<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idf0a4c8dd-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3177"><num value="3177">§ 3177.</num><heading> Use of photovoltaic energy in public buildings</heading><subsection style="-uslm-lc:I11" class="indent0" id="idf0a4c8de-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3177/a"><num value="a">(a)</num><heading> <inline class="small-caps">Photovoltaic Energy Commercialization Program.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="idf0a4c8df-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3177/a/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The Administrator of General Services may establish a photovoltaic energy commercialization program for the procurement and installation of photovoltaic solar electric systems for electric production in new and existing public buildings.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf0a4c8e0-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3177/a/2"><num value="2">(2)</num><heading> <inline class="small-caps">Purposes</inline>.—</heading><chapeau>The purposes of the program shall be to accomplish the following:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf0a4c8e1-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3177/a/2/A"><num value="A">(A)</num><content> To accelerate the growth of a commercially viable photovoltaic industry to make this energy system available to the general public as an option which can reduce the national consumption of fossil fuel.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf0a4c8e2-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3177/a/2/B"><num value="B">(B)</num><content> To reduce the fossil fuel consumption and costs of the Federal Government.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf0a4c8e3-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3177/a/2/C"><num value="C">(C)</num><content> To attain the goal of installing solar energy systems in 20,000 Federal buildings by 2010, as contained in the Federal Government’s Million Solar Roof Initiative of 1997.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf0a4c8e4-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3177/a/2/D"><num value="D">(D)</num><content> To stimulate the general use within the Federal Government of life-cycle costing and innovative procurement methods.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf0a4c8e5-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3177/a/2/E"><num value="E">(E)</num><content> To develop program performance data to support policy decisions on future incentive programs with respect to energy.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf0a4c8e6-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3177/a/3"><num value="3">(3)</num><heading> <inline class="small-caps">Acquisition of photovoltaic solar electric systems.—</inline></heading><subparagraph style="-uslm-lc:I13" class="indent2" id="idf0a4c8e7-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3177/a/3/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The program shall provide for the acquisition of photovoltaic solar electric systems and associated storage capability for use in public buildings.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf0a4c8e8-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3177/a/3/B"><num value="B">(B)</num><heading> <inline class="small-caps">Acquisition levels</inline>.—</heading><content>The acquisition of photovoltaic electric systems shall be at a level substantial enough to allow use of low-cost production techniques with at least 150 megawatts (peak) cumulative acquired during the 5 years of the program.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf0a4c8e9-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3177/a/4"><num value="4">(4)</num><heading> <inline class="small-caps">Administration</inline>.—</heading><chapeau>The Administrator shall administer the program and shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf0a4c8ea-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3177/a/4/A"><num value="A">(A)</num><content> issue such rules and regulations as may be appropriate to monitor and assess the performance and operation of photovoltaic solar electric systems installed pursuant to this subsection;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf0a4c8eb-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3177/a/4/B"><num value="B">(B)</num><content> develop innovative procurement strategies for the acquisition of such systems; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf0a4c8ec-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3177/a/4/C"><num value="C">(C)</num><content> transmit to Congress an annual report on the results of the program.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idf0a4effd-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3177/b"><num value="b">(b)</num><heading> <inline class="small-caps">Photovoltaic Systems Evaluation Program.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="idf0a4effe-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3177/b/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Not later than 60 days after the date of enactment of this section, the Administrator shall establish a photovoltaic solar energy systems evaluation program to evaluate such photovoltaic solar energy systems as are required in public buildings.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf0a4efff-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3177/b/2"><num value="2">(2)</num><heading> <inline class="small-caps">Program requirement</inline>.—</heading><content>In evaluating photovoltaic solar energy systems under the program, the Administrator shall ensure that such systems reflect the most advanced technology.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idf0a4f000-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3177/c"><num value="c">(c)</num><heading> <inline class="small-caps">Authorization of Appropriations.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="idf0a4f001-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3177/c/1"><num value="1">(1)</num><heading> <inline class="small-caps">Photovoltaic energy commercialization program</inline>.—</heading><content>There are authorized to be appropriated to carry out subsection (a) $50,000,000 for each of fiscal years 2006 through 2010. Such sums shall remain available until expended.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf0a4f002-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3177/c/2"><num value="2">(2)</num><heading> <inline class="small-caps">Photovoltaic systems evaluation program</inline>.—</heading><content>There are authorized to be appropriated to carry out subsection (b) $10,000,000 for each of fiscal years 2006 through 2010. Such sums shall remain available until expended.</content>
