L. 107–217, Aug. 21, 2002, 116 Stat. 1073.)","seq_in_title":18,"parent_identifier":"/us/usc/t40/stI/ch3/schII","ancestors":[{"identifier":"/us/usc/t40","level":"title","num":"Title 40—","heading":"PUBLIC BUILDINGS, PROPERTY, AND WORKS","status":null,"is_section":false},{"identifier":"/us/usc/t40/stI","level":"subtitle","num":"SUBTITLE I—","heading":"FEDERAL PROPERTY AND ADMINISTRATIVE SERVICES","status":null,"is_section":false},{"identifier":"/us/usc/t40/stI/ch3","level":"chapter","num":"CHAPTER 3—","heading":"ORGANIZATION OF GENERAL SERVICES ADMINISTRATION","status":null,"is_section":false},{"identifier":"/us/usc/t40/stI/ch3/schII","level":"subchapter","num":"SUBCHAPTER II—","heading":"ADMINISTRATIVE","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idf088b569-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s313\"><num value=\"313\">§ 313.</num><heading> Tests of materials</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf088b56a-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s313/a\"><num value=\"a\">(a)</num><heading> <inline class=\"small-caps\">Scope</inline>.—</heading><content>This section applies to any article or commodity tendered by a producer or vendor for sale or lease to the General Services Administration or to any procurement authority acting under the direction and control of the Administrator of General Services pursuant to this subtitle.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf088b56b-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s313/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Authority To Conduct Tests</inline>.—</heading><chapeau>The Administrator, in the Administrator’s discretion and with the consent of the producer or vendor, may have tests conducted, in a manner the Administrator specifies, to—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf088b56c-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s313/b/1\"><num value=\"1\">(1)</num><content> determine whether an article or commodity conforms to prescribed specifications and standards; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf088b56d-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s313/b/2\"><num value=\"2\">(2)</num><content> aid in the development of specifications and standards.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idf088b56e-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s313/c\"><num value=\"c\">(c)</num><heading> <inline class=\"small-caps\">Fees.—</inline></heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf088b56f-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s313/c/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>The Administrator shall charge the producer or vendor a fee for the tests.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf088b570-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s313/c/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Amount of fee if tests predominantly serve interest of producer or vendor</inline>.—</heading><content>If the Administrator determines that conducting the tests predominantly serves the interest of the producer or vendor, the Administrator shall fix the fee in an amount that will recover the costs of conducting the tests, including all components of the costs, determined in accordance with accepted accounting principles.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf088b571-b211-11e9-9941-df2837ad0631\" identifier=\"/us/usc/t40/s313/c/3\"><num value=\"3\">(3)</num><heading> <inline class=\"small-caps\">Amount of fee if tests do not predominantly serve interest of producer or vendor</inline>.—</heading><content>If the Administrator determines that conducting the tests does not predominantly serve the interest of the producer or vendor, the Administrator shall fix the fee in an amount the Administrator determines is reasonable for furnishing the testing service.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"idf088dc82-b211-11e9-9941-df2837ad0631\">(<ref href=\"/us/pl/107/217\">Pub.
