<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idf0a7d62c-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3314"><num value="3314">§ 3314.</num><heading> Baby changing facilities in restrooms</heading><subsection style="-uslm-lc:I11" class="indent0" id="idf0a7d62d-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3314/a"><num value="a">(a)</num><heading> <inline class="small-caps">Additional Requirement for the Construction, Alteration, and Acquisition of Public Buildings</inline>.—</heading><content>Except as provided in subsection (b) and subject to any reasonable accommodations that may be made for individuals in accordance with the Americans with Disabilities Act (<ref href="/us/usc/t42/s12101">42 U.S.C. 12101</ref> et seq.) restrooms in a public building shall be equipped with baby changing facilities that the Administrator determines are physically safe, sanitary, and appropriate.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idf0a7d62e-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3314/b"><num value="b">(b)</num><heading> <inline class="small-caps">Exceptions</inline>.—</heading><chapeau>The requirement under subsection (a) shall not apply—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idf0a7d62f-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3314/b/1"><num value="1">(1)</num><content> to a restroom in a public building that is not available or accessible for public use;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf0a7d630-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3314/b/2"><num value="2">(2)</num><content> to a restroom in a public building that contains clear and conspicuous signage indicating where a restroom with a baby changing table is located on the same floor of such public building;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf0a7d631-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3314/b/3"><num value="3">(3)</num><content> if new construction would be required to install a baby changing facility in the public building and the cost of such construction is unfeasible; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf0a7d632-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3314/b/4"><num value="4">(4)</num><content> to a building not subject to an alteration as set forth in section 3307.</content>

<subsection style="-uslm-lc:I11" class="indent0" id="idf0a7d633-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3314/c"><num value="c">(c)</num><heading> <inline class="small-caps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idf0a7d634-b211-11e9-9941-df2837ad0631" identifier="/us/usc/t40/s3314/c/1"><num value="1">(1)</num><heading> <inline class="small-caps">Baby changing facility</inline>.—</heading><content>The term “baby changing facility” means a table or other device suitable for changing the diaper of a child age 3 or under.</content>
