C. 576)” in section 208(c) of the Federal Property and Administrative Services Act of 1949 because of <ref href=\"/us/act/1956-08-10/s49/b\">section 49(b) of the Act of August 10, 1956</ref> (ch. 1041, <ref href=\"/us/stat/70A/640\">70A Stat. 640</ref>), the first section of which enacted Title 10, United States Code, and section 4(a)(5) and (6) of the Act of <date date=\"1968-01-02\">January 2, 1968</date> (<ref href=\"/us/pl/90/235\">Public Law 90–235</ref>, <ref href=\"/us/stat/81/759\">81 Stat. 759</ref>). The words “personnel (including armed services personnel) from an executive agency other than the General Services Administration” are substituted for “officials, officers, and other personnel in other executive agencies, including personnel of the armed services” for clarity and to eliminate unnecessary words.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">In subsection (d), the words “On and after <date date=\"1913-06-23\">June 23, 1913</date>” are omitted as obsolete. The word “Administrator” is substituted for “Secretary of the Treasury” [subsequently changed to “Federal Works Administrator” because of section 301 of Reorganization Plan No. I of 1939 (eff. <date date=\"1939-07-01\">July 1, 1939</date>, <ref href=\"/us/stat/53/1426\">53 Stat. 1426</ref>)], and the word “Administration” [meaning the General Services Administration] is substituted for “public-buildings service” and “Office of the Supervising Architect” [subsequently changed to “Public Buildings Administration” because of section 1 of Executive Order No. 6166 (eff. <date date=\"1933-06-10\">June 10, 1933</date>) and section 303 of Reorganization Plan No. I of 1939 (eff. <date date=\"1939-07-01\">July 1, 1939</date>, <ref href=\"/us/stat/53/1427\">53 Stat. 1427</ref>)], because of section 103(a) of the Federal Property and Administrative Services Act of 1949 (ch. 288, <ref href=\"/us/stat/63/380\">63 Stat. 380</ref>), which is restated as section 303(c) [303(b)] of the revised title.
