<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idf0a787f6-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3313"><num value="3313">§ 3313.</num><heading> Use of energy efficient lighting fixtures and bulbs</heading><subsection style="-uslm-lc:I11" class="indent0" id="idf0a787f7-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3313/a"><num value="a">(a)</num><heading> <inline class="small-caps">Construction, Alteration, and Acquisition of Public Buildings</inline>.—</heading><content>Each public building constructed, altered, or acquired by the Administrator of General Services shall be equipped, to the maximum extent feasible as determined by the Administrator, with lighting fixtures and bulbs that are energy efficient.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idf0a7af08-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3313/b"><num value="b">(b)</num><heading> <inline class="small-caps">Maintenance of Public Buildings</inline>.—</heading><content>Each lighting fixture or bulb that is replaced by the Administrator in the normal course of maintenance of public buildings shall be replaced, to the maximum extent feasible, with a lighting fixture or bulb that is energy efficient.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idf0a7af09-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3313/c"><num value="c">(c)</num><heading> <inline class="small-caps">Considerations</inline>.—</heading><chapeau>In making a determination under this section concerning the feasibility of installing a lighting fixture or bulb that is energy efficient, the Administrator shall consider—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idf0a7af0a-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3313/c/1"><num value="1">(1)</num><content> the life-cycle cost effectiveness of the fixture or bulb;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf0a7af0b-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3313/c/2"><num value="2">(2)</num><content> the compatibility of the fixture or bulb with existing equipment;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf0a7af0c-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3313/c/3"><num value="3">(3)</num><content> whether use of the fixture or bulb could result in interference with productivity;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf0a7af0d-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3313/c/4"><num value="4">(4)</num><content> the aesthetics relating to use of the fixture or bulb; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf0a7af0e-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3313/c/5"><num value="5">(5)</num><content> such other factors as the Administrator determines appropriate.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idf0a7af0f-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3313/d"><num value="d">(d)</num><heading> <inline class="small-caps">Energy Star</inline>.—</heading><chapeau>A lighting fixture or bulb shall be treated as being energy efficient for purposes of this section if—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idf0a7af10-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3313/d/1"><num value="1">(1)</num><content> the fixture or bulb is certified under the Energy Star program established by section 324A of the Energy Policy and Conservation Act (<ref href="/us/usc/t42/s6294a">42 U.S.C. 6294a</ref>);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf0a7af11-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3313/d/2"><num value="2">(2)</num><content> in the case of all light-emitting diode (LED) luminaires, lamps, and systems whose efficacy (lumens per watt) and Color Rendering Index (CRI) meet the Department of Energy requirements for minimum luminaire efficacy and CRI for the Energy Star certification, as verified by an independent third-party testing laboratory that the Administrator and the Secretary of Energy determine conducts its tests according to the procedures and recommendations of the Illuminating Engineering Society of North America, even if the luminaires, lamps, and systems have not received such certification; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf0a7af12-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3313/d/3"><num value="3">(3)</num><content> the Administrator and the Secretary of Energy have otherwise determined that the fixture or bulb is energy efficient.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idf0a7af13-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3313/e"><num value="e">(e)</num><heading> <inline class="small-caps">Additional Energy Efficient Lighting Designations</inline>.—</heading><content>The Administrator of the Environmental Protection Agency and the Secretary of Energy shall give priority to establishing Energy Star performance criteria or Federal Energy Management Program designations for additional lighting product categories that are appropriate for use in public buildings.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idf0a7af14-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3313/f"><num value="f">(f)</num><heading> <inline class="small-caps">Guidelines</inline>.—</heading><content>The Administrator shall develop guidelines for the use of energy efficient lighting technologies that contain mercury in child care centers in public buildings.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idf0a7af15-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3313/g"><num value="g">(g)</num><heading> <inline class="small-caps">Applicability of Buy American Act</inline>.—</heading><content>Acquisitions carried out pursuant to this section shall be subject to the requirements of the Buy American Act <ref class="footnoteRef" idref="fn002015">1</ref><note type="footnote" id="fn002015"><num>1</num> See References in Text note below.</note> (<ref href="/us/usc/t41/s10c">41 U.S.C. 10c</ref> et seq.).</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idf0a7af16-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3313/h"><num value="h">(h)</num><heading> <inline class="small-caps">Effective Date</inline>.—</heading><content>The requirements of subsections (a) and (b) shall take effect 1 year after the date of enactment of this subsection.</content>
